Box 1587 Greenville, NC 27835 Subject: The replacement of Bridge No. 150 over Fork Swamp on SR 1530 in Beaufort County;.State Project No. 17BP.2.R.54; DWR project number 20140846 Dear Mr. Johnson: The Division of Water Resources has reviewed your submittal for a 401 Water Quality Certification for the aforementioned project. Review of your application revealed it lacking necessary information required for making an informed permit decision. The permit application was deficient in the following areas: Ditches through buffers. The proposed plans show a 2:1 ditch being cut through the buffer in the NW quadrant from —L- STA. 10 +65 to STA. 12 +86 RT. 15A NCAC 2B .0259(6) requires that new ditches through buffers provide a storrmwater management facility to control for nitrogen and attenuate flow before the conveyance discharges through the buffer. For linear transportation projects, this can be accomplished with grass swales at a ratio of 100 linear feet of swale per acre of drainage. The swales must have a minimum of 3:1 slopes, or flatter, front and back. A prior response indicated that creating 3:1 swales would require additional easements. It is noted that a 3:1 swale is being cut on the opposite side of the road and staying within the existing right of way. Please provide additional information explaining whether or not it is possible to provide some length of 3:1 swale for the area in question. Therefore, pursuant to 15A NCAC 2H .0507(a)(5), we will have to place the permit application on hold until we are supplied the necessary information. You have 21 days to respond in writing with the requested information or notification to this office that the information is forthcoming. If, at the end of the 21 days, this office has not received this information in writing, we will assume you are withdrawing your application and it will be returned. Furthermore, until the information is received by the NC Division of Water Resources, we request (by copy of this letter) that the US Army Corps of Engineers place the permit application on hold.
