Note: Didn't have map out when talking to Mr. Bowen. The above 2 points are about 2 miles apart.
You may want to call him and get better location before investigation.
Circumstances
Duke Energy staff was spraying for mosquitos and noted an oily substance flowing in creek. It
appeared to be burning the grass along the edge of the creek.
NOTHING FOUND. DEAD GRASS, APPEARED TO BE "COOL SEASON" GRASS; THE AREA
WAS DRY AT THE TIME OF INVESTIGATION.

Subject: Unknown Matter in Stream

Dear Mr. Mullinax:
In response to your concern regarding what appeared to be an accumulation of manure in the stream
on your property, Mr. Alan Johnson of this Office conducted a site inspection of the subject stream on May
28, 2002. Upon investigation, it was noted that the matter was not manure, but algae. In clearing the
underbrush from the stream bank and surrounding area, shading was diminished, which enhanced the aquatic
environment for the growth of algae. Allowing vegetation (including trees) to reestablish along the stream
bank will suppress algae growth as was evident in the adjoining properties.
While conducting the investigation Mr. Johnson observed that riprap had been placed in the
streambed to allow temporary access to the opposite side of the stream. Once access is no -longer required,
the riprap must be removed. If you have any -questions concerning this matter, please do not hesitate to

Subject: Improper Discharge of Wash
Water to Storm Drain

Dear Mr. Forrest:
On February 20, 2002 this Office received a complaint regarding blue/gray-tinted water
flowing through a ditch. Mr. Alan Johnson of this Office investigated the complaint on February
21, 2002. At the time of the investigation Mr. Johnson noted that there was a discharge of what
appeared to be wash water flowing into the storm drain in front of your residence. He spoke
with Ms. Teresa Forrest and was informed that clothes were in fact being washed at the residence
at that particular time. It is apparent that the discolored water was from the clothes washing
occurring at the time. Please be advised that such discharges are a violation of NCGS 143-215.1,
which prohibits discharges of wastewater without a proper permit. Since your home is served by
a septic tank system, this matter is being referred to the Iredell County Health Department.
Be advised that North Carolina General Statutes provide for penalties of up to $25,000
per violation per day for noncompliance with state environmental laws and regulations. It is
requested that a written response be submitted to this office by March 7, 2002 indicating the
actions taken to correct the noted problem. It is requested that you address this information to
the attention of Mr. Johnson.

Dear Mr. Stewart:
On February 20, 2002 this Office received a complaint from you regarding blue/gray-
tinted water flowing through a storm ditch in your yard. Mr. Alan Johnson of this Office
investigated the complaint on February 21, 2002. During the investigation it was determined that
the discharge was from a washing machine. The occupants of the residence responsible for the
discharge were informed that wastewater must be discharged into an approved septic system or
public wastewater treatment system. The matter is being forwarded to the Iredell County Health
Department.

Subject: Operating a Concentrated Animal
Animal Feedlot (CAFO) Without A Permit

Dear Mr. Gibson:
On February 21, 2002 Mr. Alan Johnson of this Office and Mr. Rocky Durham of the
Division of Soil and Water conducted a routine inspection of your cattle facility on Rash Rd.
North Carolina General Statutes (NCGS) 143-215.10B states that an animal facility that confines
100 head of cattle or more must obtain a permit from the North Carolina Environmental
Management Commission. One of the permit's requirements is the development of a Certified
Animal Waste Management Plan (CAWMP) in accordance with Natural Resource Conservation
Standards (NRCS). Based on the size of your facility and observations/comments received from
inquiries regarding your operation, it is apparent that the facility exceeds the 100-head threshold.
Be advised that North Carolina General Statutes provide for penalties of up to $25,000
per violation per day for noncompliance with state environmental laws and regulations, and/or
criminal penalties. It is requested that a written response be submitted to this office by March
10, 2002 indicating the actions taken to correct this matter. Please address this information to the
attention of Mr. Johnson.

REPORT : Complaint investigation regarding unknown pollutant entering Lake Norman

LOCATION: From the intersection of SR 1112 (Stutts Rd.) and SR 1282 (Bridle Path Rd.),
travel east on SR 1282 to the end of the road. The cove is located behind the residence at 141
Bridle Path Rd.

