Please find following responses to the items in your request for more information from your email on 8/29/2022.
1. Attached is an updated impact table that calculates the disturbed areas based on a normal pool elevation of
995.1 AMSL (full pool elevation for Lake Rhodhiss). The calculated impact area below the normal pool elevation
is 493 sf. The impact area above the normal pool and 50’ landward is 7092 sf.
2. The bottom elevation of our abutment will be at elevation 992.4 AMSL (991.85 NAVD 88). The bottom elevation
is within the range of possible elevations for the lake based on Duke Energy’s posted statement for spillway
work. The concrete abutment will be poured within a metal formwork. The bottom of the formwork will be
sealed by backfilling against the form with dirt after installation and prior to pouring of concrete. The abutment
installation will take place at a time when the lake elevation is near the normal pool elevation of 992.1 AMSL
and rain is not forecasted. NCWRC staff will coordinate with Duke Energy officials prior to beginning abutment
work to verify that they do not plan to restrict flows and raise the lake elevation during the time the abutment
will be poured and cured. We had originally hoped to begin construction of this project in December
2022. However, Duke Energy representatives recently informed us that they and FERC will likely not have
completed their approvals by then. Construction will not begin until all permits and approvals have been
obtained. It will likely be in the first quarter of 2023 before any work can begin on the project.

Stabilization Application Form.

Dear Mr. Bailey:
On August 01, 2022, the Division of Water Resources (Division) received your application requesting a 401 Water Quality
Certification from the Division for the subject project. The Division has determined that your application is incomplete
and cannot be processed. The application is on‐hold until all of the following information is received:
1. Your application proposed 5,280 square feet of impact “above the normal pool lake level” of Lake Rhodhiss.
Plans received with your application indicate “Target Water Elevation” at 991.55 and “Full Pond Elevation”
at 994.55. Duke Energy reports “Full Pond Elevation” at 995.1 and “Target Elevation” at 992.1 AMSL (NGVD
29 datum). As your plans propose impacts below the full pond elevation of Lake Rhodhiss, such impacts shall
be considered as “below the normal pool lake level”. Please provide an updated impacts table that calculate
all impacts below full pond elevation 995.1 as “below the normal pool lake level” and all impacts above
995.1 as “above the normal pool lake level.” [15A NCAC 02H .0502(a)/15A NCAC 02H .0502(c)]
2. Duke Energy reports that lake levels will range from 992.1 to 996.1 due to spillway maintenance between
August 3, 2022 and the first quarter of 2023. Your project proposed a concrete abutment below elevation
994. Please provide a description of measures proposed to ensure uncured concrete does not come in
contact with surface waters. [15A NCAC 02H .0502(a)/15A NCAC 02H .0502(c)]
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the
proper consideration of the application. Please respond in writing within 30 calendar days. If all of the requested
information is not received within 30 calendar days of receipt of this letter, the Division will be unable to approve the
application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division
for approval, including a complete application package and the appropriate fee. Please be aware that you have no
authorization under the Section 401 of the Clean Water Act for this activity and any work done within waters of the
state may be a violation of North Carolina General Statutes and Administrative Code.
