We received your application for an NPDES No Exposure Certification on July 26, 2022. It was
concluded that the site's primary operations do not qualify for exclusion under a No Exposure
Certification. Additionally, this site is currently covered under Individual Permit NCS000299 which
is also owned by Legacy Feeds, not Kalmbach Feeds.
With this letter, your application is being returned to you. Please be advised that if the State
determines that discharges from this site contribute to a water quality standard violation or are a
significant contributor of pollutants to waters of the U.S., the Department of Environmental Quality
(DEQ) is authorized to require a discharge permit.
If operations at our facility change such as that an NPDES stormwater discharge permit is required,
then you must submit an application and receive permit coverage prior to any discharge. The
return of this application does not affect the legal requirements to obtain other permits which may
be required by the Division of Energy, Mineral, and Land Resources, or permits required by the
Division of Water Resources, Coastal Area Management Act, or any other federal or local
government permit or approval that may be required.