REPORT:
On September 5, 2000 this Office received a complaint concerning an unknown pollutant
entering the cove behind the complainant's residence (141 Bridle Path Rd., Mooresville). That
afternoon, Mr. Alan Johnson of this Office investigated the complaint. It was observed that the
"pollutant" was algae.
During discussion with Mr. Clark, it was apparent that due to recent rain events, the algae had
been flushed into the cove from the stream/drainage basin entering the cove. It was also noted
that the cove is adjacent to the Mallard Head Golf Course. Mr. Johnson drove to the end of
Mallard Way (a street in the golf club) and noted a creek and pond. The pond was covered with
algae and the small stream receiving the pond's overflow showed evidence of algae deposits due
to high water levels.
Warm weather and stagnant ponds are conducive to the growth of algae and other aquatic plants.
Also, nutrients such as fertilizers used in golf course maintenance and on residential lawns
further enhance the growth of aquatic plants.

REPORT:
On March 27, 2000 this Office received -a complaint ofanimproper application of animal
waste. The complainant informed the investigator, Mr. Johnson, that on March 27, 2000 a
manure spreader from the Buttke dairy had applied animal waste behind his residence. Because
the .application was within 100 ft. of his residence, the complainant was concerned about the
possible contamination of his well. He also inquired about setback requirements.
On March 28, 2000, Mr. Alan Johnson conducted an investigation of the field behind the
complainant's residence. It was noted that some type ofmaterial/substance had been applied
within-60 ft. of the residence. Mr. Johnsonalso investigated other fields.in the immediate area
for possible problems. There was no evidence of animal waste being applied on any of -the
surrounding fields.
Upon leaving the location, Mr. Johnson visited the Buttke Dairy.and spoke with Mr. Ben
Williams and Mr. Harold Buttke. Mr. Buttke informed Mr. Johnson that the material .was not
animal waste but old silage. Mr. Buttke was reminded that animal waste could not be applied
within:
200 ft. of a residence,
100 ft. of a well, or
25 ft. of -a perennial stream.
However, because the material was old silage and not animal waste, it does not fall subject to our
regulations.

Subject: NOTICE OF DEFICIENCY
Silage Runoff Discharge
Tributary of Beaver Creek

Dear Mr. McLain:
Mr. Alan Johnson of this Office noted runoff from your trench silo located on Seed
House Rd. (SR 2170) was entering an unnamed tributary of Beaver Creek. The runoff
discharges into a ditch along Seed House Rd. and flows east approximately 60 ft. before
entering the tributary. This discharge has caused an excessive growth of algae which is
visible on the south side of the road. Mr. Johnson spoke with your employee, Mr. Dale
Guy, and was informed that you were aware of the problem. Mr. Guy also pointed out
some measures that had been taken to control the problem (dirt berms and gravel). It is
apparent that these measures are not adequate, therefore, other measures need to be taken
immediately to alleviate the problem.
A Notice of Violation was issued in September 1995 for the same problem noted at
this site by Mr. Todd St. John of this Office. Mr. St. John indicated that you informed him
that you would remove the silage from the trench silo to prevent further water quality
problems. It is requested that you respond in writing by April 15, 1998 indicating the
actions taken to alleviate the problem. Please contact your Soil and Water Conservation
District representative for technical assistance.

REPORT:
On September 10,1997, Mr. Alan Johnson of this Office was contacted by Mr. Harold
Harmon regarding some cattle that had become sick and died. Mr. Harmon informed Mr.
Johnson that his vetemarian (Dr. Blackwelder) informed him that it.appeared that the cows had
been poisoned. Mr. Hannon was concerned that -it might be apollutant in the stream where the
cows had watered. The cows had been put' in the pasture on Tuesday, September 7th, but
symptons did not show up until Friday, September loth.
The location of the pasture was downstream of the old Statesville landfill, Twin Oaks
Golf Course and a number of industries that border the stream and its tributaries. Mr. Johnson
contacted the general manager of Merchant Metals located upstream of the site to inquire if any
spills had occurred at his plant. The manager stated he had no problems. When informed of the
dead cows, the manager noted that Twin Oaks Golf Club had been doing some work on their golf
greens earlier in the week.

