Klimek, P.E., Director Division of Water Quality July 15, 2003 Ms. Julie McLelland Charlotte -Mecklenburg Utilities 5100 Brookshire Boulevard Charlotte, North Carolina 28216 UV Disinfection System Subject: Authorization to Construct Permits ATC Nos. 024937A01 and 024945A01 Sugar Creek and Irwin Creek WWTPs Mecklenburg County Dear Ms. McLelland: The Division of Water Quality's NPDES Unit has reviewed the Charlotte -Mecklenburg Utilities' request for Authorization to Construct permits for improvements at the Sugar Creek and Irwin Creek WWTPs. We have also reviewed additional information provided by Camp Dresser & McKee on the Utilities' behalf. The Division finds the proposed improvements and design to be satisfactory and hereby grants authorization for the following: Sugar Creek WWTP (ATC No. 024937A01) • construction of a 40 MGD (peak flow) open channel, low-pressure ultraviolet (UV) disinfection system; • construction of a sodium hypochlorite disinfection system for on -site water reuse; • decommissioning of the existing gaseous chlorine disinfection system; and • construction or installation of all related structures, equipment, piping, controls, and other appurtenances, as presented in the proposed plans and specifications. Irwin Creek WWTP (ATC No. 024945A01) • construction of a 30 MGD (peak flow) open channel, low-pressure ultraviolet (UV) disinfection system; • decommissioning of the existing gaseous chlorine disinfection system; • installation of a trailer -mounted 300 KW diesel -powered generator and standby power system; and • construction or installation of all related structures, equipment, piping, controls, and other appurtenances, as presented in the proposed plans and specifications. These Authorization to Construct permits are issued in accordance with Part III, Paragraph A of NPDES Permit Nos. NC0024937 and NC0024945, both issued October 4,1996, and shall be subject to revocation unless the wastewater treatment facilities are constructed in accordance with the conditions and limitations specified in the applicable NPDES and ATC permits. Special Provisions These Authorization to Construct permits are conditioned upon compliance with the following: • The UV system bypass valve at each facility will be removed and the adjacent tees plugged after acceptance of the UV system and decommissioning of the chlorine disinfection systems. Removal of the bypasses will be verified in the Engineer's Certification for each project. • Both facilities are hydraulically limited; at present, peak flows cannot exceed 40 MGD at the Sugar Creek WWTP and 30 MGD at the Irwin Creek WWTP. If actual daily flows exceed these values or if Charlotte -Mecklenburg Utilities proposes to remove bottlenecking in one or both facilities, the design of the UV systems must be re-evaluated and, if necessary, modified to accommodate the increased peak flows. • The trailer -mounted generator at the Irwin Creek WWTP will be dedicated to the new UV system until it is replaced by a permanent unit as part of a plant -wide generator system upgrade. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement wastewater treatment or disposal facilities. Notification Requirements The Permittee shall notify the Mooresville Regional Office, telephone number (704) 663-1699, at least forty-eight (48) hours in advance of operation of the installed facilities, so that an in -place inspection can be made. Such notification to the regional supervisor shall be made during the normal office hours of 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. Engineering Certification Upon completion of construction and prior to operation of each modified facility, the Permittee shall provide the Division with a certification from a professional engineer registered in North Carolina certifying that the permitted facility has been installed in accordance with the NPDES Permit, this Authorization to Construct, and the approved plans and specifications. The certification should be mailed to the NPDES Unit, 1617 Mail Service Center, Raleigh, North Carolina 27699-1617. ORC Requirements The Permittee must continue to employ a certified wastewater treatment plant operator in responsible charge (ORC) of the wastewater treatment facilities. The operator must hold a certificate of the type and grade at least equivalent to or greater than the classification assigned to the wastewater treatment facilities by the Certification Commission. The Permittee must also employ a certified back-up operator of the appropriate type and grade to comply with the conditions of Title 15A, Chapter 8G, .0200. The ORC of the facility must visit each Class I facility at least weekly and each Class II, III, and IV facility at least daily, excluding weekends and holidays; and must properly manage and document daily operation and maintenance of the facility and comply with all other conditions of Title 15A, Chapter 8G, .0200. v ATC No. 024937A01 and 024945A01 Sugar Creek and Irwin Creek WWTPs Additional Conditions The Operational Agreement between the Permittee and the Environmental Management Commission is incorporated herein by reference and is a condition of these ATC permits. Noncompliance with the terms of the Operational Agreement shall subject the Permittee to all sanctions provided by G. S. 143-215.6 for violation of or failure to act in accordance with the terms and conditions of this Permit. Failure to abide by the requirements contained in these Authorization to Construct permits may subject the Permittee to an enforcement action by the Division of Water Quality in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. The issuance of these Authorization to Construct permits does not relieve the Permittee from its responsibility to comply with any and all statutes, rules, regulations, or ordinances that may be imposed by other government agencies (local, state, and federal) which have jurisdiction. The Permittee shall maintain a copy of the approved plans and specifications on file for the life of the facilities.
