Skvarla, III Governor Secretary September 22, 2014 CERTIFIED MAIL - RETURN RECEIPT REQUESTED 70133020000076320321 Mr. Clay Willis NCDOT, Division One 1 ] 3 Airport Drive, Suite 100 Edenton,,NC 27932 Subject: The replacement of Bridge No. 16 over a canal on US 264 in Dare County; State Project No. 1713P.1.R.50; DWR project number 20140847 Dear Mr. Willis: The Division of Water Resources has reviewed your submittal for a 401 Water Quality Certification for the aforementioned project. Review of your application revealed it lacking necessary information required for making an informed permit decision. The permit application was deficient in the following areas: Stormwater Discharge. The proposed plans show the bridge storrmwater being discharged into a canal on the west side of the road which would provide little or no opportunity for treatment. Condition # 11 of Water Quality Certification No. 3883 requires treatment of bridge storrmwater prior to entering the stream. This is especially critical for waters classified as HQW. The east side of the road has a wetland area that would provide better treatment of the bridge storrmwater runoff. DWR requests moving the discharge point to the wetland area on the east side of the road. Please explain whether or not this is possible. Therefore, pursuant to 15A NCAC 2H .0507(a)(5), we will have to place the permit application on hold until we are supplied the necessary information. You have 21 days to respond in writing with the requested information or notification to this office that the information is forthcoming. If, at the end of the 21 days, this office has not received this information in writing, we will assume you are withdrawing your application and it will be returned. Furthermore, until the information is received by the NC Division of Water Resources, we request (by copy of this letter) that the US Army Corps of Engineers place the permit application on hold.
