Effective August 1, 2013 the State Stormwater program has been transferred from the Division of Water
Quality (DWQ) to the Division of Energy. Nlineral and Land Resources (DEMLR). All previous
references to DNVQ will remain in older stormwater permits issued prior to August 1, 2013 until they are
modified. Please note that the updated permit or any updated pages to the permit will now reference
DEMLR as the Division responsible for issuance of the permit.
Permit Renewal. Name/Ownership Change. and Extension:
On April 19, 2018, the Division of Energy, Mineral and Land Resources (DEMLR) received a permit for
the subject project. As indicated on the Name/Ownership Change form, you have ackno-wledged receipt
of a copy of the permit; which includes the application and supplement forms; a copy of the approved
plans and a copy of the required Operation and Maintenance agreement from the previous permittee. By
acknowledging receipt. of the permit, and by signing the Name/Ownership Transfer form, you have
accepted the responsibility for complying with the terms and conditions outlined in this permit. On
August 5, 2009; the Governor signed Session Law 2009-406, This law impacts any development approval
issued by the Division of Energy, N4ineral and Land Resources under Article 21 of Chapter 143 of the
General Statutes, which is current and valid at any point between January L 2008, and December 31,
2010. The law extends the effective period of any stormwater permit that was set to expire during this
time frame up to three (3) years from its current expiration date. On August 2, 2010: the Governor signed
Session Law 2010-177, which granted an extra year for an extension of up to four (4) years. The Division
is hereby notifying you that permit SW8 980346 has been renewed, transferred, and extended on the
following dates:

Notice of Inspection:
The original permittee, S-2 Yachts, Inc., filed for destruction on November 21, 2017, and the new owner
(the incoming permittee), Swans Point, LLC, has requested that the permit be transferred to them. Swans
Point. LLC was previously titled TCC Swausboro, LLC, which for clarity, is the entity listed on the deed.
A file review and site inspection was performed on April 23, 2018 by DEMLR staff and as noted in the
enclosed inspection report. The expansion of the built upon area authorized by this permit have not been
initiated or completed.

This permit is subject to the conditions and limitations as specified in the updated permit. Please pay
special attention to the conditions listed in this permit regarding'the Operation and Maintenance of the
BMP(s), recordation of deed restrictions, procedures for changes of ownership; transferring the permit,
and renewing the permit. Failure to establish an adequate system for operation and maintenance of the
storntwater management system, to record deed restrictions; to transfer the permit, or to renew the permit,
will result in firture compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to
request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings
(OAH). The written petition must conform to Chapter 150B of the North Carolina General Statutes, and
must be filed with the OAH within thirty (30) days of receipt of this permit. You should contact the OAH
with all questions regarding the filing fee (if a filing fee is required) and/or the details of the filing process

This permit shall be effective from the date of issuance until November 12, 2020 and shall be subject to the following specified
conditions and limitations:
I. DESIGN STANDARDS
I . This permit is effective only with respect to the nature and volume of stormwater described in the application and other
supporting data.
2. This stormwater system has been approved for the management of stormwater runoff as described in the Project Data
Sheet of this permit. The stormwater control has been designed to handle the runoff from 396,159sf of impervious
area. The basin must be operated with a minimum 50' long vegetated filter for all overflows in the excess of the design
storm.
3. Approved plans and specifications for this project are incorporated by reference and are enforceable parts ofthe permit.
4. The tract will be limited to the amount of built -upon area indicated in the Project Data Sheet and per the approved
plans.
5. The 15.25ac project area within 575ft of (the AEC) of ORW class waters of the Intracoastal Waterway is limited to
166,072sf of built upon area. ']'his permit covers the construction of I59,635sf of built upon area within the AEC. No
collection systems are allowed within the 575' 016*,1 AEC.

