PROJECT DESCRIPTION The project site is located at Lot 8B, SE 67th Street, adjacent to the Atlantic Ocean, within the Town of Oak Island, in Brunswick County To find the project site, travel south on US Highway 17 to NC Highway 133 South Travel approximately 22 ;miles south on NC -133 to Dosher Cutoff SE/ NC- 133 Turn onto Dosher Cutoff and then turn right at Southport- Supply Rd SE/NC-133 Travel approximately 0 8 mile}and turn left onto NC -133 Travel on NC -133 to Oak Island and turn right on East Oak Island Drive Travel approximately 13 miles to SE 67th Street- Make a left on 67th Street and the property will be located near the end of the street on the left The property consists of a single lot with a total area of approximately 20,828 square feet The property is within Phase 2 of the Turtle Creek .Subdivision It was formerly part of a larger tract that was subdivided' into two parcels by Mr Blankenship in December 2013 The site is predominately occupied by a freshwater pond and jurisdictional §404 wetlands The pond is connected to adjacent wetlands by a box culvert located roughly in the center of the pond Wetland vegetation consists primarily of Cattails (Typha spp ), Bulrush (Scirpus spp ), and Common Reed (Phragmites austrdlis), amongst other wetland species While remnant coastal wetland species are present, they are not tidally influenced According to the applicant, the highground portion of the property,, located along the street side of the lot to the west, has a current elevation of approximately 5 5 feet above mean sea level The frontal dune is located oceanward of the, southern property line The longterm erosion rate,for this portion of Oak'Island is 2 feet per year The 100 -year storm recession line for this area is 300 feet, creating a total Ocean Erodible AEC of 420 feet While the parcel lies partially within the Ocean Erodible Area of Environmental Concern (AEC), the•project area falls outside the limits of this AEC However, the work would �be located entirely within the High Hazard Flood AEC as indicated by zones V1 -30 on the Flood Insurance Rate,Maps of the Federal Insurance Administration Setbacks in this portion of Oak Island are measured from a,static or fixed vegetation line, unless the actual first line of stable, natural vegetation is more restrictive This static vegetation line represents the first line of stable, natural vegetation that existed prior the large -scale spoil deposition project The vegetation line was surveyed bythe North Carolina Geodetic Survey Unit in February and March of 2002 With a 2 feet per year erosion rate, structures with a total floor area less than 5,000 square feet must be set back a distance of 60 feet landward, from the static line The 60 foot setback is located approximately 260 °feet oceanward of the southern property line The actual first line of stable, natural vegetation is located oceanward of the surveyed static vegetation line There are no man-made structures currently on the property other than municipal sewer hook -up The waters of the Atlantic Ocean in the vicinity of the;project area are classified SB by the North Carolina Division of Water Quality The area is not designated as a Primary Nursery area by the North Carolina Division of Marine Fisheries Scott Blankenship Page Three PROPOSED PROJECT: The applicant is proposing to constructa single - family residence with associated wetland fill A "bulkhead"/retaining wall would be constructed around the perimeter of the home site to retain the fill material around the'house and parking area The applicant is also proposing a 2' construction buffer around the °proposed retaining walls to account for temporary impacts due to construction According to the narrative, once construction of the retaining wall is completed, the buffer area will be returned to its natural grade and allowed to re- vegetate naturally The total floor area of the house would be 3;200 squareTfeet 10. The property is approximately 0 48 acres (20,828 SF) Site Information <and history: As mentioned„ this lot is part of Turtle Creek Subdivision Phase II Previous owners, of the parcel (Wiles, Judy and David) applied `for a CAMA Mayor Permit in 2003. As part of that process, the USACE issued a jurisdictional determination (JD), under USACE AID# 200201007 and a NWP 18, under USACE AID# 200400049, which authorized the fill of `0 03 acre of wetlands and 0 04 acre of waters of'the United States (see Attachment 2) It appears, from a review of the NCDENR file, that the DWR had requested additional information regarding the proposed fill of wetlands This request was,never answered and'the proj,ect was put on hold, and subsequently withdrawn Due to the time that has elapsed since the original permit was submitted, the Applicant had SEC-ii re- delineate the wetlands and determine the limits of surface waters, within the parcel Mr Ronnie Smith, USACE CAMA Field Officer, verified the wetland line, as well as-the normal water line, on 6 March 2014. The Rapanos forms have been included with the correspondence, in order to complete that process (see Attachment 3) This site is located within the VE flood zone, but is not located on a waterbody that has a coastal shoreline area of environmental concern associated with it The parcel was covered under NC State Stormwater Pernut SW8 920714 Under that permit, Lot 8 was allotted 5,000 square feet of built upon area However, since that permit was issued„ the Applicant purchased °the property and subdivided it into two, Lots 8A and 8B (see Attachment 4) As required, the Applicant recorded the declaration of restrictive covenants, at the Brunswick County Register of Deeds Office, allocating a built upon area of 2,800 square feet and 2,200 square feet respectively. A 2' temporary construction buffer, which consists of approximately 380 square feet (0 008 acre), has been incorporated into the plan, to ensure that unauthorized impacts to wetlands, do not take place The proposed location of the structure is such that it-is in keeping with the local setbacks.
