PROJECT SUMMARY: Demolition of dilapidated structures and construct a marina in the existing basin, with improvements to include maintenance excavation of the access channel, canal, and basin, two 12-unit multi -family dwellings, pool & accessory building, bulkhead, boardwalks, finger piers, pier, platforms, riprap, boat ramp, and associated infrastructure. Project Setting The two parcels (Lots 1 r and 2r) are located at 27446 and 27478 NC Hwy 12 in Salvo, Dare County, adjacent a manmade basin and connected to the Pamlico Sound. These two lots equate to a total of 5.06-acres. Lot 1 r (#27446) currently has an existing boat basin with dilapidated structures, including a bulkhead, boat ramp, and finger piers, as well as upland concrete and gravel. There are natural uplands with native grasses starting at the east side of the bulkhead leading up to Hwy NC 12. Along the north side of the bulkhead, where the elevation is 4-5' above normal water level (NWL), the upland area consists of natural grass, salt meadow cordgrass, Atlantic cedar, wax myrtles, bayberry, and catbrier, then slopes down to a Coastal Wetland (CW) and 404 Wetland area that includes Big cordgrass (Spartina cynosuroides), cattails, and Black needlerush (Juncus roemerianus). In that northern section there is also a natural pond that opens to the next canal to the north. There is a Coastal Wetland fringe along the non -hardened north side of the canal on Lot 1 r that consists of Smooth cordgrass (Spartina alterniflora), and Black needlerush, and the wetlands extend to the northwest end of the lot. The water depth along the shoreline is -1' NWL. As you cross the canal, the water depths range from -1' to -4' NWL. Transitioning to the south side of the canal, a small area of Common Three -square (Scirpus) on an upland area southwest of the dilapidated bulkhead is not claimed as jurisdictional Coastal or 404 wetlands. This upland area also has native grasses. The ±1' erosion onsite is noted to be where the bulkheading has failed due to storm and deterioration. On the west side of the canal near the existing bulkhead return there is CW and 404 wetland vegetation that includes Smooth cordgrass, and transitions to a marsh on Lot 2r that also includes Black needlerush. Field indicators for the CW area also included the existence of periwinkle and crab holes. An official USACE Jurisdictional Determination (JD) verifying 1.86 acres of 404 wetlands dated 01/21/22 was completed by Billy Standridge, and a copy of that JD is included in the application package. The permit history found for this property was General Permit (GP) #21808A, which was issued to OBX LLB on 04/23/99 for the repair and replacement of 500' of bulkheading, as well as repair of the existing boardwalk. This permit referenced Salvo Market and Campground in the project location. Further research determined that GP #21808A was a renewal for the original GP021261A issued on 11/18/95. The riparian property to the north is developed with a single-family dwelling, utility shed, detached garage, a bulkhead and docking facility. The riparian property to the south is developed with a mobile home and utility shed. Field Investigation Report: Salvo Marina 27446, LLC Page 3 An interagency scoping meeting was held on 07/29/21 to discuss the redevelopment of this property. Representatives from Quible & Associates, SAGA Construction & Development, USACE, National Marine Fisheries, US Fish & Wildlife Services, NC Wildlife Resources, Marine Fisheries, Coastal Management, 401 Division of Water Resources, Stormwater, and Land Quality were in attendance. The waters of the Pamlico Sound are within the Pasquotank River Basin. These waters are classified as Coastal by the NC Marine Fisheries Commission. The DWR water classification for the Pamlico Sound is SA & HWQ. These areas are not designated as Primary Nursery Areas and are closed to the harvesting of shellfish. Development Proposal The applicant is proposing the demolition of the existing structures (i.e. boardwalk, finger piers [7 slips], boat ramp, bulkhead) and improvements for a marina, to include two, 12-unit multi -family dwellings, pool & accessory building, bulkhead, boardwalks, finger piers, pier, platforms, riprap, boat ramp, and associated infrastructure. Maintenance excavation of the access channel (entrance on the west side of the canal) and areas in the middle and east side of the canal/basin is proposed. An SAV survey was conducted on 06/25/21 by representatives of Quible & Associates. No rooted SAV was found within the areas of the proposed excavation and development. Ruppia Maritima beds were documented outside of the mouth of the channel and boat basin, and the area is identified on Sheets 1 and 2 that were submitted with the major application. The water bottom in the canal is sand and muck. The dimensions for the excavation starting at the entrance are 246'x20'x-1', which will remove ±182 cubic yards (cy). The collective dimensions for excavating the remaining areas of the canal/basin are 