Good afternoon,
On behalf of our client, the City of Greensboro, Kimley-Horn is submitting this NCDWR 401 Water Quality Certification
Pre-Filing Notification for the Greensboro Downtown Greenway Phase 4 and College Branch Stream Enhancement
project located in Greensboro, Guilford County, North Carolina. Kimley-Horn is requesting a reauthorization of the
previously approved Section 404 Nationwide Permit (SAW-2017-01430), Section 401 Water Quality Certification, and
Jordan Lake Watershed Riparian Buffer Authorization (NCDWR #20180957) for the above referenced project in Guilford
County. The project was originally permitted in July 2018 under a NWP 3, NWP 14, and NWP 27 and corresponding WQC
4132, 4134, and 4135. An approved 404 permit was issued by Mr. David Bailey of the USACE on August 6, 2018. An
approved 401 permit was issued by Ms. Sue Homewood of NCDWR on August 27, 2018. An additional modification was
th
submitted on December 17, 2021, with approvals received for the 404 permit modification on January 13, 2022 by
James Lastinger and the 401 permit modification on February 15, 2022 by Sue Homewood. Nodesign changes have been
made since the 2022 modification approvals.
The proposed project is anticipated to result in unavoidable impacts to stream resources and riparian buffers, however,
impacts have been minimized to the greatest extent practicable. It is assumed that these impacts would qualify for
authorization under Nationwide Permit (NWP) 3 for Maintenance Projects, NWP 14 for Linear Transportation Projects,
and NWP 27 for Aquatic Habitat Restoration, Enhancement, and Establishment Activities and the corresponding WQC
4132, 4134, and 4135.
