At this time, project construction is scheduled to start in September of 2014. The project will require over 21,700 PV modules, as depicted on the attached site plan. These modules will be installed on racking equipment mounted on steel piles driven into the ground. After clearing and grading the site, the steel piles will be installed. Approximately 33 of the pilings will be installed within a ditch classified by the USACE as an RPW. Based on previous communication with the USACE, it is our understanding that the installation of pilings within an RPW is not a regulated activity. After the pilings are in place, the racking equipment will be mounted on them approximately 4 feet above ground (see attached figure). For the pilings in the RPWs, the racking equipment will be installed 4 feet above the top of bank elevation. Pilings will be spaced between 16 feet and 20 feet from each other. The PV modules will then be mounted in rows on the racking equipment. A proposed access road will cross the RPW at an existing culvert and no impacts will be needed. Basis For Determination The site exhibits features with Ordinary High Water and wetland criteria as defined in the 1987 wetland delineation manual and applicable Regional Supplements The waters on site include an Unnamed Tributary (UT) to Dunn Swamp a Relatively Permanent Water (RPW) which flows via several other L�Ts to Dunn Swamp (all RPWs), and Porter Swamp (RPW) to the Lumber River, a Traditionally Navigable Water and adjacent wetlands. This determination is based on a site visit by David F Bailev of the U.S. Armv Corps of Engineers on 6/27/2013. D. Remarks The wetlands and other Waters of the US on the property were flagged by Land Management Group, inc., with changes made in the field by David F Bailey (USAGE) and are approximated on the attached figure entitled "Figure 7: Aerial Photograph w/Preliminary Unland/Wetland Sketch Overlav ". Note that this document and our determination of iurisdiction within the cultivated farm field area, is pursuant to a change in use in the protect area Via letter dated 8/12/2013 as well as the "Memorandum of Option Agreement for Solar Energy Site Lease" dated 5/24/2013 and recorded with the Columbus Countv Register of Deeds in Book RB 106.0, Page 163 -167 HelioSaze LLC (applicant) and Estaleen T Gore (owner) have indicated their intention to change the use of the subiect proiect area from an agricultural field to a non - agricultural use (i.e. installing solar electric generating eauioment on the site). E. Attention USDA Program Participants This del ineation/determination has been conducted to identify the limits of Corps' Clean Water Act jurisdiction for the particular site identified in this request. The delineation/determination may not be valid for the wetland conservation provisions of the Food Security Act of 1985. If you or your tenant are USDA Program participants, or anticipate participation in USDA programs, you should request a certified wetland determination from the local office of the Natural Resources Conservation Service, prior to starting work.