462'x22'.5"x-1', which will remove ±385 cy. The total amount of material to be excavated from below NWL is 567 cy. An upland area in the northwest section next to the basin is proposed to be excavated to lengthen the current basin an additional 60'. A 3,018 square foot (sf) area will be removed, resulting in 671 cy of high -ground excavation. A 290'x25' (7,250 sf) dredge disposal area for the spoil is proposed on the southeast side of the basin, outside of the 30' buffer. Silt fencing will be used to contain the dredge spoils. After the spoil is dewatered and removed, that section of the site is proposed to be asphalted for an access to the proposed boat ramp, pool house, and boat trailer parking area. A new 34'x22' boat ramp is proposed on the southeast side of the basin, with a courtesy pier on each side. The pier on the east side of the ramp is proposed at 15'x4', and the pier on the west side of the ramp is proposed at 34'x4'. A total of 13 finger piers (dimensions of 8)(3' equating 24 sf each) with associated pilings are proposed in the canal and boat basin. A 32'x6' pier with a 20'x20' (400 sf) T-head platform and 2 pilings is proposed off the southwest shoreline of Lot 1 r. The construction of finger piers and installation of 51 pilings will create a total of 26 slips. A 33'.5"x27'.5" (921.25 sf) platform is proposed in the southeast corner of the basin for kayak and paddle board launches. Field Investigation Report: Salvo Marina 27446, LLC Page 4 Two channel marker/No Wake Signs are proposed at the entrance of the canal. The existing bulkhead will be replaced with a new 828 linear foot (Ift) vinyl bulkhead, transitioning from the north side of the basin to the east and ending at the southwest section of the canal. Most of the replacement bulkhead will average 0' waterward of NWL, with a maximum distance equaling 15' waterward of NWL on the southwest side of the canal. Proposed backfill material is clean sand, and ±2,065 sf of fill will be placed below NWL. A small area (±50 sf) of riprap revetment is proposed at the end of the southwest bulkhead return in front of a CW fringe. The maximum distance of the toe of the rock is ±3' waterward of the vegetation. Upland fill is proposed to raise the existing site grade to accommodate the proposed development and provide coastal flooding resilience. An estimated ±2.7 acres will be filled, with dimensions averaging 270'x450'. The majority of the western section of the parcel is zoned AE(4), and the upland section to the east of the basin is zoned 'Shaded X'. The proposed upland development on Lots 1 r and 2r includes two 12-unit, multi -family dwellings with associated parking and septic system, a concrete pool with concrete decking and a pool house accessory building, a 514'x6' walkway leading to a 200 sf overlook platform on the north side of Lot 1 r, an 820'x5' boardwalk around the basin, 2 kayak stands/racks, a walkway leading from the dwellings to the boardwalk, asphalt driveway and boat launch drive. The north side access driveway, southern access driveway, septic systems, parking for the multi -family dwellings, one-10'x12' dumpster pad, and the southern section of the boat launch drive equate to ±5,472 sf (approximate dimensions are 228'x24') and are sited outside of the CAMA 75' AEC. A 92'x92' (±8,464 sf) stormwater basin is proposed between the boat trailer parking area and the second multi -family dwelling to address surface runoff. The applicant is also proposing 811 Ift of retaining wall to be constructed on Lot 2r along the south side of the property between the upland development and the 404 wetlands. The total impervious coverage proposed in the 75' CAMA AEC is ±20,659.2 sf (17.5%). The total impervious coverage and/or built -upon surfaces of the entire tract(s) is ±60,975.4 sf (27.7%). Anticipated Impacts Estuarine Waters/Public Trust AEC = 20,199.25 sf • The construction of the main pier, courtesy piers, finger piers, T-head platform, and launch platform will result in ±2,021.25 sf of shading of the Open Water Habitat. • The construction of the boat ramp will result in the filling of 748 sf of Shallow Bottom habitat. • A total of ±15,315 sf of Shallow Bottom habitat will be removed as a result of the maintenance excavation of the access channel/canal and basin. o A total of ±567 cy of material is proposed to be excavated. • The installation of replacement bulkheading and riprap, with associated backfill, will result the filling of ±2,115 sf of Shallow Bottom habitat. Field Investigation Report: Salvo Marina 27446, LLC Page 5 Coastal Shoreline (Estuarine/Public Trust Shoreline) AEC = 31,264 sf • Excavation of an upland area will result in the removal of 3,018 sf (671 cy) of shoreline. • Construction of the swimming pool and associated decking, accessory pool house, portion of the boat trailer parking area (BTPA), access drive(s) to the BTPA and boat ramp, and portion of the multi -family dwellings will result in ±20,289 of impervious coverage in the ES AEC, outside of the 30-foot buffer. • ±7,672 