As discussed with Sue Homewood on August 29, 2022, there are several items that will require additional time to analyze. These are noted in the responses below and will be provided by September 30, 2022. Each individual comment received is in italics below, along with corresponding response. 1. If the USAGE requests a response to any comments received as a result of the Public Notice, please provide the Division with a copy of your response to the USAGE. We will provide the Division comment responses that are submitted to the USACE. Note that this will include the Division's comments to the USACE, which will be addressed by 9/30/22. 2. Please provide an analysis of potential secondary and cumulative impacts as a result of this development pursuant to the Division's Cumulative Impact Policy. Please see the attached analysis and associated figure. It is our professional opinion, based on the Division's Cumulative Impact Policy, that this project is not likely to contribute to secondary and cumulative impacts in the project vicinity. 3. In order to ensure that the project is appropriately authorized, the Division requires documentation that the USAGE has verified that wetland 23 is Isolated. Understood. As noted in the application, we are not proposing this area as isolated due to schedule constraints, but will confirm with the USACE if an Approved JD is achievable in the permitting period. We will confirm this by 9/30/22. 4. While the Division recognizes that impacts to wetland 24 were inadvertent, as clearly stated in the application, significant design effort was made to avoid this feature in previous submittal. Pursuant to 15A NCAC 02H.01305(b) "In assessing whether the proposed activity will comply with water quality standards, the Division shall evaluate if Mr. Paul Wojoski September 9, 2022 the proposed activity: (1) has avoided and minimized impacts to surface waters and wetlands... ". Please provide further evidence that the current proposal meets this criteria when prior design indicates this area could be avoided. Page 2 of 4 We appreciate the acknowledgement that the impact was inadvertent and understand additional justification is required. It should be noted that the avoidance of this wetland in the prior Nationwide Permit submittal was done using preliminary design, and impacting this wetland feature would have prevented the use of a Nationwide Permit for the prior phase. The design has been advanced and while the retaining walls are not completely impractical to build, they would result in redirecting approximately 94% of the existing surface water drainage away from this wetland feature. After considering the Division's concern for drainage of stream and wetland features (Item 10), it is likely that a loss of wetland function could result at this location. Also, as the design has advanced, retaining walls surrounding wetland 24 will average 15' in height from the original wetland elevation. Given that there will be both some shading effect from the walls, and a significant reduction in hydrology at this wetland, the construction of the walls (with an associated cost of approximately $270,000) would still likely result in a loss of wetland function regardless of the prior disturbance. With this evaluation, it is our request to permit the wetland impact as proposed in the application. 5. Please provide a stream restoration detail and wetland restoration details for all proposed temporary impact areas. Details on temporary impacts have been added to the attached Impact Map set. Sewer crossing temporary impact area details will be provided after coordinating with the local utility authorities on their requirements. This information will be provided by 9/30/22. Note that areas denoted as temporary wetland impact adjacent to riprap inlet/outlet construction areas do not have a detail. These areas are denoted as temporary impact for access only and the contractor will be required to use matts to prevent permanent disturbance to those areas. Upon completion of the work, the areas will be inspected, and if any compression of soils has occurred discing and reseeding with a natural wetland seed mix will be performed. This information will be added to construction drawings as the final plans for each phase are developed. 6. In order for the Division to adequately evaluate potential impacts to stream and wetland functions, please provide detailed plans and profiles for all proposed culverts. These details should include temporary dewatering details and riprap apron design details, proposed culvert slopes, culvert burial (if appropriate) and stream width and culvert diameters. The requested information has been added to each culvert location in the attached Impact Map set. 7. For all locations where multiple culverts are proposed, the plan sheets must clearly detail that low flows shall be accomplished in one culvert/pipe and additional Mr. Paul Wojoski Page 3 of 4 September 9, 2022 culverts/pipes shall be installed such that they receive only flows above bankfull. Please provide design details that clearly show floodplain bench construction and/or sills at the inlet and outlet of the culverts to ensure that the stream is not over -widened on either end of the culvert. Please also provide a profile view of all stormflow culverts. This information has been added to the attached Impact Map set for the multiple barrel culvert at impact location S15. 