Hi Alicia,
Our paper files are considered public record and would include things like the application documents, approved site
plans, and other supporting documentation. If you need further information, we can either arrange a time to make the
file available for review here in the office or can arrange to have the file scanned at your expense. The copier/scanner
available during the in house file review is not large enough to handle the plan sheets however you may take pictures. If
you choose to have the file scanned by the third party scanner, the cost to scan depends on how big the file is ($35/inch
of file thickness) and would include the file in its entirety.

We do have the current O&M agreement on file here for this project. For the renewal application, when it notes the
O&M agreement, it is asking if you would like a copy for your records.
When the permit is transferred, the new permit holders will need to sign a new O&M agreement as well. Those forms
can be found on our website: Stormwater Design Manual I NC DEQ.

When I was checking the plan sheets we have on file, both the property with the pond and the adjacent property were
included impervious area that is part of the drainage area for this permit. I have attached the site plans to this email.
Both properties do need to be permitted. If the two companies do not want to be co-permittees (meaning they both
hold the same permit), they can inquire to get what we call an "offsite" permit but that requires a process that would
need to be discussed with one of our engineers as it would require a modification to the previous approved plans.

If you would like to get two permits, meaning SW8 950213 would be held by one entity and the other (land owner
adjacent to the pond) would like to get an "offsite" permit, please contact Kellie Norris ([e-mail]) to
discuss what would need to happen to obtain an offsite. If both permittees would like to become co-permittees, then
they both would need to sign the transfer application to transfer SW8 950213.

We just received approval to cut the check for the first and second renewal amount along with a third renewal amount

As promised, attached is a picture of the plan sheets we have on file here in our office as well as the legal name change
documentation from the NC Secretary of State business registration, its most recent annual filing of 2022, and the
matching property for this permit from the New Hanover County GIS. webpage. Per 15 NCAC 02H. 1045 only the current
permit holder can renew the stormwater permit. When checking these locations, it has also come to my attention that
the properties have been sold. After this permit is renewed, it will need to be transferred to the new property owners. I
will send another letter to the two current property owners so we can officially transfer this permit through our office.

to Jam of Wilmington, LLC and expired on March 26, 2007. Per 15A NCAC 211.1003 (h) (the stormwater rules),
applications for permit renewals shall be submitted 180 days prior to the expiration of a permit and must be
accompanied by a processing fee, which is currently set at $505.00. The renewal timeframe is currently set at 8
years. Since this permit expired on March 26, 2007, two renewals are needed to return this permit to an active
status as demonstrated below:
First renewal: March 26, 2007 + 8 years = March 26, 2015
Second renewal: March 26, 2015 + 8 years = March 26, 2023
Please complete and submit a renewal application with two (2) processing fees of $505.00 for a total of $1,010.00
prior to August 6, 2022. The renewal application can be found at the following website under the Applications
Forms section: https://deci.nc.aov;about/divisions/enerav-mineral-land-resources/enerev-mineral-land-
rules/stormwateLproMmZpost-construction. Please note that if they have not already been submitted to the
Division, the permit renewal request must be accompanied by the required Designer's Certification and the
recorded documents (if applicable).
Please be advised that you are required to comply with the terms, conditions and limitations of the Stormwater
Management Permit under Title 15A North Carolina Administrative Code 2H .1003 and North Carolina General
Statute 143-214.7 until you submit the required Permit Transfer Application Form to the Division and receive
approval from the Division to transfer the permit. This includes providing the necessary operation and
maintenance of the permitted stormwater system. The Permit Transfer Application Form is available on our

The operation of the stormwater treatment system without a valid and active permit, and/or failure to provide the
Designer's Certification and/or failure to operate and maintain the stormwater treatment system, are violations of

Dear Mr. McNeil:
Effective August 1, 2013 the .State Stormwater program has been transferred from the Division of Water Quality
(DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous references to DWQ will
remain in older stormwater permits issued prior to August 1, 2013 until they are modified, transferred, or
renewed. Please note that this letter references DEMLR as the Division responsible for issuance of the permit.
