Klimek, P.E., Director Division of Water Quality October 18, 2004 Subject: NPDES Permit Minor Modification Permit No. NC0024970 CMU-McAlpine Creek WWTP Mecklenburg County In accordance with your request for modification of the downstream monitoring site on Little Sugar Creek (Station ID LSC3), the Division has evaluated the information submitted and has changed the sampling site from Route 521 to Highway 51, approximately 0.6 miles upstream. Accordingly, we are forwarding herewith the modification to the subject permit. Please find enclosed the amended permit pages, which should be inserted into the McAlpine Creek WWTP permit, as well as the existing permits for the Sugar Creek (NC0024937) and Irwin Creek (NC0024945) WWTPs. The old pages should be discarded. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such a demand is made, this permit shall be final and binding. Please take notice that this permit is not transferable. Part II, E.4. addresses the requirements to be followed in case of change in ownership or control of this discharge. N. C.
