Attn: Michael Murphy, Owner 11120 Tomahawk Creek Parkway Leawood, KS 66211 Subject: NOTICE OF VIOLATION (NOV-2022-PC-0485) NPDES Stormwater General Permit NCGO80000 MHC Kenworth-Clinton, Certificate of Coverage NCGO80980 Sampson County Dear Mr. Murphy: On August 26, 2022, Melissa Joyner from the Fayetteville Regional Office of the Division of Energy, Mineral and Land Resources (DEMLR), conducted a site inspection for the MHC Kenworth-Clinton facility located at 1103 N. US 421 Highway, Sampson County, North Carolina. A copy of the Compliance Inspection Report is enclosed for your review. Jack Sexton, Facility Manager and Robin Austin, P.E., Manager, Civil Division, with CATLIN Engineers and Scientists were also present during the inspection and their time and assistance is greatly appreciated. The site visit and file review revealed that the subject facility is covered by NPDES Stormwater General Permit NCG080000 under Certificate of Coverage NCG080980. Permit coverage authorizes the discharge of stormwater from the facility to receiving waters designated as Great Coharie Creek, a class C:SW waters in the Cape Fear River Basin. As a result of the site inspection, the following permit conditions violations are noted 1) Stormwater Pollution Prevention Plan (SPPP) Per Part B... A Stormwater Pollution Prevention Plan (SPPP) has not been developed and properly implemented. 2) Analytical Monitoring Per Part E, Section E-1-E-4... Analytical monitoring has not been conducted and/or recorded in accordance with permit requirements. 3) Qualitative Monitoring Per Part D, Section C... Qualitative monitoring has not been conducted and/or recorded in accordance with permit requirements. Other Observations Please refer to the enclosed Compliance Inspection Report for additional comments and observations made during the inspection. Requested Response You are asked to respond to this office, in writing, within 30 calendar days from receipt of this notice. Alan Cabe has replaced Brandon Henricks as the person responsible for the permit for this facility. A Permit Contact Update Request Form will need to be completed and submitted. Please refer to the following link to access this form: https://deq. nc.gov/about/divisions/energy-mineral-and-land-resources/stormwater/stormwater-program/npdes-industrial-progr m Since the MHC Kenworth-Clinton facility had been issued industrial stormwater coverage in December 2019 under General Permit NCG080000, Certificate of Coverage NCG080980, a Stormwater Pollution Prevention Plan (SPPP) had not been developed and implemented by the facility. No Analytical or Qualitative monitoring had occurred at the outfalls. The facility grounds were reviewed with two outfalls identified on the south side of the property where Analytical and Qualitative Monitoring should occur. Ms. Austin had said that a No Exposure Certification Application form had been submitted. (It was later determined that this form had not been submitted.) This facility does not qualify for No Exposure because there were parked trucks awaiting repairs on the facility grounds near the outfalls and there was also scrap metal located outdoors near a ditch which transported water toward the outfalls.
