After further review, the water depths at the previous pier location were too shallow for fishing and canoe /kayak launching. Therefore, the pier location was revised to relocate it to an area with sufficient water depths. The relocation of the pier has resulted in a revision to the walking trail alignment and a change in the previously permitted buffer impacts. Therefore, we are requesting a modification of the buffer authorization to reflect the current alignment and required buffer impacts. The project area is located within Phase SF -7 of the South Lakes Subdivision on NC 55 in Fuquay, Wake County. The specific project area is located on the western edge of the onsite lake at Lat: 35.5739 °N; -78.7434 0W• The project is located in the Neuse River basin and the onsite waters drain to Black Creek. The Water Quality Classification for Black Creek is B; NSW and the Stream Index Number is:27-45-(1). The cataloging unit forthe site is 03020201. Proposed Proiect The proposed project consists of the construction of a walking trail, which will connect the greenway parking area to the future amenity pier within Phase SF -7. The walking trail will cross the riparian buffers of the onsite pond. Please note that the future amenity pier does not require a permit as a piling supported pier does not constitute impacts to jurisdictional surface waters and therefore does not require authorization from the Corps or NCDWR. Project History A Buffer Determination was issued for the South Lakes Subdivision (NBRRO# 12 -059) on August 21, 2012. A copy of the Buffer Authorization has been provided as an Appendix. The Corps of Engineers issued a Jurisdictional Determination for the South Lakes Subdivision (SAW - 2012- 01484) on September 14, 2012. A copy of the 401 WQC & Buffer Authorization has been provided as an Appendix. On May 27, 2014 NCDWR issued a Buffer Authorization for the previous alignment of walking trail connecting the parking area to the pier on May 27, 2014 (DWR #12- o821v.2), which has been provided as an Appendix. However, after further inspection of the previously proposed pier location, the water depths were too shallow for either fishing or canoe /kayak launching. Therefore, the pier location was revised to an area with sufficient water depths. This required a realignment of the walking trail connecting the parking area to the pier, resulting in this request for a revision to the Buffer Authorization. Proposed Impacts The currently proposed impacts consist of 626 sq ft of permanent Zone 1 impacts and 996 sq ft of permanent Zone 2 impacts for the construction of the walking trail connecting the greenway parking area to the future amenity pier. Avoidance and Minimization The proposed walking trail has been designed to cross the riparian buffer at a perpendicular angle. Mitigation The proposed impacts from the walking trail are "Allowable" and therefore no mitigation is proposed. The current request is for 1,622 sq ft of permanent impacts to riparian buffers (see the attached maps and PCN for details).