II. SCIEDULE OF CONIPLIANCI?
1. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended
use prior to the construction of any built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired
immediately.
3. The perminee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater
system functions at optimum efficiency. "fhe approved Operation and Maintenance Plan must be followed in its
entirety and maintenance must occur at the scheduled intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and re -vegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
C. Maintenance of all slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of outlet structure, orifice device, flow spreader; catch basins and piping.
g. Access to the outlet structure must be available at all times.
4. Records of maintenance activities must be kept and made available upon request to authorized personnel of
DEMLR. The records will indicate the date, activity, name of person performing the work and what actions were
taken.
5. Decorative spray fountains will not be allowed in the pond or basin.
6. The facilities shall be constructed, operated and maintained in accordance with the provisions of this permit, the
approved plans and specifications, and the supporting documents attached to this permit and on file with the
Division.
7. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this
permitted facility, a certification must be received from an appropriate designer for the system installed certifying
that the permitted facility has been installed in accordance with this permit, the approved plans and specifications,
and other supporting documentation. Any deviations from the approved plans and specifications must be noted on
the Certification. A modification may be required for those deviations.
8. A copy of the approved plans and specifications shall be maintained on file by Permittee for a minimum of ten
years from the date of completion of construction.
9. Prior to the sale of any portion of the property, an access/maintenance easement to the stormwater facilities shall be
granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale of any portion of
the property.
10. The permittec is responsible for verifying that the proposed built upon area does not exceed the allowable built
upon area.
I I . The runoff from all built upon area on the project must be directed into the permitted stormwater control system.
12. If the stormwater system was used as an Erosion Control Device, it must be restored to the design condition prior to
operation as a stormwater treatment device, and prior to occupancy of the facility.

13. The pennittce shall submit to the Director and shall have received approval for revised plans, specifications, and
calculations prior to construction, for any modification to the approved plans, including, but not limited to, those
listed below:
a. Any revision to any item shown on the approved plans, including the stormwater management measures,
built -upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the drainage area.
C. Further subdivision, acquisition, lease or sale of all or part of the project area. The project area is defined
as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a
CANMA Major permit was sought.
f. Pilling in, altering, or piping of any vegetative conveyance shown on the approved plan.
14. The Director may determine that other revisions to the project should require a modification to the permit.
15. The Director may notify the permittee when the permitted site does not meet one or more of the minimum
requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time
schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies
of revised plans and certification in writing to the Director that the changes have been made.
16. The facilities shall be constructed, operated and maintained in accordance with the provisions of this permit, the
approved plans and specifications, and the supporting documents attached to this permit and on file with the
Division.
17. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the
transfer request. \either the sale of the project, in whole or in part, nor the conveyance of common area to a third
party constitutes an approved transfer of the stormwater permit.
18. Any individual or entity found to be in noncompliance with the provisions of this stormwater management permit
or the requirements of the Stormwater rules is subject to enforcement procedures as set forth in NCGS 143 Article
21.
19. The permittee shall submit a permit renewal application request at least 180 days prior to the expiration date of this
permit. The renewal request must include the appropriate documentation and the processing fee.
20. If permittee will review and approve permeable pavement applications from the lot owners, add the following 2
statements to the modified permit:
a. To the section of the permit where all the things that require a modification to the permit are listed,
add this simple statement: "The construction of permeable pavement for BUA credit.
In Schedule of Compliance, "If the use of permeable pavement for 13UA credit within the lot is
desired; the pennittce shall direct the lot owner to submit an application with all supporting
documentation and the application fee to the Division and receive a permit prior to construction of
the permeable pavement.

