feature, which includes an Ordinary High Water Mark (OHWM), shelving, pebble sorting, bench
cuts, etc.
Your work as proposed does not require Department of the Army authorization for the following
reason(s):

On December 29, 2015, Anthony Scarbraugh at the request of your consultant Mr. Byron Bateman of
Bateman Environmental conducted on -site determination to review unnamed tributary (UT) to Howell
Branch located on the subject property for applicability to the Neuse Buffer Rules (15A NCAC 2B .0233).
The feature is labeled as "15-1243" on the attached map(s) initialed by Mr. Scarbraugh on December 31,
2015. The project is located at the southeast intersection of County Day Road and Patetown Road in
Goldsboro, Wayne County, NC.
At your request, Mr. Scarbraugh conducted on -site determination as stated above. During his review, he

The purpose of this letter is to inform you of the findings of site visits to your property in Goldsboro, NC
by representatives of the NC Division of Water Resources (DWR) and the US Army Corps of Engineers
(USACE). Mr. Gary Beecher with USACE conducted a site visit Tuesday December 15, 2015 and Mr.
Anthony Scarbraugh (DWR) conducted a separate site visit on Tuesday December 29, 2015. The purpose
of both visits was to evaluate the jurisdictional status of a drainage feature that flows across your
property. Both agencies concluded that this feature is not a jurisdictional (regulated) stream and DWR
does not consider it to be subject to the Riparian Buffer Rules. Please see the enclosed email from Mr.
Beecher and the DWR report that accompany this letter.

Dear Mr. Satterfield,
The purpose of this letter is to inform you of the findings of site visits to your property in Goldsboro, NC
by representatives of the NC Division of Water Resources (DWR) and the US Army Corps of Engineers
(USACE). Mr. Gary Beecher with USACE conducted a site visit Tuesday December 15, 2015 and Mr.
Anthony Scarbraugh (DWR) conducted a separate site visit on Tuesday December 29, 2015. The purpose
of both visits was to evaluate the jurisdictional status of a drainage feature that flows across your
property. Both agencies concluded that this feature is not a jurisdictional (regulated) stream and DWR
does not consider it to be subject to the Riparian Buffer Rules. Please see the enclosed email from Mr.
Beecher and the DWR report that accompany this letter.
