Dear Mr. Mull:
In accordance with your application received February 17, 1984, we are
forwarding herewith Permit No. 10664, dated August 30, 1984, to the Metropolitan
Sewerage District of Buncombe County for the operation of the subject non -discharge
type waste treatment plant sludge land appliction facilities.
This permit shall be effective from the date of issuance until July 1, 1989,
and shall be subject to the conditions and limitations as specified therein.
If any parts, requirements, or limitations contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing before a
- -- --hearing-officer upon written demand to the Director within thirty (30)-days ----
following receipt of this permit, identifying the specific issues to be con-
tended. Unless such demand is made, this permit shall be final and binding.
One (1) set of approved plans and specifications is being forwarded to you.

In accordance with the provisions of Article 21 of Chapter 143, General
Statutes of North .Carolina as amended, and other applicable Laws, Rules, and
Regulations
PERMISSION IS HEREBY GRANTED TO
Metropolitan Sewerage District of Buncombe County

FOR THE
operation of an 150,000 GPD non -discharge type sludge land application system to
dispose of sludge from the Metropolitan Sewerage District of Buncombe County Waste-
water Treatment Plant to those sites as .listed in Condition No. 23 of this Permit
withno-discharge to the surface waters of the State,
pursuant to the application received February 17, 1984, and in conformity with
the project plans, specifications, and other supporting data, subsequently filed
and approved by the Department of Natural Resources and Community Development and
considered a part of this permit.
This Permit shall be effective from the date of issuance until July 1, 1989,and
shall. be subject to the following specified conditions and limitations:
1. This permit shall become voidable unless the facilities are operated in
accordance with the approved plans, specifications and other supporting data.
2. This permit is effective only with respect to the nature and volume of wastes
described in the application and other supporting data.
3. The facilities shall be properlymaintainedand operated at all times.
4. This permit is not transferable.
5. This permit shall become voidable in the event of failure of the soil to
adequately absorb the wastes, and may be rescinded unless the facilities are
installed, maintained and operated in a manner which will protect the assigned
water quality standards of the surface waters and ground waters.
6. In event the facilities fail to perform satisfactorily including the creation
of nuisance conditions, the Permittee shall take such immediate corrective
action as may be required by this Division, including the construction of
additional or replacement wastewater treatment or disposal facilities.

measures shall be approved by the Division of Environmental Management.
9. The Permitted, at least six (6) months prior to the expiration of this Permit,
shall request its extension. Upon receipt of the request, the Commission will
review the adequacy of the facilities described therein, and if .indicated,
will extend the Permit for such period of time and under such conditions and
limitations as it may deem appropriate.
10. .The application rates shall .not exceed:
a. 212 #PAN/Ac/Yr.
b. 2.5 dry tons/Ac/Yr.
c. 0.45 4Cd/Ac/Yr. -
11(. Monitoring wells shall be constructedand sampling schedules arranged as required
by the Division of Environmental Management and constructed in accordance with
10 NCAC 2C 0.0100. The Asheville Regional Office must be contacted to coordinate '
placement and construction of the wells.
12. Groundwater.monitoring shall be begun befor sludge. application begins. Monitoring
shall be conducted -:quarterly for. the first year :and semi-annually tereafter _

13. The issuance of this permit shall not relieve the Metropolitan Sewerage District.
of Buncombe County of the responsibility for damages to surface or ground waters
resulting from the operation of this facility.
14. The facilities shall be effectively maintained and operated as a non -discharge
system to prevent the discharge of any wastewater into the surface waters of
the State.
15. No type of sludge other than that from the MetropolitanSewerageDistrict Wastewater
Treatment. Plant shall be placed on the land application disposal site. -
16. The site shall be adequately limed to a soil pH of 6.5 prior to sludge application.
17. A 100-foot buffer shall be maintained between the appropriate land owner's
property line and any applied sludge.

18. No liquid sludge shall be surface applied within a 100-feet buffer zone
of any water course or 'surface drainage area.
19. No liquid sludge shall be applied in form of subsurface injection within
a 25-foot buffer zone of any watercourse of surface drainage area.
20. No root or leaf crops for public consumption shall be raised on these sites.
21. This permit shall become voidable unless the agreement between the Metropolitan
Sewerage District and those persons listed in Condition No. 23 is in full
force and effect.
22. In any future transfer of this land, a notice shall be given to the new -
owner that gives full details as to the materials applied or incorporated
at this site.
23. The following sites are approved for sludge disposal:
a. Warren Wilson College 223 acres
b. Fred Myers and Ulmont Baker 40 acres
c. Don Cordell 49 acres _
