FHWA has determined that after reviewing the Public Areas Maintenance Agreement between Progress Energy Carolina Inc. (Duke Energy), and the NC Wildlife Resources Commission (NC WRC),they believe the Swift Island Access Area (boat ramp access parking area) adjacent to NC 24-27 and NC 73 is a Section 4(f) protected resource. We have decided to wait until the section 4(f) issue is resolved prior to agreeing on a revised LEDPA. FHWA and NCDOT is currently coordinating with NC WRC, and I will keep you all posted on this issue. If you have any questions or need additional information, please let me know. Thanks, Lisa Lisa M. The Land Trust of Central NC will NOT be able to take over ownership of the historic Swift Island bridge as discussed in their email below. I have included the legislation that was passed as part of the budget that includes the requirements specific to this bridge that was discussed in their email: The merger team discussed that if this situation arose, we would revisit our selection of the LEDPA for the B-4974 portion of the corridor. Based on the fact that there is no longer a willing party to take ownership of the historic bridge, do you agree that the recommended LEDPA should now be B-4974,Alternative 4, replace in place? The impacts summary from the January 22, 2014 CP3 meeting is still valid. I have reserved a one-hour time slot in case we would like to meet to discuss the issue, or we can gather input through email. Please let me know by Friday,August 29th whether you wish to have the meeting on September 11th or to work through email to communicate your LEDPA selection and ultimately sign a new concurrence form. In light of the 2014-2015 budget that was passed and signed into law, my board had a conference call to discuss our willingness to accept ownership of the Swift Island Bridge. We discussed the expected new costs for bonding and right of way acquisition due to the new statutory requirements. While we do not have good cost estimates on these new requirements,we feel confident that these costs will exceed what we are willing to bear in order to preserve the bridge for pedestrian and cycling purposes. 2 As you know,we were excited about saving the historic structure for its own sake, as well as to help foster recreational tourism in the Uwharrie region. With Morrow Mountain State Park and the Uwharrie National Forest so close to this bridge,we honestly believed that its preservation could create tourism opportunities that do not currently exist. However, due solely to the additional financial burden created by the new statutory language regarding right of way costs and bonding expenses,we will not be able to make this commitment. Should these additional expenses be removed in the future,we would be willing to accept and maintain the bridge as originally contemplated. Regardless,we hope that the Highway 24/27 expansion moves forward. It is an important corridor to the future health of the region, and we always hoped that our participation in saving the bridge would do nothing to delay this project. In fact,we believed—rightly or wrongly—that helping NC DOT meet its Section 106 obligations and ensuring the that bridge could remain in use while a new bridge was built(versus the using the Garritson Bridge as a two-way traffic bridge for a lengthy period of time)was helpful to the overall highway widening project and the region's economy.
