CONDITIONS OF APPROVAL
1. ALL DECORATIVE TRAFFIC RELATED SIGNAGE SHALL BE MAINTAINED SOLELY BY THE
DEVELOPER OR THE HOMEOWNER'S ASSOCIATION.
2. NO MORE THAN 30 BUILDING PERMITS WILL BE ISSUED WITHIN THE SUBDIVISION UNTIL THE
REQUIRED SECONDARY ACCESS IS CONSTRUCTED, IN ACCORDANCE WITH THE
REQUIREMENTS OF THE NC FIRE CODE.
3. ALL ROADWAY AND TRAFFIC IMPROVEMENTS REQUIRED BY THE TOWN AND/OR NCDOT
SHALL BE CONSTRUCTED OR FINANCIALLY GUARANTEED PRIOR TO THE PLATTING OF THE
PHASE OF THE DEVELOPMENT THAT WILL TRIGGER THEIR NECESSITY. IF NO PHASE IS
SPECIFIED, THE IMPROVEMENTS SHALL BE REQUIRED IMMEDIATELY OR AS SPECIFICALLY
REQUIRED BY NCDOT.
4. THE NEW TRAFFIC SIGNAL REQUIRED AT THE INTERSECTIONS OF COVERED BRIDGE ROAD
AND N. O'NEIL STREET SHALL BE INSTALLED PRIOR TO THE COMPLETION OF THE
SUBDIVISION, OR WITHIN A TIMEFRAME REQUIRED BY NCDOT.
5. THE TRAFFIC SIGNAL REQUIRED AT THE INTERSECTION OF SHOTWELL ROAD AND COVERED
BRIDGE ROAD SHALL BE INSTALLED PRIOR TO THE COMPLETION OF THE SUBDIVISION, OR
WITHIN A TIMEFRAME REQUIRED BY NCDOT.
6. FEE -IN -LIEU SHALL BE PAID FOR HALF OF THE PROPOSED STREAM CROSSING OF STREET
"D" TO THE EAST AT PLAT RECORDATION FOR PHASE.
7. IF ANOTHER DEVELOPMENT CONTRIBUTES TRAFFIC TO ANY REQUIRED SIGNAL
MODIFICATIONS, THE WILL CONTRIBUTE TO THE COST OF THE IMPROVEMENTS BASED ON
THEIR IMPACT AT THE INTERSECTION AT THE TOWN'S DISCRETION OF DETERMINING SUCH
IMPACT.
8. ALL REQUIRED LANDSCAPE BUFFERS OR PLANTINGS SHALL BE INSTALLED OR BONDED
PRIOR TO THE PLATTING OF THE PHASE IN WHICH THEY OCCUR.
9. MULTI -USE TRAILS SHALL BE CONSTRUCTED OR BONDED PRIOR TO THE PLATTING OF THE
PHASE IN WHICH THEY OCCUR.
10. ALL PHASES OF THE DEVELOPMENT SHALL CONSIST OF COMPLETE STREET SECTIONS; NO
MID -BLOCK PHASING SHALL BE PERMITTED.
11. THE AMENITY CENTER SHALL BE SUBMITTED AS A SEPARATE MINOR SITE PLAN
APPLICATION TO BE REVIEWED AND APPROVED BY THE TOWN OF CLAYTON TECHNICAL
REVIEW COMMITTEE AND PLANNING DEPARTMENT.
12. FEE -IN -LIEU SHALL BE PAID FOR THE REMAINDER OF ROAD "C" THAT DOES NOT CONNECT
WEST TO THE ADJACENT PROPERTY, TO ENSURE THAT THIS CONNECTION IS FUNDED FOR
FUTURE DEVELOPMENT.
13. THE FINAL PLAT AND SUBSEQUENT DEVELOPMENT OF THE SITE SHALL BE CONSISTENT
WITH THE SPECIFICATIONS OF THE APPROVED PRELIMINARY SUBDIVISION PLAN AND
ASSOCIATED SPECIAL USE PERMIT. MODIFICATIONS SHALL REQUIRE ADDITIONAL
APPROVALS PURSUANT TO SECTION 155.706 AND 155.711 OF THE UNIFIED DEVELOPMENT
CODE.
GENERAL NOTES:
1. FIELD TOPOGRAPHIC SURVEY PREFORMED BY TRUE LINE SURVEYING, P.C. DATED MAY 25, 2005.
2. THE CONTRACTOR SHALL CONTACT NC ONE CALL CENTER PRIOR TO ANY DIGGING.
3. ALL PUBIC WATER IMPROVEMENTS SHALL CONFORM TO ALL TOWN OF CLAYTON PUBLIC UTILITIES
DEPT. AND NCDEQ PWS STANDARDS AND SPECIFICATION. ALL SANITARY SEWER IMPROVEMENTS
SHALL CONFORM TO ALL TOWN OF CLAYTON PUBLIC UTILITIES DEPT. AND NCDEQ DWQ STANDARDS
AND SPECIFICATION.
4. THE CONTRACTOR SHALL CHECK PLANS AND FIELD CONDITIONS FOR CONFLICTS AND
DISCREPANCIES PRIOR TO CONSTRUCTION. THE CONTRACTOR SHALL NOTIFY THE ENGINEER OF
ANY CONFLICT BEFORE PERFORMING WORK IN THE AFFECTED AREA.
5. THE CONTRACTOR IS RESPONSIBLE FOR REPAIRING ANY DAMAGE TO EXISTING FACILTIES, ABOVE
AND BELOW GROUND THAT MAY OCCUR AS A RESULT OF THE WORK PERFORMED BY THE
CONTRACTOR.
6. IT SHALL BE THE SOLE RESPONSIBILITY OF THE CONTRACTOR TO COMPLY WITH AND ENFORCE ALL
APPLICABLE SAFETY REGULATIONS.
7. THE CONTRACTOR SHALL BE RESPONSIBLE FOR PROTECTING EXCAVATION AGAINST COLLAPSE AND
SHALL PROVIDE BRACING,SHEETING, OR SHORING AS NECESSARY. TRENCHES SHALL BE KEPT DRY
WHILE PIPES ARE BEING PLACED, DEWATERING SHALL BE USED AS REQUIRED, AND PERMITTED
THROUGH LOCAL GOVERNMENT AGENCIES AND WATER MANAGEMENT DISTRICT PER CURRENT
REGULATIONS AT THE SOLE COST OF THE CONTRACTOR.
8. WORK BEING PERFORMED UNDER THIS CONTRACT SHALL INTERFACE SMOOTHLY WITH OTHER
WORK BEING PERFORMED IN THE AREA BY OTHER CONTRACTORS AND UTILITY COMPANIES. IT WILL
BE NECESSARY FOR THE CONTRACTOR TO COORDINATE AND SCHEDULE HIS ACTIVITIES, WHERE
NECESSARY, WITH OTHER CONTRACTORS AND UTILITY COMPANIES.
