The remaining 5 percent can be is comprised of'utility easement and characterized as maintained land (see attached Figure 3.1 Existing Conditions and Figure 3.2 Existing Conditions w /aerial). Land use within the vicinity of the subject property is residential, commercial, and forested areas. On April 21, 2014, McAdams Company conducted a jurisdictional wetland delineation and a Neuse River Buffer determination at the subject property defining the limits of waters of the U.S. and determining jurisdictional features subject to the Neuse River Buffer rules. On May 22, 2014, the° USACE (Raleigh Field Office — Mr. David Schaeffer, Action IDt SAW- 2014 - 00866) agreed with the$delineation and field confirmed the wetland delineation. On May 9, 2014 the North Carolina Department of Water Resources (DWR — Mr. Sara Knies, NBRRO # 14 -145). Subsequently, McAdams Company surveyed the features and the surveyed features are located on the attached Figures 3.1 and 3.2. PROPOSED PROJECT: The purpose of the project is to provide housing to the northwest section of Wake County,,_ North 'Carolina. The proposed development will consist of approximately 100 residential townhome units and the associated infrastructure, including roads, utilities, city sewer; and stormwater management facilities. There are proposed stream and buffer impacts associated with two road crossings and two greenway trail crossings. No impacts to wetlands are proposed. The plan incorporates stormwater management techniques to manage both water quantity and quality aspects of site runoff. Stormwater management for the Creeks at Weston will be accomplished by incorporating engineered , stormwater best, management practice facilities to capture and treat the stormwater- runoff from developed areas. One (1) stormwater pond and one (1) constructed wetland are proposed. Other stormwater treatment devices that will be used are level spreaders in conjunction with vegetated filter strips, which are designed to remove a minimum of 40% average annual total suspended solids (TSS), and provide 30% total nitrogen and 35% total phosphorus' removal. The stormwater pond and wetland will serve the dual purpose ,of water quality and water quantity, (i.e. detention) control. Since the Town of Cary 'is ,a delegated authority for NCDWR Stormwater Management Plans, the,review and approval of the S WMP is part of the Town of Cary review process. The proposed development will be subject to, the stormwater management requirements set forth in the Town of Cary Land Development Ordinance (LDO). AVOIDANCE & MINIMIZATION: Impacts to jurisdictional streams and wetlands have been avoided and minimized to the maximum extent practicable; however, due to required infrastructure improvements, there are proposed impacts to streams and buffers. Impacts to jurisdictional wetlands have been avoided entirely. Stream and buffer impacts will result from two road crossings, while only buffer impacts will result from two greenway trail crossings. To access the subject property from Weston Parkway, a road crossing perennial Stream Feature C -is proposed (see attached Inset` 1; I_mpact,Area 1). Alternative road entrances were examined to access the subject property; however, these alternatives would impact both Stream Feature D and Stream Feature C. Therefore, it was determined Stream Feature D would'be avoided. To minimize impacts to Stream Feature C. the road will cross ,the stream near perpendicular and reduction efforts in the road crossing width were made. To access the extreme southeastern section of the subject property, a road crossing Stream Feature B is proposed (see attached Inset 2; Impact Area 3). To minimize impacts to Stream Feature B, crossing at the narrowest point of the stream and nearly perpendicular is proposed. Reduction efforts in the road crossing width were also made to further minimize impacts to Stream Feature B. Of the 239 if of permanent stream impact, 34 if will be associated with a rip -rap dissipator pads which will be installed flush with the existing grade of the stream beds to allow for aquatic life passage. Therefore, 34 if of the permanent stream impacts will not require mitigation. Proper sedimentation and erosion control methods will be utilized 'during construction and installation of the road crossings. All work will take place during dry conditions and can be facilitated from high, non- jurisdictional, stable ground. As such, a temporary diversion channel and temporary coffer dam will be utilized to construct the two road crossings so that work within the stream features can be performed in dry conditions (see attached Insets 1 and 2; Plan and Profile views). Greenway trail crossings of Stream Feature A (see attached Inset 3; Impact Area 4) and Stream Feature C ,(see