Is that a previous name for Tarin Woods? Is your project on the map in the attachment (it is hard to tell....)? Or, are you saying that this is an example of a call the Division made in 2007 for another project? A lot has changed since 2007. The 2008 rule caused a lot of confusion about SA with its "no discharge" clause. The Director has since determined that if any part of a project is inside the half -mile line then the whole project is subject. (But, if the Division had told you previously that you were not subject to SA for this project, then I am certainly not going to go back on that now.) Also, did you get clarification on the stream/no stream issue? It sounded like they were not going to call it a stream. I really don't mean to be difficult about this one. It just has lots of coordination between agencies, and that complicates things. It is my understanding that there is some concern on the ditch/waters of the US/stream determination on the feature which runs through both Tarin I & II. I've attached the JD from 2007 that clarifies the "stream", "Waters of the US" and "ditch" calls within Tarin I. Additionally, I've included the Tarin 1404 and 401 permit that denotes the permitted stream and open water (ditch) crossings. Based on the "Waters of the US" determination and consequent "open water (ditch)" permit received on Tarin I (downstream portion of the feature) Tarin II (upstream portion of the feature) received the same determination and was permitted similarly. Please let me know if you have any additional questions or require additional information. VAN DER VAART Secretary TRACY DAVIS Director The Wilmington Regional Office received and accepted a State Stormwater Management Permit Application for Tarin Woods II on March 8, 2016. A preliminary in-depth review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: 1. Stream: The water feature running through the property appears to be a stream. Please see the enclosed documentation for the site immediately south of this project. I have discussed this with 00 L,191t. Chad Coburn with NC401, and he will do a site visit in the near future to determine where the stream origin point(s) are. a. Please make the necessary adjustments. c. Design: i. Unnamed Tributaries, [per 15A NCAC 02B .0301(i)(1)]: Any stream which is not named in the schedule of stream classifications carries the same classification as that assigned to the stream segment to which it is tributary unless it meets one of the exceptions such as a freshwater tributary. Please note that per 15A NCAC 02B .0202(35), freshwater is defined as waters that, under natural conditions, would have a chlorine ion content of 500mg/l or less. ii. The area where this portion of the development will occur has been observed by the ACOE and no wetlands are present within the project area. The owner of the property is Hoosier Daddy LLC.. For the initial phase of the Tarin Woods II development access to the site will be from Tarin Road which connects directly to Lt. Congleton Road. The project is not located within % mile of SA waters. Stormwater from the site drains through a tributary to Everett Creek SA;HQW located in the Cape Fear River Basin (Index # CPF 18-87-29). The project will be high density and will be treated with a high density BMP. The proposed site will utilize a wet basin designed for 90% TSS removal. Roads within the development are designed to be super elevated and directed into flumes allowing water to filter through a grass channel before entering the wet basin. Since the project is located within New Hanover County the site will also need to meet the 2,10 and 25 year pretpost requirement. Proposed impervious for the site is 53%. Water for the site will be public and provided by the CFPUA. Sewer will be private and owned and maintained by the HOA. PROJECT BMP: storm water pond. This letter, with attachments, is the report of our testing. Field Testing On August 5, 2015, ECS conducted an exploration of the subsurface soil and groundwater conditions at thirteen requested locations shown on the attached Test Location Plan (Figure 1). ECS met onsite with Mr. James Yopp with Hoosier Daddy, LLC to locate the boring locations. The purpose of this exploration was to obtain subsurface information of the in -place soils for the stormwater BMP areas. ECS explored the subsurface soil and groundwater conditions by advancing one hand auger boring into the existing ground surface at the requested boring locations. ECS visually classified the subsurface soils and obtained representative samples of each soil type encountered. ECS also recorded the SHWT elevation observed at the time of the hand auger borings. The attached Infiltration Testing Form provides a summary of the subsurface conditions encountered at the hand auger boring locations. The SHWT elevation was estimated at the boring locations below the existing grade elevation. A summary of the findings are as follows: B-1 0 inches B-2 18 inches B-3 60 inches B-4 6 inches B-5 8 inches B-6 12 inches B-7 8 inches B-8 60 inches B-9 42 inches B-10 90 inches B-11 30 inches B-12 80 inches B-13 100 inches 6714 Netherlands Drive, Wilmington, NC 28406 • T: 910-686-9114 • F: 910-686-9666 - www.ecslimited.com ECS Carolinas, LLP - ECS Florida, LLC • ECS Midwest, LLC • ECS Mid -Atlantic, LLC • ECS Southeast, LLC • ECS Texas, LLP Report of SHWT Estimation and Infiltration Testing Heglar Tract Wilmington, New Hanover County, North Carolina ECS Project No. 22.23105 August 13, 2015 ECS has conducted seven infiltration tests utilizing a compact constant head permeameter near the hand auger borings (B-2, B-3, B-8, B-9, B-10, 8-12, and B-13) in order to estimate the infiltration rate for the subsurface soils. Infiltration tests are typically conducted at two feet above the SHWT or in the most restrictive soil horizon. Test locations B-2, B-3, B-8, and B-9 were requested to be tested below the restrictive horizon encountered in case the restrictive soils are allowed to be removed in the BMP footprint. Tests in clayey conditions are conducted and calculated up to 30 minute intervals. If an exact hydraulic conductivity is necessary for these locations, then ECS recommends collecting samples by advancing Shelby tubes and performing laboratory permeability testing. Closure ECS's analysis of the site has been based on our understanding of the site, the project information provided to us, and the data obtained during our exploration. If the project information provided to us is changed, please contact us so that our recommendations can be reviewed and appropriate revisions provided, if necessary. The discovery of any site or subsurface conditions during construction which deviate from the data outlined in this exploration should be reported to us for our review, analysis and revision of our recommendations, if necessary. The assessment of site environmental conditions for the presence of pollutants in the soil and groundwater of the site is beyond the scope of this geotechnical exploration. 2 Report of SHWT Estimation and Infiltration Testing Heglar Tract Wilmington, New Hanover County, North Carolina ECS Project No. 22.23105 August 13, 2015 ECS appreciates the opportunity to provide our services to you on this project.