8. The alignment of the culvert outlet at stream impact S17 appears to be directed at a streambank. Please either provide a revised alignment or provide more detailed information to clarify or otherwise address the proposed alignment. The stream at impact S17 is relatively low flow as it originates just upstream of the culvert inlet. The proposed slope of the pipe in the original submittal could result in some stream bank erosion, therefore, an inside drop junction box has been added to allow the outlet pipe to be constructed at a low grade with less slope, thus reducing the velocity and potential for streambank erosion at the outlet. Based on engineering calculations for the revised pipe grade, the proposed riprap stabilization at the outlet would adequately control the discharge and minimizes impacts compared with rerouting the stream or extending the pipe further downstream to the next bend which would entail additional wetland impacts. 9. The riprap apron proposed at Impact S15 is extensive. Please provide plan and profile construction details for the riprap outlet apron. The details should clearly show how natural stream flow and conditions will be maintained within a low flow channel within the enhanced riprap apron. It is the Division's experience that when excessively wide riprap aprons are required for velocity control and/or stability that natural stream function is not maintained and therefore these impacts should be considered as permanent loss of stream. The riprap apron at the S15 culvert outlet has been re-evaluated and reduced in size. Culvert details have been added in the attached Impact Map set and provide the requested information. 10. Pursuant to 15A NCAC 02H.0506(b) "a 401 Water Quality Certification may only be issued upon determining that the proposed activity will comply with state water quality standards which includes designated uses, numeric criteria, narrative criteria and the state's antidegradation policy, as defined in rules of 15A NCAC 02B.0200... In assessing whether the proposed activity will comply with water quality standards, the Division shall evaluate if the proposed activity: (2) would cause or contribute to a violation of water quality standards; (3) would result in secondary and cumulative impacts that cause or contribute to, or will cause or contribute to, a violation of water quality standards". In order for the Division to fully evaluate the potential hydrological impacts on some stream and wetland features within the project limits, please provide the location of all outlet structures from the SCMs shown on the proposed plan sheet. In order to avoid Mr. Paul Wojoski Page 4 of 4 September 9, 2022 further requests for additional information upon receipt of the response to this item, the Division strongly encourages that you carefully evaluate the proposed site plan for locations where existing surface hydrology will be redirected which would have the potential to remove or reduce the existing functions of a stream and/or wetland. Based on the current proposed plan the Division believes there is potential for indirect impacts to some features within the overall project limits. The SCM outlets have been added as Sheet Q in the attached Impact Map set. The engineering team is evaluating these outlets for pre- and post -construction drainage areas and we will provide more detailed evaluation of each SCM by 9/30/22. 11. Please provide a conceptual construction schedule for all impacts proposed within the application. Please note that mitigation will be required for ALL impacts unless a mitigation schedule is requested, reviewed and approved by the Division. Please note that any 401 issued by the Division will expire upon expiration of the 404 permit. Noted. The anticipated construction schedule is represented on the attached phasing and construction exhibit. Greenfield has elected to pursue phasing of the mitigation as construction advances. We will coordinate this request with you and the USACE and provide a detailed phased mitigation proposal by 9/30/22. The project is located in northern Harnett County, south of the Wake County line (Figure 1). Hector Creek, a High Quality Water (HQW), drains through the project area. Per Section III of the above referenced policy, private development projects are unlikely to cause cumulative impacts unless they are: (1) relatively large, (2) involve commercial development, and (3) occur in otherwise relatively undeveloped landscapes with an impact on regional growth patterns. The Serenity Development is relatively large but does not have a commercial component. In addition, while the site is in a relatively undeveloped landscape, it is reasonable to expect other developments in the area over time, regardless of this development, due to the continuing growth expected in nearby Wake County and surrounding areas. Therefore, the project is unlikely to affect anticipated regional growth patterns. While the project does not seem to meet all the