21. This permit is not transferable to any person or entity except after notice to and approval by the Director. The

permittee shall submit a completed and signed State Stormwater Request Form for Permit Transfer or Permit
information Update, accompanied by the supporting documentation as listed on the form, to the Division at least 60
days prior to any one or more of the following events:
a. Any ownership change including:
i. The sale or conveyance of the project area in whole or in pan, except in the case of an individual
lot sale that is made subject to the recorded deed restrictions and protective covenants;
ii. Dissolution of the partnership or corporate entity, subject to NCGS 57D-2-01(e) and NCGS 57D-
6-07;
b. Bankruptcy;
c. Foreclosure, subject to the requirements of Session Law 2013-121;
d. A name change of the current permittee;
e. A name change of the project;
f A mailing address change of the permittee;
2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittce to enforcement
action by the DEMLR, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes; rules; regulations;
or ordinances which may be imposed by other government agencies (local, state, and federal) which havejurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Pennittee
shall take immediate corrective action, including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.
5. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit
modification, revocation and rcissuance or termination does not stay any permit condition.
6. Pennittee grants permission to staff of the DENMI,R to access the property for the purposes of inspecting the stormwater
facilities during normal business hours.
7. The permittce is responsible for compliance with all permit conditions until such time as the Division approves the
transfer request. Neither the sale of the project, in whole or in part, nor the conveyance of common area to a third party
constitutes an approved transfer of the stormwater permit.
8. Any individual or entity found to be in noncompliance with the provisions of this stormwater management permit or the
requirements of the Stormwater rules is subject to enforcement procedures as set forth in NCGS 143 Article 21.

This form may be photocopied for use as an original
This form is to be completed by the current permit holder pursuant to Title 15A NCAC 2H.1003 (h) (2). This states
that stormwater management permits, issued for projects that require the construction of engineered stormwater
control measures (High Density Permits), shall be required to submit an application to renew the permit 180 days
prior to expiration of the permit. Renewed permits are valid for a period of 8 years per Session Law 2011-398 (SB
781) Section 60. (c).
I. SUBMITTAL REQUIREMENTS
Only complete application packages will be accepted and reviewed by the North Carolina Department of
Environment and Natural Resources (NCDENR) Division of Energy Mineral and Land Resources (DEMLR). A
complete package includes all of the items listed below. The complete application package should be
submitted to the appropriate DEMLR Regional Office. (The appropriate office may be found by clicking on the
interactive online map at htt :�//12ortal.ncdenr.org web/guest/regional-offices. Copies of the original permit can be
obtained from the Regional Office of the Division of Energy, Mineral and Land Resources.)

PERMIT TRANSFER APPLICATION FORM
Pursuant to 15A NCAC 02H.1045 and other applicable statues as reference within
Only complete applications packages will be accepted and reviewed. This form and the required items (with
original signatures) must be sent to the appropriate DEMLR Regional Office, which can be determined by locating
the project on the interactive online map at: htto://deg.nc.gov/contact/regional-offices.
After this application is accepted, DEMLR will conduct a compliance inspection and report any deficiencies to the
current permittee and/or the proposed permittee. Per the state stormwater rules and the state stormwater permit
conditions, the permit shall not be transferred until:
1. the current permittee resolves all non-compliance issues identified in the inspection report;
2. the current permittee negotiates a resolution with the proposed permittee (in writing and signed by both
entities. The negotiated resolution must identify the necessary actions, the responsible party(ies), and the
timelines to correct the deficiencies. The site must either be found in compliance or a copy of the
negotiated resolution must be submitted prior to the transfer of the permit.); or
3. in the case where a transfer falls under G. S. 143-214.7(c2) (see also SL 2011-256), the proposed
permittee resolves all non-compliance issues upon acquiring the permit.
Signature requirements for the named signing official (for current and proposed permittee) must meet the following:
• Corporation - a principal executive officer of at least the level of vice-president;
• Limited Liability Company (LLC) - the designated manager,' (Documentation from the NC Secretary of
State or other official documentation must be provided that states the titles and positions held by the
person who signed the application (pursuant to 02H.1040) that shows they have legal authority to sign for
the LLC)
• Municipality - a ranking official or duly authorized employee;

been built, documentation that the maximum allowed per lot built -upon area or the maximum
allowed total built -upon area has not been exceeded. If the project has not been built, the new
owner shall provide a signed agreement to submit final recorded deed restrictions and protective
covenants.
8. If transferring under G.S. 143-214.7(c2) (see also SL 2011-256), documentation verifying that 50%
or more of the lots have been conveyed to individuals (not builders). Copies of the deeds of
conveyance or a chart listing the lot number, lot address, owner's name, conveyance date and
deed book and page number are acceptable.

