This letter is in response to the Notice of Violation and Intent to Assess Civil Penalty dated July
27, 2022 issued to the Ashley Hills WWTP located in Wake County.
The NPDES permit's daily maximum limit for BOD was exceeded on May 17, 2022 due to
irregular air distribution within the aeration basins. This facility utilizes a common air header to
supply three aeration basins, making it difficult to regulate dissolved oxygen in each individual
unit, particularly during times of extreme temperature swings. Improvements to the air supply
system are being evaluated and operations closely monitors DO levels and adjusts, as necessary.
This exceedance was addressed quickly, and the facility remained compliant for the remainder
of the month.
