Avery Patrick requested a letter of concurrence from the North Carolina Wildlife Resources Commission
(Coxrami.ssian) fora 404 Petxnit from the X7.S. Army Corps of Engit-cers (ACOE). Y 'visited the project
area cm'August 21, 2007. Comments from t11C COn1y1]ISSiar1 8rC providec9 tinder provlstOrlS of the Clean
Water Act of 1977 {~3 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act {48 Scat. 41)1, as
amended; I61-7`.S.C.661-6674).
The project involves placing a ~0-foot culvert in a tributary to Richland Creek near Waynesvilie for
property access-
The stream is probably taa small for fish. Richland Creek downstream of the property supports wild
trout. 'Ttterefaxe, efforts to reduce eaCasian &am the culvert work, such as rapid rnatttir-g and seeding of
exposed soils on the stream banks, are recotiunended-
Tf the project is permitted, then the Commission eaa concur if:
1. The Nationwide and Final Regiattal conditions are adhered to. This includes avoiding stream disturbance
from October 1 S to April 15 as specified in 1.2 of the >~inal 12egianal Conditions.
Z. Sediment and erosion control measures are used and maintained. Exposed soils along the stream arc
rnattcd and seeded as soon as possible.