The Division of Water Quality issued a Coastal Stormwater Management Permit, Number SW8 980346 to S-2 Yachts, Inc. for
a High Density project on November 12, 2008, with a Permit Extension letter issued on April 26, 2011. This permit expires on
November 10, 2012. Per 15A NCAC 2H.1003(h) (the stormwater rules), applications for permit renewals shall be submitted 180
days prior to the expiration of a permit and must be accompanied by a processing fee, which is currently set at $505.00. If this is
still an active project please complete and submit the enclosed renewal application prior to May 18, 2012. If this project has not
been constructed and a permit is no longer needed, please submit a request to have the permit rescinded. If you have sold the
project please provide the name, mailing address and phone number of the person or entity that is now responsible for this
permit. Enclosed is a form for change of ownership, which should be completed and submitted if the property has changed
hands.
Your permit requires that upon completion of construction and prior to operation of the permitted stormwater treatment system,
a certification of completion be submitted to the Division from an appropriate designer for the type of system installed. This is to
certify that the permitted facility has been installed in accordance with the permit, the approved plans, specifications and
supporting documentation. If you have not already provided a Designer's Certification to our office, please include a copy with
your permit renewal request and processing fee. A copy of the certification form is enclosed for your convenience.
You should be aware that failure to provide the Designers Certification and the operation of a stormwater treatment facility
without a valid permit, are violations of NC General Statute 143-215.1 and may result in appropriate enforcement action
including the assessment of civil penalties of up to $10,000 per day.

On August 5, 2009, the Governor signed Session Law 2009-406. This law impacts any
development approval issued by the Division of Water Quality under Article 21 of
Chapter 143 of the General Statutes, which is current and valid at any point between
January 1, 2008, and December 31, 2010. The law extends the effective period of any
stormwater permit that is set to expire during this time frame to three (3) years from its
current expiration date. On August 2, 2010, the Governor signed Session Law 2010-
177 which grants an extra year for a total of four (4) years extension.
Accordingly, Stormwater Permit # SW8 980346 which has already expired on
November 18, 2008, is now in effect until November 18, 2012. Please resubmit the
renewal application and fee at least 180 days prior to November 18, 2012, which would
be May 18, 2012. A copy of the Renewal Application can be obtained from the following

Apparently, the original file was lost and a replacement file has been generated.
The replacement file contains an incomplete plan set, no calculations and no
application. I'm going to contact Central Files to get a copy of the signed permit
and the application itself and I'll contact the original designer, Stroud
Engineering in Morehead City to send me a copy of the calculations..
In regard to your questions about ownership and the expansion. The permit will need
to be transferred to Hatteras Yachts before any construction takes place. If
Hatteras wants to build the site in phases, starting out with a smaller BMP system
than is currently permitted to Tiara, then this would require a permit
modification.

If we can't find the file, we'll notify Central Files to make us a copy of the
permit and application and then we'll contact the original permittee for a copy of
the plans. We're holding out hope that we will find the file shortly. I can pull up
an unsigned copy of the permit without the application, but I really need the plans
to know whether or not what you're proposing will need a modification, plan
revision or nothing at all.

The 3 ownership changes that Lisa saw were caused by an error in
the
system, where one of our admin staff entered what she thought was a
change to just one owner, but the system somehow changed the owners
on
over 2,000 projects. This occurred in April, 2007. It took a few
weeks
to get it all straightened out. We have NOT received a request to
change
the project name or ownership of Tiara Yachts, that I know of.
Again, wet ponds are currently not allowed within 1/2 mile of SA
waters.
The infiltration basin is the final BMP- the pond itself acts only
as a
storage device. Runoff in excess of the design storm has to be
bypassed
through a 50' vegetated filter, unless the pump and infiltration
system
have been designed to accommodate more than the 1.5" design storm.
Modifications to what was previously permitted can be approved, but
the
whatever is proposed y will be required to meet today's criteria.