sf of shading in the 30-foot buffer will result in the construction of the walkways, overlook platform, and boardwalk. • ±285 Ift of the total 811 Ift of retaining wall proposed along the southern border of Lot 2r will fill ±285 sf (285x1). High ground (Upland development outside of the CAMA AEC) = ±73,000 sf • The remaining development, which includes the northern and southern access driveways, septic systems, multi -family dwellings, parking associated with the dwellings, dumpster pads, trailer parking area, boat launch drive, and associated filling and grading, will disturb High Ground habitat. Temporary water turbidity will occur during the water -dependent development. PROJECT SUMMARY: Demolition of dilapidated structures and construct a marina in the existing basin, with improvements to include maintenance excavation of the access channel, canal, and basin, two 12-unit multi -family dwellings, pool & accessory building, bulkhead, boardwalks, finger piers, pier, platforms, riprap, boat ramp, and associated infrastructure. Project Setting The two parcels (Lots 1 r and 2r) are located at 27446 and 27478 NC Hwy 12 in Salvo, Dare County, adjacent a manmade basin and connected to the Pamlico Sound. These two lots equate to a total of 5.06-acres. Lot 1 r (#27446) currently has an existing boat basin with dilapidated structures, including a bulkhead, boat ramp, and finger piers, as well as upland concrete and gravel. There are natural uplands with native grasses starting at the east side of the bulkhead leading up to Hwy NC 12. Along the north side of the bulkhead, where the elevation is 4-5' above normal water level (NWL), the upland area consists of natural grass, salt meadow cordgrass, Atlantic cedar, wax myrtles, bayberry, and catbrier, then slopes down to a Coastal Wetland (CW) and 404 Wetland area that includes Big cordgrass (Spartina cynosuroides), cattails, and Black needlerush (Juncus roemerianus). In that northern section there is also a natural pond that opens to the next canal to the north. There is a Coastal Wetland fringe along the non -hardened north side of the canal on Lot 1 r that consists of Smooth cordgrass (Spartina alterniflora), and Black needlerush, and the wetlands extend to the northwest end of the lot. The water depth along the shoreline is -1' NWL. As you cross the canal, the water depths range from -1' to -4' NWL. Transitioning to the south side of the canal, a small area of Common Three -square (Scirpus) on an upland area southwest of the dilapidated bulkhead is not claimed as jurisdictional Coastal or 404 wetlands. This upland area also has native grasses. The ±1' erosion onsite is noted to be where the bulkheading has failed due to storm and deterioration. On the west side of the canal near the existing bulkhead return there is CW and 404 wetland vegetation that includes Smooth cordgrass, and transitions to a marsh on Lot 2r that also includes Black needlerush. Field indicators for the CW area also included the existence of periwinkle and crab holes. An official USACE Jurisdictional Determination (JD) verifying 1.86 acres of 404 wetlands dated 01/21/22 was completed by Billy Standridge, and a copy of that JD is included in the application package. The permit history found for this property was General Permit (GP) #21808A, which was issued to OBX LLB on 04/23/99 for the repair and replacement of 500' of bulkheading, as well as repair of the existing boardwalk. This permit referenced Salvo Market and Campground in the project location. Further research determined that GP #21808A was a renewal for the original GP021261A issued on 11/18/95. The riparian property to the north is developed with a single-family dwelling, utility shed, detached garage, a bulkhead and docking facility. The riparian property to the south is developed with a mobile home and utility shed. Representatives from Quible & Associates, SAGA Construction & Development, USACE, National Marine Fisheries, US Fish & Wildlife Services, NC Wildlife Resources, Marine Fisheries, Coastal Management, 401 Division of Water Resources, Stormwater, and Land Quality were in attendance. The waters of the Pamlico Sound are within the Pasquotank River Basin. These waters are classified as Coastal by the NC Marine Fisheries Commission. The DWR water classification for the Pamlico Sound is SA & HWQ. These areas are not designated as Primary Nursery Areas and are closed to the harvesting of shellfish. Development Proposal The applicant is proposing the demolition of the existing structures (i.e. boardwalk, finger piers [7 slips], boat ramp, bulkhead) and improvements for a marina, to include two, 12-unit multi -family dwellings, pool & accessory building, bulkhead, boardwalks, finger piers, pier, platforms, riprap, boat ramp, and associated infrastructure. Maintenance excavation of the access channel (entrance on the west side of the canal) and areas in the middle and east side of the canal/basin is proposed. An SAV survey was conducted on 06/25/21 by representatives of Quible & Associates. No rooted SAV was found within the areas of the proposed excavation and development. Ruppia Maritima beds were documented outside of the mouth of the channel and boat basin, and the area is identified on Sheets 1 and 2 that were submitted with the major application. The water bottom in the canal is sand and muck. The dimensions for the excavation starting at the entrance are 246'x20'x-1', which will remove ±182 cubic yards (cy). The collective dimensions for excavating the remaining areas of the canal/basin are 462'x22'.5"x-1', which will remove ±385 cy. The total amount of material to be excavated from below NWL is 567 cy. An upland area in the northwest section next to the basin is proposed to be excavated to lengthen the current basin an additional 60'. A 3,018 square foot (sf) area will be removed, resulting in 671 cy of high -ground excavation. A 290'x25' (7,250 sf) dredge disposal area for the spoil is proposed on the southeast side of the basin, outside of the 30' buffer. Silt fencing will be used to contain the dredge spoils. After the spoil is dewatered and removed, that section of the site is proposed to be asphalted for an access to the proposed boat ramp, pool house, and boat trailer parking area. A new 34'x22' boat ramp is proposed on the southeast side of the basin, with a courtesy pier on each side. The pier on the east side of the ramp is proposed at 15'x4', and the pier on the west side of the ramp is proposed at 34'x4'. A total of 13 finger piers (dimensions of 8)(3' equating 24 sf each) with associated pilings are proposed in the canal and boat basin. A 32'x6' pier with a 20'x20' (400 sf) T-head platform and 2 pilings is proposed off the southwest shoreline of Lot 1 r. The construction of finger piers and installation of 51 pilings will create a total of 26 slips. A 33'.5"x27'.5" (921.25 sf) platform is proposed in the southeast corner of the basin for kayak and paddle board launches. Field Investigation Report: Salvo Marina 27446, LLC Page 4 Two channel marker/No Wake Signs are proposed at the entrance of the canal. The existing bulkhead will be replaced with a new 828 linear foot (Ift) vinyl bulkhead, transitioning from the north side of the basin to the east and ending at the southwest section of the canal. Most of the replacement bulkhead will average 0' waterward of NWL, with a maximum distance equaling 15' waterward of NWL on the southwest side of the canal. Proposed backfill material is clean sand, and ±2,065 sf of fill will be placed below NWL. A small area (±50 sf) of riprap revetment is proposed at the end of the southwest bulkhead return in front of a CW fringe. The maximum distance of the toe of the rock is ±3' waterward of the vegetation. Upland fill is proposed to raise the existing site grade to accommodate the proposed development and provide coastal flooding resilience. An estimated ±2.7 acres will be filled, with dimensions averaging 270'x450'. The majority of the western section of the parcel is zoned AE(4), and the upland section to the east of the basin is zoned 'Shaded X'. The proposed upland development on Lots 1 r and 2r includes two 12-unit, multi -family dwellings with associated parking and septic system, a concrete pool with concrete decking and a pool house accessory building, a 514'x6' walkway leading to a 200 sf overlook platform on the north side of Lot 1 r, an 820'x5' boardwalk around the basin, 2 kayak stands/racks, a walkway leading from the dwellings to the boardwalk, asphalt driveway and boat launch drive. The north side access driveway, southern access driveway, septic systems, parking for the multi -family dwellings, one-10'x12' dumpster pad, and the southern section of the boat launch drive equate to ±5,472 sf (approximate dimensions are 228'x24') and are sited outside of the CAMA 75' AEC. A 92'x92' (±8,464 sf) stormwater basin is proposed between the boat trailer parking area and the second multi -family dwelling to address surface runoff. The applicant is also proposing 811 Ift of retaining wall to be constructed on Lot 2r along the south side of the property between the upland development and the 404 wetlands. The total impervious coverage proposed in the 75' CAMA AEC is ±20,659.2 sf (17.5%). The total impervious coverage and/or built -upon surfaces of the entire tract(s) is ±60,975.4 sf (27.7%). Anticipated Impacts Estuarine Waters/Public Trust AEC = 20,199.25 sf • The construction of the main pier, courtesy piers, finger piers, T-head platform, and launch platform will result in ±2,021.25 sf of shading of the Open Water Habitat. • The construction of the boat ramp will result in the filling of 748 sf of Shallow Bottom habitat. • A total of ±15,315 sf of Shallow Bottom habitat will be removed as a result of the maintenance excavation of the access channel/canal and basin. o A total of ±567 cy of material is proposed to be excavated. • The installation of replacement bulkheading and riprap, with associated backfill, will result the filling of ±2,115 sf of Shallow Bottom habitat.
