Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). This final permit contains the following significant changes from the draft you were sent on May 24, 2006: > A Total Phosphorus monthly average limit of 1,067 lbslday has been added to the permit, as required by 2002 Settlement agreement between CMUD, SC DHEC, and the Division. The combined 12-month rolling average limit for McAlpine Creek WWMF, Sugar Creek WWMF, and Irwin Creek WWMF is still required. > Monthly hardness monitoring is being required at instream stations IC1, MC2, SC4, LSC1, and LSC2 to coincide with existing copper and zinc monitoring requirements. > A daily maximum fecal coliform limit has been added to the permit to align with South Carolina standards. This limit will take effect in six months (February 1, 2007). (2) TOTAL PHOSPHORUS LIMIT As stipulated by the 2002 Settlement Agreement between Charlotte -Mecklenburg Utilities Department (CMUD), the South Carolina Department of Health and Environmental Control (SC DHEC) and the North Carolina Division of Water Quality (NC-DWQ), CMUD's McAlpine Creek WWMF, Sugar Creek WWTP and Irwin Creek WWTP must comply with a combined 12 month rolling average limit of 826.0 lbs/day as of February 28, 2006. This limit is defined as an effluent limit for total phosphorus from the total combined discharge from the three referenced CMUD wastewater treatment plants (based on a 12-month rolling average). The methodology for calculating the annual average is described in Part A. (3.). A. (3) TOTAL PHOSPHORUS MONITORING The Permittee shall calculate a 12-month rolling average mass loading as the sum of monthly Loadings, according to the following equations: (1) Monthly Average (lbs./day) = TP x Qw x 8.34 Where: TP = the arithmetic average of total phosphorus concentrations (mg/L) obtained via composite samples (either daily, weekly, or monthly average values) collected during the month Qw = the average daily waste flow (MGD) for the month 8.34= conversion factor, from (mg/L x MGD) to pounds The 12-month rolling average mass loading is defined as the sum of the monthly average loadings for the previous 12 months inclusive of the reporting month: 12 (2) 12-Month Mass Loading (pounds/day)= >TPma =12 (inclusive of reporting month) Where: TPma is defined as the total phosphorus monthly average mass loading (calculated above). The monthly average and 12-month average mass loadings shall be reported on the attached worksheet and submitted with the discharge monitoring report for McAlpine Creek WWMF. The first worksheet is due with the discharge monitoring report, 12 months from the effective date of the total phosphorus limit (referenced in Special Condition A. (2)). In the interim period between the effective date and the requirement to submit the attached worksheet, the total phosphorus monthly average mass loadings should be reported on the discharge monitoring report for the respective facility. The Permittee shall report the total phosphorus concentration for each sample on the appropriate discharge monitoring report for each facility. Reporting of and compliance with the phosphorus limit shall be done on a monthly basis. NPDES Permit Part I - Page 4 of 4 Permit NC0024970 A. (4) CHRONIC TOXICITY PASS/FAIL PERMIT LIMIT The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 90%. The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed during the months of March, June, September, and December. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent. discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. • All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Test data shall be complete, accurate, indude all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Section at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. (9) EFFLUENT POLLUTANT SCAN The permittee shall perform an annual Effluent Pollutant Scan for all parameters listed in the table below (in accordance with 40 CFR Part 136). Summary McAlpine Creek WWMF is one of the largest of the five Charlotte -Mecklenburg Utilities Department (CMUD) plants at a total design flow of 64 MGD. The facility serves 366,000 people and 23 SIUs in the City of Charlotte, Town of Mint Hill, Town of Matthews, Town of Pineville, unincorporated areas of Mecklenburg County, and the Six Mile Creek area of Union County. The McAlpine WWMF also treats overflow from the Irwin Creek WWTP and 1/3 of the industrial flow from the Sugar Creek WWTP (Sugar Creek treats flows from 12 SIUs). The facility is required to implement a full LTMP but voluntarily performs monthly monitoring rather than quarterly. NPDES Permit Fact Sheet — 05/23/06 CMUD-McAlpine Creek WWMF Page 2 NC0024970 The entire length of McAlpine Creek is listed on the draft 2006 303(d) list. The creek has overall impairments for turbidity and fecal coliform standards violations and an aquatic life impairment for impaired biological integrity. Potential sources are listed as urban runoff and storm sewers. A TMDL for fecal coliform has been developed for the Greater Sugar Creek Basin, which includes McAlpine Creek. CMUD samples the WWMF effluent daily and also samples the downstream site (MC2) weekly for fecal coliform. The sampling at MC2 for fecal is not an NPDES requirement, however, Charlotte Mecklenburg Utilities agreed to this sampling as part of an agreement with the Mecklenburg County Storm Water Services. Sampling throughout the basin is conducted by Storm Water Services. The McAlpine Creek WWMF is currently undergoing 4 major capital improvement projects. Phosphorus reduction project. This project resulted from a January 2002 settlement agreement between CMUD, DWQ, and SCDHEC that allows a total phosphorus discharge of 1 mg/L. Phosphorus reduction will involve the addition of magnesium hydroxide, ferric