Per our conversation yesterday, our client has chosen not to upgrade the existing crossing at the Kinston Davis Farm,
therefore the existing impacts to the stream and Neuse River Riparian Buffer are considered "Exempt" activities, and no
written authorization will be required from the Division of Water Resources. This Office requests that you submit a
written request to withdraw your Pre - Construction Notification application to our DWR Central Office.