criteria for private development projects requiring cumulative impact analysis, the following qualitative analysis is provided to reinforce that there are adequate protections in place to protect downstream water quality. This analysis focuses on stormwater management and stream buffer requirements, as these are key to maintaining downstream water quality. Additional water quality protection, including Flood Damage Prevention and Sediment and Erosion Control are also applicable in these jurisdictions and information can be provided if requested. The project is located in an area with multiple existing local environmental ordinances. As shown in Figure 1, Serenity is primarily within the HQW and Water Supply Watershed (WSW) of Hector Creek. Adjacent areas to the north, south and west are within the same watershed. Adjacent areas to the east are in Phase II and WSW areas. Both Harnett and Wake County have multiple environmental ordinances protecting water quality that would be applicable to future development if it occurred in the area. In Harnett County, where the majority of undeveloped land is located, all potential areas of development within the project vicinity fall under either: 1) Water Supply Watershed — areas within WSW Protection Area 2) High Quality Waters — within 1-mile and draining to HQW waters 3) Phase II Post -Construction Stormwater — all other areas of the County including WSW areas outside PA Serenity — Cumulative Impact Analysis Page 2 of 3 September 9, 2022 Areas within and adjacent to the project fall within the highest category of protection according to the 2004 policy (HQW/WSW) or have additional regulatory measures of protection (Phase II). A brief summary of applicable watershed and stormwater ordinances is provided below for Harnett County, where the majority of adjacent land is located. Wake County, while not summarized below (due to higher current development and limited adjacent area), has similar measures in place. A stormwater permit is required for all new development and redevelopment with a cumulative disturbance of 1 acre or more. Preliminary subdivision plats and site plans must include a stormwater management statement which includes: - USGS & NRCS mapping - Descriptions of all water courses, impoundments, and wetlands on or adjacent to the site or into which stormwater directly flows - Statement noting if the site is within conservation zoning or a watershed district - Impervious area calculations - Description of proposed stormwater management system, including: o BMP preliminary sizes and locations o Post development drainage map delineating flows to each BMP o Description and concept for diversion of off -site stormwater o Pre- and post -development discharges for the 10 and 25-year storms o Downstream analysis (if post -development is greater than 10%) • Topography with drainage areas • Photographs of downstream structures • Analysis of increased velocity and flooding in existing streams • Analysis of increased headwater and flooding for existing culverts • Point where the development is less than 10% of the watershed • Analysis to demonstrate no adverse impacts in the increase in runoff • Detention or other improvements to minimize downstream impacts Stream buffers or setbacks are required in all areas of the County as follows: - High Quality Waters — 30-foot stream buffers - Watershed Protection Area — 30-foot stream buffers (100-foot for high density) - All other areas of the County — 30-foot impervious setbacks for Phase II Stormwater - Buffers and setbacks are implemented on intermittent and perennial streams, except WSW applies to perennial features only. Note that WSW areas east of the project are not within the Protected Area, and therefore would fall under Phase II rules Construction Plans for stormwater management plans must include: - Erosion control measures - Detailed topographic information - Storm sewer profiles - 100-year floodplain boundaries and elevations - All jurisdictional wetland boundaries - All proposed stormwater management facilities - Construction details Serenity — Cumulative Impact Analysis Page 3 of 3 September 9, 2022 - Drainage easements - Certification by a Professional NC Land Surveyor or Engineer is required for as -built plans The summary above is provided to show that there are adequate water quality protections in place within the immediate vicinity of the proposed development within Harnett County. Further information regarding the detailed requirements of each ordinance can be provided, if requested. Per DWR policy, and based on the information provided above, the project: 1. Is not likely to induce growth — the project does not meet all three criteria for private development that are likely to cause cumulative impacts 2. Is not likely to impact existing uses/water classifications — the project and much of the surrounding area are within HQW/WSW watersheds 3. Does not require additional regulatory measures — remaining areas of the County are already under Phase II stormwater requirements Therefore, the project is not likely to cause or contribute to cumulative impacts on water quality in the region and a quantitative analysis of impacts is not required.
