(SEGi) has been retained by Navaho Development Company, LLC (see Attachment 1), herein referred to as the "Applicant ", to submit the attached Pre - Construction Notification (PCN) and accompanying attachments (see Attachment 2). The project site is located at 1300 Navaho Trail, off Myrtle Grove Road, in New Hanover County, North Carolina, and is adjacent to Whiskey Creek. Historically, the agencies considered the north and south tracts one single and complete project and issued a Department of the Army (DOO) Nationwide Permit 39 (see Attachment 3) and corresponding NC Division of Water Quality (now Water Resources) Water Quality General Certification (GC) #3402 (see Attachment 4). The authorized work consisted of impacting 0.35 acre of wetlands (0.24 acre north tract + 0.11 acre south tract) and 72 linear feet of stream impact (south tract). The impacts were necessary to facilitate the installation of infrastructure. Mitigation to offset those impacts consisted of: (1) Payment to the NCEEP for 72 linear feet of warm water stream restoration credit (2) creation of wetlands and (3) preservation of wetlands. Construction on the north tract took place in 2008 and the NCEEP stream restoration credit was secured (see Attachment 5), but the creation and preservation of wetlands did not take place. This rendered the project in non - compliance of the NWP and GC. In order to resolve the non - compliance, the USACE required the Permittee (TSV Developers, Inc. and Navaho Investments, LLC) to make payment to the NCEEP, at a 3:1 mitigation to impact ratio, for riparian wetland restoration credit. This ratio was intended to fulfill the creation and preservation components of the previously issued permit. This was fulfilled in January of 2009 (see Attachment 6). Once the non- compliance had been resolved, the Permittee applied for and secured a CAMA Major Permit for the anticipated wetland impacts, as well as the construction of a community observation deck, to take place on the south tract, also known as The. Creek at Willowick - (see Attachment 7). As part of that -pcmnt, the. USAF d the Applicant to make payment to the NCEEP for 0.22 acre of riparzan:VV�tland restoration credl%, a t "e .•. ,..�: remaining wetlands. Payment was made to the NCEEP, as required (see Attachment 8), but the wland preservation never took place. The following is a list of the permits that have been issued for this project: • USACE Action ID #: 200600561 (Notification of Jurisdictional Determination) • AID #: SAW - 2006 -40949 -065 (Nationwide Permit 39) issued 19 January 2007, expired 18 March 2008 (impacts associated with the development of The Creek at Willowick did not occur during this time period.) S 4 . } o5 -io&o, Pre- (_onstruction Notification Project Narrative [2121 Sr—Gi 401 Water Quality Certification #3402: 20061522 (issued 29 November 2006) • 401 Water Quality Certification #3402: 20061522x2 (issued 16 May 2008) • Stormwater Permit #: SW8 060748 — issued 28 November 2006 • Sedimentation & Erosion Control Permit #: 83 -06 — issued 27 June 2007 • DOT Driveway Encroachment Permit — issued 12 September 2008 • CAMA Major Permit #: 73 -09 — issued 29 June 2009 Currently, all of the work associated with the north tract has been completed, and all of the proposed wetland impacts authorized under the CAMA Major Permit 73 -09, for the south tract, have taken place. The community observation deck has not yet been constructed. Just recently the south tract was conveyed to the Applicant (see Attachment 9). During the construction of the roadways, within the south tract, it was determined that a conveyance swale is not able to drain properly. In order to correct the problem, the drainage swale needs to be extended out approximately 50 feet into the wetland. This will provide the fall necessary to allow the water to drain. The proposed drainage swale would require 750 square feet (0.02 acre) of permanent wetland impact and 1,175 square feet (0.03 acre) of temporary wetland impact (see Attachment 10). The permanent impact would result from the incidental fallback from excavating the swale. The temporary impact would result from removing vegetation from each side of the drainage feature for a construction buffer. It is not anticipated that land disturbance (disturbance of the root mat) will take place within the temporary impact area, and the area will be allowed to re- vegetate naturally, after work has been completed. Should land disturbance take place, the area will be returned to its original grade and contour first. Cumulatively, wetland impacts on the north and south tracts will total 0.37 acre (0.24 acre north tract + 0.13 acre south tract). Taking into consideration that the previous Permiee made payment to the NCEEP for 0.94 acre of riparian wetland restoration credit (a 2.7 to 1 mitigation to impact ratio), the Applicant is not proposing mitigation with this request. The Applicant and SEGi feel the mitigation supplied to date is sufficient to offset the cumulative impacts associated with the project. With that being said, the Applicant is requesting that the preservation be removed from the compensatory mitigation requirements. As required, the Two Hundred and Forty Dollar ($240.00) filing fee has been attached as Attachment 11 and sent to the Division of Water Resource 401 & Buffer Permitting Unit, along with 4 copies of the application. In conclusion, it is of SEGi's opinion that the proposed impact is the least environmentally damaging practicable alternative.
