I'm sorry that we haven't been able to catch up with each other directly, but I so appreciate your feedback via
voicemail. I discussed the situation with Cyndi Karoly, which she had discussed with Doug Huggett. Doug and Cyndi
recalled that timing of the 401 approval is slightly different when a project goes through the NEPA process. I'm not sure
whether it is any NEPA processor just when the USACE is the lead agency. I suspect that it maybe the latter. Cyndi said
that we can issue the 401 approval as long as at least the Draft EIS has been published and DWR has provided comments
on the project. Cyndi also said that we used to have a memo from Robin Smith that explained this difference, but she
doesn't have a copy of it. I'm in the office the rest of the week with just a few short meetings scheduled. If you would
like to discuss this further, please don't hesitate to give me a call.
