Skvarla, III Governor Secretary September 30, 2014 Pam & Richard Naugle 109 Oaklake Court Fuquay - Varina, NC 27526 Subject: Surface Water Determination Letter NBRRO# 14 -341 Wake County Mr. and Mrs. Naugle, On September 15, 2014 DWR staff conducted a site visit to 109 Oaklake Court, Fuquay- Varina. This site visit was for the purposes of assessing the property of 109 Oaklake Court, Fuquay -Varian for streams, buffers, and to answer questions Mrs. Naugle had regarding the adjacent property (200 Dickens Road), and the applicability of the Neuse River Riparian Buffer Rules. DWR did not identify any intermittent or perennial streams on 109 Oaklake Court; however, there is a pond and stream feature depicted on Wake County Soil Survey and USGS Maps at 200 Dickens Road, Fuquay - Varina. These features were not evaluated due to their being located on the adjacent homeowners' private property. Per the Neuse River Riparian Buffer Rules, these features have been located on the Soil Survey of Wake County, North Carolina or the most recent copy of the USGS Topographic map at a 1:24,000 scale and are therefore considered subject to the Neuse River Riparian Buffer Rules until/unless a requested site visit by DWR determines there feature are not subject to the Neuse River Riparian Buffer Rules. The Neuse River Basin is subject to the riparian (streamside) buffer rules covered under North Carolina Title 15A NCAC 02B .0233. The purpose of these rules is to protect and preserve riparian buffers in the Neuse River Basin that help protect surface water by removing nutrients from overland flow. The North Carolina buffer rules apply to areas immediately adjacent to surface waters which includes intermittent streams, perennial streams, lakes, ponds, and estuaries. The protected riparian buffer has two zones: Zone 1 is measured from the stream bank landward for 30 feet. Zone 2 is measured an additional 20 feet landward from the outer edge of zone 1. Both Zone 1 and Zone 2 consist of a stable vegetated area that is undisturbed except for activities and uses provided for in item (6) of 15A NCAC 2B .0233 (4). Jva�tl�ll!! Landowners or affected parties that dispute a determination made by the DWR or Delegated Local Authority may request a determination by the Director. An appeal request must be made within sixty (60) days of date of this letter or from the date the affected party (including downstream and /or adjacent owners) is notified of this letter. A request for a determination by the Director shall be referred to the Director in writing c/o Karen Higgins, DWR WeBSCaPe Unit, 1650 Mail Service Center, Raleigh, NC 27699. This determination is final and binding unless, as detailed above, you ask for a hearing or appeal within sixty (60) days. The owner /future owners should notify the Division of Water Resources (including any other Local, State, and Federal Agencies) of this decision concerning any future correspondences regarding the subject property (stated above). This project may require a Section 404/401 Permit for the proposed activity.
