PROJECT SUMMARY: Fill 0.19 acres of 404 wetlands and construct a garage with 2nd- floor apartments, boat storage area, driveway, parking, and septic system. Project Setting The project parcel #025807000 is listed as 0 S. Hwy 64/264, in Manteo, Dare County. This vacant, 7.12-acre, lot is adjacent to natural and man-made canals that connect to Scarboro Creek and Shallowbag Bay, which join with the Roanoke Sound. The elevation of the tract is ±3' above normal water level (NWL). There was no shoreline erosion noted onsite. The only man-made use currently on this tract is an old gravel driveway. The vegetation onsite included Loblolly pine (Pinus taeda), Eastern red cedar (Juniperus virginiana), Live oak (Quercus virginiana), Black Gum/tupelo (Nyssa sylvatica), (Jesuit's bark (Iva frutescens), Poison ivy (Rhus radicans), Winged Sumac (Rhus copallinum), Black needlerush (Juncus roemerianus), Salt meadow hay (Spartina patens), and Sawgrass (Cladium jamaicense). A coastal marsh is located on and adjacent to the north, northeast portion of the parcel, and no coastal wetland vegetation is within the project worksite. A Jurisdictional Determination (JD) of 404 wetland vegetation was verified by the US Army Corps of Engineers (USACE) Regulator Official, Billy Standridge, on 07/13/21, and a copy of the JD (Action ID SAW- 2021-01130) is included in the application package. There is no known permit history or archaeologic sites associated with this property. The riparian property to the north is developed with a single-family residence, dock, and basin. The riparian property(s) to the south are undeveloped marsh and the Scarborough Creek Homeowners subdivision, developed with single-family residences, bulkheading, and dockage. The waters of the Scarboro Creek, Shallowbag Bay, and Roanoke Sound are within the Pasquotank River Basin. These waters are classified as Coastal by the NC Marine Fisheries Commission. The DWR water classification for the Shallowbag Bay is SC, Scarboro Creek is SC and HQW, and the Roanoke Sound is SA and HQW. The canal does connect to a PNA, and the area is closed to shellfishing. Development Proposal IDEM, Inc., proposes to fill 0.19 acres (8,291.17 sf) of 404 wetlands, which will reviewed through Nationwide 18 and Nationwide 14 permit requests. ±2,500 sf of that fill falls within the upland area of the CS AEC. Correspondence has been received from The Great Dismal Swamp Restoration Bank, LLC, confirming the applicant's request for the purchase of 0.378 riparian wetland mitigation credits. The development proposed includes the construction of a 70'x44' (3,080-sf) garage with 2nd-floor apartments for 4 bedrooms, a 6'x48' (288 sf) cantilevered open deck with stairs to a 4'x35' (140 sf) walkway, a 42'x30' (1,260 sf) boat storage/canopy area,12'-wide gravel access driveway with associated parking/apron, and a 24'x50' (1,200 sf) Brunswick Bed in fill with pressure manifold septic system with associated septic tank(s). Impervious coverage within the CS AEC is limited to 846.34 sf of the garage/apartment building and boat canopy area, and 4,365.10 sf of the gravel drive aisle and parking, with a total of 8.71 % AEC coverage. The total proposed impervious coverage for the project parcel is ±12,746 sf (4.10% of 301,148.44 sf). Anticipated Impacts The development as proposed will fill 8,291.17 sf of 404 wetland vegetation. High Ground Habitat - 10,253.32 sf • 5,211.44 sf of impervious coverage in the upland area of the CS AEC will result from the construction of a section of the garage/apartment building, boat canopy area, gravel drive and parking. • 428 sf of shading will result from the construction of the cantilevered open deck and walkway with stairs located outside of the CS AEC. • The balance of upland development related to the construction, grading and filling will result in 4,613.88 sf of disturbance outside of the CS AEC. HIGHWAY 64/264 MANTEO, NC 27954 The applicant proposes to improve the site by constructing two 2-bedroom apartments, garage/storage, and boat storage area. The proposed development will be serviced with a Brunswick Bed System. The project will require fill in wetlands, 4,088.14 sq. ft. for the driveway (Nationwide #14), and 4,203.03 sq. ft. for the area surrounding the wastewater system, garage, and for parking (Nationwide #18). The 0.198 acres (total) will be mitigated with 0.378 acres of credit from The Great Dismal Swamp Restoration Bank, Inc. The owner plans to build a single-family residence at a later date that will be northeast of the proposed structure. Although the single-family structure is in the early stages of planning, it is anticipated that no additional fill in wetlands will be necessary. The wetlands have been delineated and confirmed SAW-2021-01130. The wetlands have been delineated, and the delineation has been verified by the Corps to be sufficiently accurate and reliable. The approximate boundaries of these waters are shown on the enclosed delineation map dated 5/24/2021. Therefore, this preliminary jurisdiction determination may be used in the permit evaluation process, including determining compensatory mitigation. For purposes of computation of impacts, compensatory mitigation requirements, and other resource protection measures, a permit decision made on the basis of a preliminary JD will treat all waters and wetlands that would be affected in any way by the permitted activity on the site as if they are jurisdictional waters of the U.S. This preliminary determination is not an appealable action under the Regulatory Program Administrative Appeal Process (Reference 33 CFR Part 331). That statute addressed wetlands subject to the Clean Water Act be limited to those areas should only include relatively permanent, standing or continuously flowing bodies of water. The result of that rule was to trigger actions by the North Carolina Division of Water Quality (NCDWQ) which administered Section 401 of the Clean Water Act to require a request for an agency meeting and provided a 30-day window for such actions before a CAMA Major Development Permit could be considered. That rule was overturned during the current administration (President Biden). The abandonment of that rule was challenged to the U.S. Supreme Court and decided on April 6, 2022 to reinstate the rule and thus the North Carolina Division of Water Quality procedures. I was informed that an email to NCDWQ will suffice to begin the 30-day review process to satisfy the period before the CAMA Major Development process can begin. Thus please find attached a narrative and plat for a project in Dare County and trust it will suffice to initiate the 30 day process. Thanks for your consideration of this request.
