Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:* The site is currently undeveloped and forested. Wetlands transect the site in several places. A road exists within an easement along the western property boundary, but the easement ends before getting to the southern portion of the site. 4b. Explain the purpose of the proposed project: * The purpose of the project is to construct a residential development within the site to serve the residential needs of the community. Wetland impacts are needed to access one of the lots. 4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be used: * The residential development will contain five single family lots. Two pits also proposed within the site. Access to the lots will be mostly provided by an existing dirt road located within an easement on the western boundary. The applicant does not have rights to the easement beyond the Ray property and needs to construct a road within his tract and partially through wetlands to access the southernmost lot. This road will be 12 feet wide. A 18" culvert is proposed at the wetland crossing to maintain a hydrological connection. Sediment and erosion control measures will be put in place. Then the limits of disturbance will be cleared of vegetation and site grading will occur. The road and utilities will be installed. Then home construction will occur. Track hoe, loader, dump truck, bob cat, and other standard construction equipment will be used. 5. Jurisdictional Determinations 5a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: The applicant attempted to avoid and minimize impacts to wetlands as much as possible. Unfortunately, his easement to the existing dirt road terminates prior to accessing the uplands in the southern part of the site, where he plans to construct a house. Crossing wetlands on his property was the only way to get this this area. The road width through wetlands has been minimized to 12-ft to reduce wetland impacts. lb. The NC Natural Heritage Program database was reviewed to determine if any rare species are known to occur on or near the site. According to their files, no federally listed species are known to occur on the site. Several federally listed species and managed areas are documented within a one mile of the site. The USFWS IPaC database was also reviewed and several species were identified as potentially occurring in the region. Many of these are coastal and/or marine species and would not be found within the project area. Most of the site is forested, with some clearing and pond construction in uplands in the northern part of the site. Wooded uplands support a mix of hardwoods and pines and wetlands support mostly shrubs, with a very sparse canopy of pines. Therefore, it does not appear to provide suitable habitat for the red cockaded woodpecker. Forested areas within the site provide appropriate summer and wintering roosting habitat for the northern long-eared bat. Because no roost trees have been identified by the USFWS in Onslow County, any associated take from the proposed project as a result of clearing trees would be exempt per the Programmatic Biological Opinion for the NLEB. The site does not appear to provide suitable habitat for any other federally protected species known to occur in the area. 6. Essential Fish Habitat (Corps Requirement) 6a.