Driving into Mr. Harmon'spasture Mr. Johnson observed two dead cows and two other
cows that were obviously sick. Mr. Harmon drove to the area where the cows obtained their
water. The stream was approximately two feet wide and two -to four inches in depth. There was
no evidence of dead fish or other aquatic life. Water samples were collected at the area where
Mr. Harmon said the cows had watered. The "watering hole" was .about 30 - 50 yards north of
Fourth Creek.
Mr. Johnson visited Twin Oaks Golf Course (872-3979) to inquire about the work that
had been done on the greens. Mr. Johnson spoke with Mr. Buford Kerley, an employee at the
golf course,.and informed him of the problems and requested permission to collect some water
samples. The water samples were collected justdownstream of the.maintenance building and
upstream of the tenth tee. When Mr. Buford was asked about the work on the greens he advised
Mr. Johnson to speak to the manager, Ms. Pattie Keith, who would not be in until Monday.
On Monday morning (September 13th) Mr. Johnson contacted Ms. Keith and was
informed that the company of Hendricks and Dail of Greensboro had done the work on the
greens. She believed that methylbromide had been used. Upon speaking with Mr. Ray Braxton
of Hendricks and Dail (252-758-4263),'he confirmed that methylbromide had been used. He said
the procedure for fumigating the greens is to lay down a tarp over the green, and inject the
chemical underneath the tarp and allow it to vaporized. The tarp remains on the green. The
greens were treated on Wednesday, September 8th. The tarps were still on the greens Friday
evening when Mr. Johnson visited the site. It appeared to Mr. Johnson that the treatment of .the
greens was not the source of the problem.
Mr. Johnson also spoke with Dr. Blackwelder, Mr. Harmon's veternarian, to see if he had
any information that might indicate the cause of the problem. Dr. Blackwelder ruled out
vegetation such as cherry trees and johnson .grass. Given the lack.of muscle control that the
.animals exhibited, he informed Mr. Johnson that the symptons were similar to lead poisoning.
Samples were collected for leadand other metals. Until results are obtained, this office is
unable to confirm that the illness to the cows was -waterborne.

investigation was conducted on May 15, 1997. Though no violations were observed, please inform Mr.
McLain that regulations for land application of waste require a 100 ft. buffer around wells, a 200 ft. buffer
from dwelling and other facilities frequented by people, and a 25 ft. buffer between any stream, ditch, or any
other similar conveyance.
Concerning whom is responsible for third party applicators, I found this in a guidance memo regarding
poultry dry litter systems. The same rules would also apply in your situation as well. As I mentioned in our
conversation, you or someone at your dairy would need to be certified.
Though youare not applying the waste, you have responsibility for:
1) Contracting the third party for which you must have a signed agreement.
2) Keeping the name, address, and phone number of the applicator.
3) Maintaining records of how much waste removed
4) Providing the waste analysis to the third party.
5) Providing a copy of the guidelines to the third party applicator.
Third party applicators should also maintain proper records as to when, how much, and the location where the
waste is applied.

Church, the Field Representative of the Division of Soil and
Water Conservation.
In order to address water pollution problems associated with
agricultural activities, North Carolina has established the
Agriculture Cost Share Program which helps farmers use practices
that protect water quality and avoid situations like the one you
described, so help is available to do something.

I discussed the farm plan at Rash Road with Larry Hendrix after talking with you on Wednesday.
We had talked before about putting the lots in permanent grass and downsizing our operation in
order to be in compliance with the reguiatioris.
The piles of manure will be spread on fields this week. I will call you as soon as you get this
letter.
We need to meet at the farm ASAP to discuss the options. Larry and I talked about the possibility
of not needing a feedlot permit if the lots were for grazing cattle and not to exceed 100 cattle.