chloride, and polymer to the treatment process and the construction of anaerobic zones to the numerous aeration basins for biological phosphorus removal. Various other improvements will also be made to optimize capacity and performance at the plant. The project was scheduled for completion in February 2006. II. Consolidated influent pumping facility. The McAlpine Creek WWMF is comprised of a North and South plant with separate influent pump stations. In this project, a single pump station will be constructed to combine influent and side -stream flows. A new relief sewer will also be constructed to eliminate SSOs during wet weather. The relief sewer will give the plant the ability to treat wet weather flows of up to 109 MGD. This project is scheduled to be completed in March 2007. III. Primary treatment improvements. This project will involve additional improvement to ensure the plant is able to consistently meet the phosphorus limit. It includes construction and rehabilitation of primary clarifiers and a primary sludge pumping station, amongst other improvements. This project is scheduled for completion in February 2007. IV. Standby generator facilities. Two generator buildings will be constructed and equipped with three 2700 kVA generators and space for one additional generator. These generators will provide standby power for the entire plant (rather than only critical systems). The project was scheduled for completion in December 2005. Phosphorus The CMUD plants have a collective phosphorus limit with a compliance date that was previously determined as follows: If CMUD conducts construction activities associated with phosphorus removal at either the Sugar Creek WWTP or the Irwin Creek WWTP, the annual average limit of 826.0 lbs/day (based on the collective discharge from all three plants) shall become effective February 28, 2007. Said construction activities will also trigger an effluent limit for total phosphorus for the McAlpine Creek WWTP of 534.0 lbs/day (based on a 12-month rolling average) as of February 28, 2006 (as stipulated in Part. A. (2.) of NPDES Permit NC0024970). If however, CMLID decides not to pursue construction activities, associated with phosphorus removal, at either the Sugar Creek WWTP or the Irwin Creek NPDES Permit Fact Sheet - 05/23/06 CMUD-McAlpine Creek WWMF Page 3 WWTP, the total phosphorus annual average limit applicable to the loading from all three WWTPs, shall become effective on February 28, 2006. NC0024970 Since CMUD is not constructing phosphorus removal at the Irwin and Sugar Creek plants, the language will be modified to state that the limit is in effect as of the effective date of this permit. Compliance Summary DMR Data Review Monthly average DMR data was reviewed for the period of January 2003- December 2005. A summary is provided in Table 1. During this time period the facility experienced average monthly flows at 76% capacity and maximum monthly average flows at 99% capacity. CMUD has already submitted a scoping document and a request for speculative limits to the Division for proposed future flows of 144 MGD for the three CMUD plants combined. It appears that this monitoring was historically required because of the poor water quality. The Sugar Creek watershed (comprised of Irwin Creek, Little Sugar Creek, McAlpine Creek, and Sugar Creek) collectively drains the metropolitan center of Charlotte. These streams originate in Charlotte but continue into South Carolina. These monitoring requirements will not be modified during this permit renewal. Instream DMR data was reviewed for the period of January 2004-January 2006. Downstream temperature levels appear to be slightly elevated in the winter, but similar to upstream values in the summer. Similarly, downstream D.O. levels are slightly depressed in the winter, but comparable to upstream values in the summer. The lowest observed DO was 5.4 mg/L. Downstream conductivity was consistently elevated with an average of 211 umhos/cm upstream versus 367 umhos/cm downstream. pH levels appear similar both upstream and down. Additional instream data is summarized in Table 2. The limit and monitoring requirements will be removed from the permit. Values of chromium, lead, and mercury did not show reasonable potential to exceed applicable water quality standards. The limits and monitoring requirements for these parameters will be removed from the permit however they should continue to be monitored through the facility's LTMP. Out of 199 samples of cyanide taken, there were only eight reported detections. All 'detections' were at or below 5 pg/L and the last was reported in August 2004. Since the practical quantitation level for this pollutant is 10 pg/L, these eight results were also automatically interpreted by the RPA method as <10 pg/L. Therefore all 199 samples were interpreted as <10 ig/L. With no variance, this dataset yields a multiplication factor of 1 and a "maximum predicted" of 5 pg/L (1 detection limit). Although the chronic allowable is also 5 pg/L, it would appear that in this case there are no grounds for interpreting that cyanide is a parameter of concern. The limit and monitoring requirement will be removed from this permit. This parameter should continue to be monitored through the LTMP. Monitoring was required for molybdenum and silver in the previous permit, however data from the past permit cycle showed no reasonable potential for levels of these parameters to exceed water quality standards. Therefore monitoring will be removed from this permit. Calculated allowable limits for copper and zinc were developed for the McAlpine Creek WWTP based on a methodology already used at the Irwin and Sugar Creek plants. All equations and parameters are from SC DHEC Water Classifications and Standards and EPA's "The metals