Bridge Replacement 1) All work authorized by this permit shall be carried out in accordance with the following attached workplan drawings (15), except as modified herein: 2 dated as received 7/1/14, 7 dated as received 6/26/14, 2 dated as received 8/27/14, 1 dated 3/4/14, and 3 dated 4/29/14. 2) In accordance with the permit application, due to the classification of Deep Creek as a Primary Nursery Area, no in-water work work shall be conducted between April 1 to September 30 of any year without prior approval of the N.C. Division of Coastal Management (DCM), in consultation with the N.C. Wildlife Resources Commission and the N.C. Division of Marine Fisheries. 3) In accordance with the permit application; turbidity curtains shall be installed along the creek banks at the bridge abutments and along the canals. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. Department of Transportation Permit 977-14 Page 2 of 4 2%DDITIONAL CONDITIONS 4) No excavation or filling shall take place at any time in any wetlands or surrounding waters outside of the alignment of the areas as indicated on the attached workplan drawings, without permit modification. 5) All fill material shall be clean and free of any pollutants except in trace quantities. 6) Material excavated from the project site may be used in fill areas associated with the project or shall be removed from the site and taken to a high ground location. 7) The bridge shall be constructed using staged construction techniques. Any other construction method may require additional authorization from DCM. 8) The installation of the piles for the bridge and the steel sheet piling shall be accomplished by pile driving and/or the use of a vibratory hammer. Should the permittee and/or its contractor propose to utilize another type of installation, such as jetting or drilled shaft construction, additional authorization from DCM shall be required. 9) filings from the existing bridge, as well as any remnant pilings from previous bridges, shall be removed in their entirety, except that in the event that a bridge piling breaks during removal and cannot be removed in its entirety, the bridge piling may be cut off flush with the bed of the water body, and DCM shall be notified of each occurrence within one working day. 10) The authorized permanent steel sheet piling shall be structurally tight so as to prevent seepage of fill materials through the structure. The steel sheet piling shall be in place prior to any backfilling activities. 11) The placement of riprap shall be limited to the areas as depicted on the attached workplan drawings. The riprap material shall be clean and free from loose dirt or any pollutant. The riprap material shall consist of clean rock or masonry materials, such as but not limited to, granite, marl or broken concrete. 12) Any materials and/or debris resulting from the demolition or construction activities shall not enter wetlands or waters of the State, even temporarily. 13) Any waste materials and debris associated with construction, demolition, or other activities shall be disposed of at an approved upland site or shall be recycled in an environmentally appropriate manner provided appropriate authorizations are obtained from any relevant state, federal, or local authorities. 14) Live concrete shall not be allowed to contact waters of the State, or water that will enter waters of the State. 15) Construction staging areas shall be located only in upland areas, and not in wetlands or waters of the State. Department of Transportation Permit,477-14 Page 3 of 4 ADDIT1-i-1AE CONDITIONS 17) The construction of the new bridge will also require the relocation of a fiber optic lin- owned by 1k:,- Microelectronics Center of North Carolina(MCNC), and telecommunication lines. All utility lines shall f be installed using a directional bore drilling method under the creek. Sedimentation and Erosions Control 18) This project shall conform to all requirements of the N.C. Sedimentation Pollution Control Act and the N.C. Department of Transportation's (NCDOT's) Memorandum of Agreement with the N.C. Division of Energy, Mineral, and Land Resources. Impacts to Wetlands and Waters of the State and Conn etr nsato-LMitigation NOTE: This project will permanently impact approximately 4,658 square feet of Coastal Wetlands due to fill, and will temporarily impact approximately 54 square feet of Coastal Wetlands due to excavation. This project will permanently impact approximately 54 square feet of surface waters due to fill. NOTE: In accordance with the Ecosystem Enhancement Program (EEP) letter dated 6124/14, compensatory mitigation for permanent impacts of 0.106 acres of coastal marsh wetlands associated with the authorized project shall be provided by the EEP in accordance with the EEP In-Lieu Fee Instrument dated 7/28/10. 19) In order to prevent the introduction of invasive species such as Phragmites into the project area, the permittee shall implement appropriate measures, including but not necessarily limited to, appropriate cleaning of equipment prior to its arrival on the project site. 20) In accordance with the permit application, the replacement of the existing bridge with a longer bridge shall allow for the restoration of approximately 1,200 square feet of coastal floodplain through removal of the existing bridge approach fill and grading the elevation to match adjacent coastal wetlands. 21) There shall be no clearing or grubbing of wetlands outside of the areas indicated on the attached workplan drawings without prior approval from DCM. Department of Transportation Permit 477-I4 Page 4 of 4 ADDITIONAL CONDITIONS 24) If it is determined that additional permanent and/or temporary impacts are necessary that are not shown on the attached workplan drawings or described in the authorized permit application, a permit modification and/or additional authorization from DCM may be required. In addition, any changes in the approved plan may also require a permit modification and/or additional authorization from DCM. NOTE: The permittee and/or its contractor is strongly encouraged to contact the DCM Transportation Project Field Representative in Elizabeth City to request a preconstruction conference prior to project initiation. 25) The N.C. Division of Water Resources (DWR)authorized the proposed project on 7/2/14 (DWR Project No. 14-0513) under General Water Quality Certification No. 3900. Any violation of the Certification approved by DWR shall be considered a violation of this CAMA permit. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under Nationwide Permit Number 3 and Nationwide Permit Number 12 (COE Action ID No. SAW-2014-01401), which was issued on 8/1/14.
