I've attached a draft of the PCN, minus the maps, etc., which I'll include in the final submittal. It is my understanding that the biological evaluation from 2010 is still good (through 2015), but that we need to do another Virginia spiraea survey at the locations. Mark is coordinating with USFS botanists to conduct those surveys. The Elktoe surveys are happening this week. One of the things I need is an authorization from each of you to act as agent. Last time an email was sufficient (see attached). If you want to do a formal authorization, the Corps template is also attached. The following comments are provided-in•accordance with the provisions of section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531 -1543) (Act). According to the,revised Biological- Evaluation/Biological Assessment (BE), coarse sand, gravel, and,cobble,would be placed within the CheoahRiver at about 12 locations over a 5 year period. Placement of the gravel would use existing roads and river access points. The -gravel would be placed by dump trucks and/or bobcats. 'The gravel additions are expected to improve habitat for many species of aquatic organisms living within the Cheoah River, including the federally endangered Appalachian elktoe and the federally threatened spotfin chub. Gravel placement sites were surveyed on June 15, 2010rand July 15, 2010 for the presence of Virginia spiraea. One gravel site (B -06) was relocated about 100 feet upstream to the existing boat,access area to avoid potential effects to a spiraea population. After,three years (after June 15, 2013), additional Virginia spiraea surveys will be conducted at the proposed treatment sites prior to placement of new gravels. Suitable Appalachian elktoe habitat (as determined by a permitted biologist) will be surveyed,downstream (about 50 meters below the proposed gravel sites) within 3 months prior to gravel placement. The U.S. Forest'Service (USFS) expects this project to provide additional spawning areas for host fishes and burrowing substrate for the Appalachian emoe and has concluded that the gravel addition may affect, but is not likely to adversely affect the Appalachian elktoe. The USFS. also believes this project will provide additional spawning areas for the spotfin chub and'that the project may affect, but is not likely to adversely affect the spotfin,chub. The USFS determined that because most of the gravel will remain in the,main channel of the river, most of the Virginia spiraea populations, are above expected high water levels, and all of the Virginia spiraea populations growing, downstream of the proposed treatment`areas are at least 50 -1'00 feet below the augmentation sites, that Virginia spiraea will experience:no indirect effects as a result of the project. The USFS thus concluded that the proposed-project will have no affect on Virginia spiraea. We concur with your conclusions'that the proposed gravetaugmentation will not affect Virginia spiraea and is not likely to adversely affect the spotfm chub or Appalachian elktoe. However, for clarity, we assume that when you state that "Suitable Appalachian elktoe,habitat (as determined by a permitted biologist) will be surveyed downstream (approximately 50 meters below the proposed,gravel sites) within 3 months prior to gravel placement", you mean that all of the area, including the gravel placement site, to 50 meters downstream will be, surveyed. Further, because the BE does not state what will be done if the Appalachian elktoe is found during the =survey, we assume that gravel will not be placed in that location. Similarly, we assume that if Virginia spiraea is found during future surveys, that gravel will not be placed in those locations. If these assumptions are correct, then the, requirements under,section 7(c) of the Endangered Species Act are fulfilled. However, obligations under section 7 of the Endangered Species Act must be reconsidered if: (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered, (2) this action, is subsequently modified, in a,manner that was not considered in this review, or (3) a new species is listed or critical habitat is determined that may be,affected by the identified;action.
