Atlas staff completed a stream and wetland delineation of the review area on November 02, 2021 to identify potential aquatic resources. One stream channel, Satulah Branch, identified as CH 100 and is within the review area for 213 linear feet. One wetland (WL 1000) was found to exist within the review area and is approximately 0.087 acres in size. The proposed project is for a private landowner for the construction of one residential home. The lot is located within a residential neighborhood with a home abutting the Eastern property line. One unavoidable impact to wetland WL 1000 is required for the grading and construction of the home. Wetland impact W1 is permanent fill to WL 1000 totaling approximately 23.3 cubic yards. The impact is being requested under a NWP 18 due to being located within the 1% annual flood hazard zone. The area and calculated fill is less than 0.1 acre and Tess than 25 cubic yards of fill. The discharge of fill on the engineered grading plan does not include the entirety of the wetland however impacts are proposed to the entire wetland due to the likleyhood of secondary impacts. The named perennial channel, Satulah Branch/CH 100, is being entirely avoided and the site plan shows a 30-foot setback from the channel. JURISDICTIONAL DETERMINATION (JD) TYPE (Select One) In I am requesting that the Corps provide a preliminary JD for the property identified herein. A Preliminary Jurisdictional Determination (PJD) provides an indication that there may be "waters of the United States" or "navigable waters of the United States"on a property. PJDs are sufficient as the basis for permit decisions. For the purposes of permitting, all waters and wetlands on the property will be treated as if they are jurisdictional "waters of the United States". PJDs cannot be appealed (33 C.F.R. 331.2); however, a PJD is "preliminary" in the sense that an approved JD can be requested at any time. PJDs do not expire.
