(Pilot) was provided with a Notice of Continuing Violation (NOV) letter that was issued to Desco Mebane Partners by the North Carolina Department of Environmental Quality -Division of Water Resources (NCDEQ-DWR), dated August 3, 2022. The letter indicates on April 12, 2022, the NCDEQ-DWR issued a 401 Water Quality Certification and Jordan Lake Riparian Buffer Authorization (DWR#202000024) for impacts at the site and as a condition the applicant shall comply with the Buffer Restoration Plan Approval. The purpose of this correspondence is to provide the requested responses to the NCDEQ-DWR. On behalf of Desco Mebane Partners, Pilot has prepared this correspondence to provide information requested in the August 3, 2022 NCDEQ-DWR Notice of Continuing Violation. The August 3, 2022 Notice of Continuing Violation requires responses to the following: 1) provide an explanation of why the buffer restoration plan was not initiated by February 28, 2021; and 2) provide a new proposed schedule for buffer replanting. At the time of NCDEQ-DWR acceptance of the Riparian Buffer Restoration Plan, it was anticipated that final grading of up -gradient pads and removal of a temporary sediment and erosion control device within the streams surface water riparian buffer would be completed within the following 6 months. However, multiple delays occurred due to weather and various other site conditions that delayed the final grading and stabilization within the restoration area until August 2021. The applicant contracted with a planting contractor in September of 2021. This contractor delayed planting until May 2021 upon which time the applicant terminated the contractor and hired a another contractor. The replacement contractor completed the specified planting in the restoration area the week of August 17 to 24, 2022. Pilot conducted a field visit of the restoration area on August 31, 2022. The plantings consisted of at least six different native tree and shrub species. Plant container sizes of 5, 7 and 15 gallon containers were utilized.
