I have reviewed the courtesy copy of the PCN application for the subject project received by the Division on September
4, 2014. Because the proposed impacts from the road crossing (the only impact proposed for the project) do not exceed
0.10 ac of wetlands or 150 linear feet of stream, and it is exempt from the Tar-Pamlico Buffer Rule, written approval of
GC #3890 is not required. Please note that the project must comply with all of the conditions listed in the general
certification, which is attached for reference.

Hi Jennifer
I submitted a NWP 18 application to the USACE a couple of weeks ago for the Van Slyke Solar Center in Wilson County a
couple of weeks ago and copied you on it. Based on my understanding of DWR regulations (GC 3890), no written
authorization from DWR is needed for this project because wetland impacts are less than 0.1 acre and stream impacts are
less than 150 LF. Additionally, because the stream crossing is associated with a road and the road width is 40 LF, the
buffer impact is exempt. If you agree with my interpretation, would you be able to write a letter stating that no written
authorization from your office is needed? Our client would like to have something to put in his file.