Translator: Guidance for Calculating a Total Recoverable Permit limit from a dissolved Criterion". Calculations are attached to the RPA documentation for this fact sheet. Based on the calculated allowable copper and zinc effluent limits, monitoring for both parameters will be removed from the permit due to lack of reasonable potential to cause an exceedance of applicable water quality standards. These pollutants will continue to be monitored through the facility's pretreatment program. Arsenic, cadmium, and nickel are currently monitored through the LTMP. There was no reasonable potential for levels of these parameters to cause an exceedance of water quality standards. Selenium is also required to be sampled through the facility's LTMP. Although there were only 4 detections out of 114 samples, all four samples were above the allowable concentration. CMUD reports that they sample both the influent and effluent for 10 metals each week. When selenium was first detected in their effluent in April 2005, they were able to determine that three S1Us were discharging selenium at elevated levels. The pretreatment permits for all facilities were reopened and selenium limits were added. The issue was resolved in 4 weeks and no selenium has been detected in the influent or effluent since May 10, 2005. A chronic selenium limit of 5 }ig/L will be placed in the permit, however the facility will be notified that they may petition to have the limit NPDES Permit Fact Sheet — 05/23/06 CMUD-McAlpine Creek WWMF Page 5 NC0024970 removed if 12 months of data show there is no reasonable potential for an exceedance of WQ standards. WET Test Results The McAlpine Creek WWMF has a chronic WET limit at 90% effluent toxicity. The facility has passed 19/20 tests administered since March 2002. The single failure was in December 2004 and the facility passed the following two consecutive tests. Correspondence File Review/Compliance History From January 2002- February 2006 there was only one limit violation (with the exception of the single WET failure). The monthly average CBOD limit of 4 mg/L was exceeded in July 2005 (reported value of 4.42 mg/L). The facility appears to be very well operated and maintained. BUILDING A SPREADSHEET MODEL A s discussed in earlier chapters, a series of steps must be taken to implement the dissolved metals policy, including converting the water quality criteria from the total recoverable to the dissolved form, translation from the dissolved CCC or CMC to the total recoverable metal concentration in the discharger's waste stream, calculating the WLA or TMDL, and developing the permit limit. These steps or calculations are easily handled using a simple spreadsheet model. Use of these equations, whether in a spreadsheet or not, can avoid many common mistakes. The following equations may be used to translate dissolved criteria to total recoverable permit limits with translators developed through studies such as those described in Chapter 5. This model may be used as a static model with design flow conditions, it may be used in a continuous mode (i.e.., using daily flow and other data), or it may be used (with programs such as @RISK or Crystal Ball) to perform Monte Carlo analyses. These calculations do not provide concentration estimates between the point of discharge and the point of complete mixing. Construction activities have been conducted, however CMUD decided that the best way to meet the limit on all three plants was to make the upgrades at McAlpine. I also want to point out that the 534 #/day limit never actually took effect. The mod schedules the limit to take effect on 2/28/06, however the special condition states that if CMUD does construction at Sugar Creek or Irwin then the combined limit (826 #/day) would take effect 2/28/07. Those construction activities would then trigger the individual TP limit for McAlpine (534 #/day). However, if CMUD did not perform (and they did not) construction at Sugar Creek or Irwin, then the combined limit would take effect on 2/28/06. So, as things turned out, McAlpine was actually never subject to the individual 12- month average limit. I called CMUD to discuss their interpretation of the permit and their recollection of the settlement agreement. We looked over the agreement and it reiterates the above (in clearer wording, believe it or not) but also states "Whether or not the City conducts construction activities at either the Sugar Creek plant or the Irwin Creek plant... an effluent limitation of 1,067 lbs/day averaged on a monthly basis shall also apply to the McAlpine Creek Plant commencing on February 28, 2006." The agreement then goes on to state that Sugar Creek would receive a specific numerical monthly average limit if CMUD did construction there, and the same thing for Irwin. So there were monthly average limits set up for each plant if CMUD constructed phosphorus removal at any of them. Monthly average limits, but not 12-month average limit. So based on the agreement, McAlpine Creek should receive a monthly average limit of 1,067 lbs/day and all three plants should receive a combined 12- month average limit of 826 lbs/day. I'll add in the monthly average limit. But they should not get a 534 #/day 12-month average limit. 2,3,4,6a) ok. 5) Looks like this was part of the discussion back when they made the mod. It was done specifically so that the facility could choose. I don't know that it would make a difference at the compliance end because we're talking about monthly and 12-month rolling averages, but the facility requested some flexibility in case there are anomalies. 6b) I'm not sure. I'll ask the facility if there is any history for that. I know they are voluntarily monitoring hardness because they supplied data for the copper/zinc limit calculation.
