Thank you Mr. Yopp. I've attached a copy of the July 16, 2013 permit for your convenience. Unfortunately, the recorded
document you provided is missing almost all of the required statements regarding stormwater management- at least, I
was not able to find them. If they are located in the document somewhere, please provide the Article and Section
numbers. Please refer to Section 11.15 of the nermit for a list of all the statements that need to be recorded.
In addition, Article IX Section 4 of the recorded document incorrectly limits the built -upon area to 4,350 sf. The July 16,
2013 permit, allows less BUA per lot and a varied BUA per lot depending on the lot number. Please refer to the end of
Section 1.6 of the attached permit for the chart showing the permitted maximum BUA per lot limits.
There appear to be 2 different processes described in the recorded document you provided, to amend the
covenants. Article X Section 3 requires that in the first 20-year period, not less than 90% of the lot owners must sign an
instrument. After the first 20 years, not less than 75% of the lot owners must sign an instrument. However, Article X
Section 10 states that the covenants may be amended at any time by an instrument in writing, signed by two-thirds
(2/3rds) of the then lot owners. I understand about the first 20 years, but I am confused about which process is the
correct one after the first 20 year period is over — Section 3 or Section 10?
For purpose of compliance with the stormwater permit, any proposal to change the BUA limits of any lot that has
already been conveyed must be signed by that lot owner. If the BUA limit will be decreasing, and there is an existing
home already on the lot, then the existing BUA on the lot must be documented to verify that it will meet the decreased
BUA limit.
As to the transfer of the permit, please be reminded that E 85 Transport, LLC, must submit the appropriate version of a
signed Name/Ownership Change Form before the permit for Tarin Woods can be transferred to the Assoication. The
built -upon area issue described above must be resolved and the project must be inspected and determined to be in
compliance before the Division can approve a request to transfer the permit.

I do have an authorization letter for Hoosier Daddy, LLC. See attached. This is not an extension of Tarin Woods. It is a
new subdivision Just called Tarin Woods II. We are in the process of transferring the storm water ownership to the POA
and I have a meeting with the POA board tonight to explain all requirements and documents, then receive signatures.
We should be submitting to the state soon for their final review. Attached is a copy of the recorded covenants for Tarin
Woods. They were provided to Sam Burgess prior to the recording of phase 1.

This proposed project is a high density subdivision, disturbing >1 acre, not located within the City limits, with wet ponds
to treat runoff. The owner of the project is required to obtain a state stormwater management permit from DEMLR. The
challenge will bet collect that runoff from the backs of the lots and direct it to one of the B�JIP's for treatment.
This project abuts the previously permitted Tarin Woods under SW8 061005. That project was certified on September
30, 2015, however a copy of the recorded deed restrictions has not been provided. A copy of the recorded deed
restrictions for the currently permitted Tarin Woods must be submitted before additional development of the next
phase can be approved.
It may also be time to consider transferring the SW8 061005 permit to the Association if it has met the requirements
under SL 2011-256. The Tarin Woods Property Owners Association, Inc. was formed in July 2013.
The permittee for Tarin Woods is Jack J. Carlisle, E 85 Transport, LLC. Mr. Carlisle is also a member/manager of Hoosier
Daddy, LLC. The County's performance residential application has been signed by James L. Yopp, III, as representing
Hoosier Daddy, LLC. However, the last annual report filed in February 2015 with the NC Secretary of State, does not
name Mr. Yopp in any capacity associated with Hoosier Daddy, LLC. The only managers on file for Hoosier Daddy, LLC
are Ms. Lisa Carlisle Beaman and Mr. Jack J. Carlisle. The State would not be able to accept the signature of Mr. Yopp on
the stormwater application unless a signed letter of authorization was provided by either Ms. Beaman or Mr. Carlisle in
their capacity as managers of the LLC, authorizing Mr. Yopp to sign the stormwater application documents on behalf of
the LLC.
