On August 1, 2014, the Division of Water Resources (Division) received an application, dated July
24, 2014, requesting a 401 Water Quality Certification from the Division for the subject project.
The Division has determined that the application is incomplete and cannot be processed at this
time. The application is on -hold until the following items are addressed:
1. In order for DWR to process the application, a fee of $240 is required. Please remit a check
for $240 for and reference DWR # 14 -860 on your payment and send to the below address.
2. One black and white photograph is included in the application but we cannot make out the
shoreline in the photograph. Please provide color photographs of the shoreline to
demonstrate that stabilization is necessary. These can be mailed to the below address or
emailed to Shelton Sullivan at Shelton.sullivan @ncdenr.gov.
3. The application lists a wooden wall or riprap wall and the diagram provided shows a wall
with riprap in front. Please provide a specific plan or design for the proposed work and

4. If the bank has been, undermined from erosion, you will be allowed to slope the bank if
necessary and remove the vegetation along the immediate shoreline. Please specify any
vegetation present and any, such as trees, to be removed. These impacts should be
accounted for in No. 11 and explained in No. 12 of the application. W C ul

5. DWR needs the square footage of stabilization above and below the normal lake level.
DWR understands that this measurement may vary along the shoreline but please provide
these so the impacts can be properly documented and permitted. See the following
example or the Shoreline Stabilization Help Document on the web at:

a. In the following example, there are 3 ft. of impacts above the normal water level
and 3 ft. below the normal water level, measuring horizontally from the top of the
slope but not down the slope.

Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested
information for the proper consideration of the application. If all of the requested information is
not received in writing within 30 calendar days of your receipt of this letter, the Division will be
unable to process the application and it will be returned. The return of this project will necessitate
reapplication to the Division for approval, including a complete application package and the
appropriate fee. Please be aware that there is no authorization under the Section 401 of the Clean
Water Act for this activity and any work done within waters of the state may be a violation of
North Carolina General Statutes and Administrative Code.