In regard to certifications completed in Iredell County where certain items were noted,
I would like to provide you with additional information. '
The Sunrise Dairy farm was certified with a note. about management for runoff
controls. See attached letter. My intent was to inform DWQ that management of the
runoff control measures was not being used. Since Mrs. Campbell sent you the letter she
has reviewed this subject with the producer who rents her farm. She has told me he is
doing a better job of management.
At Millstone Dairy where the permit training was held, you have already seen the
amount of work that has been completed in regard to runoff controls. At present time,
however, the curb and fence have not been installed but can easily be completed when
landowner can get the time.
Please see the attached letter regarding Mountain View Dairy. Emergency spillway
and markers have been installed. Please note that certification of heifer lot runoff
controls was not needed until Mr. Souther returns heifers to this lot. At the present time
he is requesting cost share assistance to complete the work needed but until approved he
does not plan to stock animals in this lot.
I hope this information is helpful to you and the Division of Water Quality. As you
have seen, much work has been completed in Iredell County. Also the remaining work at
Millstone Dairy is very insignificant compared to what has been completed on his farm to
improve water quality.

Inactive Animal Waste Management Lagoons
In 1999, the North Carolina General Assembly passed legislation that required the Department of
Environment and Natural Resources (DENR) to locate and evaluate every inactive animal waste lagoon
in the state. Inactive lagoons were defined as those that have not received animal waste for at least one
year. This legislation requires that this inventory be completed and the results reported back to the
General Assembly within the next few months.
DENR has directed that the Division of Soil and Water Conservation and the Division of Water Quality
work together and complete this inventory and evaluation.
Our records indicate that an inactive lagoon may be located on land that you own or on which you have
previously raised animals. Due to this requirement to locate and evaluate all inactive lagoons, staff from
our Divisions will be contacting you to arrange a visit to your site to determine if an inactive lagoon
does in fact exist. If a lagoon is located, our staff is also required to gather information on the condition
of the lagoon and its potential to cause problems to the waters of the state.
We greatly appreciate your assistance in helping us meet this legislative requirement. We will make
every effort to minimize any inconvenience that this effort may cause you and we will complete our
work as quickly as possible.

Dear Mr. McLain:
Mr. Alan Johnson of this Office noted runoff from your trench silo located on Seed
House Rd. (SR 2170) was entering an unnamed tributary of Beaver Creek. The runoff
discharges into a ditch along Seed House Rd. and flows east approximately 60 ft. before
entering the tributary. This discharge has caused an excessive growth of algae which is
visible on the south side of the road. Mr. Johnson spoke with your employee, Mr. Dale
Guy, and was informed that you were aware of the problem. Mr. Guy also pointed out
some measures that had been taken to control the problem (dirt berms and gravel). It is
apparent that these measures are not adequate, therefore, other measures need to be taken
immediately to alleviate the problem.
A Notice of Violation was issued in September 1995 for the same problem noted at
this site by Mr. Todd St. John of this Office. Mr. 'St. John indicated that you informed him
that you would remove the silage from the trench silo to prevent further water quality
problems. It is requested that you respond in writing by April 15, 1998 indicating the
actions taken to alleviate the problem. Please contact your Soil and Water Conservation
District representative for technical assistance.

Environmental Management in accordance with Title 15A of the North Carolina Administrative
- Code, 2H, Rule .0217.. An individual nondischarge permit is .not required if certain criteria are
met. A major requirement to be deemed permitted is that there must not be a discharge of any
wastewater from the operation to the waters of the State.
This letter transmits a Notice of Violation and notification that your animal operation has
been found discharging wastewater to the surface waters of the State and is, therefore, no longer
deemed permitted as a nondischarge facility under 15A NCAC 2H .0217. Therefore, the existing
wastewater treatment system serving your animal operation is currently being operated without a
permit as required by North Carolina General Statute 143-215.1.
If you wish to be reconsidered for coverage by the deemed permitted provision of the
Rule, you must: 1) immediately eliminate the discharge- ofwastewater; 2) make any modifications
needed to ensure there will be no future discharges; and 3) send in an approved animal waste
management .plan by completing the attached certification form. This form and a copy of your
