Refuel America, Inc. — Refuel Terminal Operations - Charlotte
NPDES Permit Number N00046531

Dear Mr. Bryan:
The Division of Water Quality is aware that Refuel America, Inc. recently purchased the subject facility
and had the NPDES permit issued in its name. Information provided by Refuel America, Inc.'s
representatives, as found in our files, stated the company planned to test the equipment at the site to
ensure all was in working order, and that no fuel would be shipped into the site until this was completed.
While the NPDES permit requires routine monitoring to be conducted on regulated discharges and
monthly reports be submitted documenting the results of monitoring, these requirements have been
suspended until the facility exhibits potential to actually discharge treated wastewater (in this case
treated stormwater from a petroleum bulk storage facility).
Because some time has passed since the permit was issued in Refuel America, Inc.'s name, and because
only one discharge monitoring report has been submitted to the Division from the facility (results of
hydrostatic tank testing discharge from January 2007), at this time the Division requests that you provide
it with a status report with regard to the current state of operations at the facility. If the facility is not
currently operational (is not receiving/distributing product to or from its tanks), please provide us with
an estimate as to when this will occur and when you will begin to submit discharge monitoring reports.
This report does not need to be detailed; it simply needs to be a brief and accurate description of
operations as they apply to your requirements as a NPDES permittee.