attached Inset 1; Impact Area 2) will expand recreational opportunities for Cary residents. These - greenway crossings will intersect Stream Features A and C nearly perpendicular and will bridge the stream features; consequently avoiding impacts to the streams. The proposed greenway trail crossings will result in impacts to Zone 1 and Zone 2 of the Neuse River- Buffers. COMPENSATORY MITIGATION REQUIREMENTS: Of the total 23'9 if of permanent' stream impact; 34 If will be associated with a rip -rap dissipator pads which will be installed flush with the existing grade of the stream beds to allow for aquatic life passage., Therefore, 34 if of the permanent stream impacts will not require mitigation and the total permanent stream impact requiring mitigation is 205 If. At a 2 to 1 ratio, total stream mitigation units required for compensatory mitigation is 410 SMUs. The attached August 8, 2014 demonstrates that 41,0 SMUs have been reserved by Restoration Systems, LLC at the Pancho Stream and Wetland Mitigation Bank for the Creeks at Weston project (at the time the letter was drafted,,the project was called Weston Townhomes). The proposed Neuse River Buffer impacts associated with both greenway trails (see Table 6 above, Buffer Impact Numbers 2 and 4) are allowable uses and compensatory mitigation is not required. The proposed Neuse River Buffer impact associated with the road crossing Stream Feature C (see Table 6 above, Buffer Impact Number _ 1) 'is 0.25 acres in size and a maximum width of 145 linear feet, which is less, than a total 0.333 acres in size and a maximum width of 150 linear feet. The proposed Neuse River Buffer impact associated with the road crossing Stream Feature B (see Table 6 above, Buffer Impact Number 3) is MIH -14000 Mrs. Cherrie Smith Creeks at Weston September IS, 2014 Page 6 of 7 0.29 acres in size and a maximum width of 145 linear feet, which is less than a total 0.333 ,acres in size and a maximum width of 150 linear feet. At this time, the applicant proposes avoiding and minimizing impacts to riparian buffers and does not propose compensatory mitigation; however, if compensatory buffer mitigation is required, the applicant would propose payment for mitigation bank credits. SUMMARY: The proposed Creeks at Weston will consist of approximately 100 residential townhome units and the associated infrastructure, including roads, utilities, city sewer, and stormwater management facili'ties'. There are proposed stream and buffer impacts associated with two road crossings and two greenway trail crossings. No impacts to wetlands are proposed. To access the subject property from Weston Parkway, a road crossing perennial Stream Feature C is proposed. Alternative road entrances were examined to access the subject property; however, these alternatives would impact both Stream Feature D and Stream Feature C. Therefore, it was determined Stream Feature D would be avoided. The proposed project is a single and complete project and confined within the property boundary,. Appropriate land use control measures will be in place for areas which will require them. Additional impacts to streams, wetlands, and Neuse River Buffers located on the property are not proposed. Of the total 239 if of permanent stream impact; 34 if will be associated with a rip -rap dissipator pads which will be installed flush with the existing grade of the stream beds to allow for aquatic life passage. Therefore, 34 if of the permanent stream impacts will not require mitigation and the total permanent stream impact requiring mitigation is 205 1£ At a 2 to 1 ratio, total stream mitigation units required for compensatory mitigation is 410 SMUs. The proposed Neuse River Buffer impacts associated with both greenway trails are allowable uses and compensatory mitigation is not required., The proposed Neuse River Buffer impact associated with the road crossing Stream Feature C' is 0.25 acres in size and a maximum width of 145 linear feet, which is less than a total 0.333 acres in size and a maximum width of 150 linear feet. The proposed Neuse River Buffer impact associated with the road crossing Stream Feature B 'is 0.29 acres in size and a maximum width of 145 linear feet, which is less than a total 0.333 acres in size and a maximum width of 150 linear feet. At this time, the applicant proposes avoiding and minimizing impacts to riparian buffers and does not propose compensatory mitigation; however, if compensatory buffer mitigation is required, the applicant would propose payment for mitigation bank credits. At this time, we are requesting approval that the proposed construction activities associated with the Creeks at Weston project are authorized under 401 Water Quality General Certification 3890, and the Neuse River Buffer Protection Rules.
