November 12, 1998, remain in effect.

Dear Mr. Slikkers:
The Wilmington Regional Office received the modification to the Stormwater Management Permit Application for Tiara
Yachts on October 9, 1998, with final information on November 9, 1998. Staff review of the plans and specifications has
determined that the project, as proposed, will comply with the Stormwater Regulations set forth -in Title 15A NCAC 2H.1000.
We are forwarding the modification to Permit No. SW8 980346 dated November 18, 1998, for the construction of Tiara
Yachts.
This permit shall be effective from the date of issuance until November 18, 2008, and shall be subject to the conditions and
limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit.
Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in
future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an
adjudicatory, hearing upon written request within thirty (30) days following receipt of this permit. This request must be in
the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office
of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this permit shall
be final and binding.

construction, operation and maintenance of an infiltration basin in compliance with the provisions of 15A NCAC 2H .1000
(hereafter referred to as the "stormwater rules') and the approved stormwater management plans and specifications and other
supporting data as attached and on file with and approved by the Division of Water Quality and considered a part of this
permit.
This permit shall. be effective from the date of issuance until November 18, 2008 and shall be subject to the following
specified conditions and limitations:
I. DESIGN STANDARDS
I. This permit is effective only with respect to the nature and volume of stormwater described in the application and
other supporting data.
2. This stormwater system has been approved for the management of stormwater runoff as described on page 3 of this
permit, the Project Data Sheet. The stormwater control has been designed to handle the runoff from 396,159 square
feet of impervious area. This basin must be operated with a minimum 50' long vegetated filter for all overflows in
excess of the design storm.
3. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the
permit.
4. The tract will be limited to the amount of built -upon area indicated on page 3 of this permit, and per approved plans.
5. The 15.25 acre project area within 575 feet (the AEC) of the ORW class waters of the Intracoastal Waterway is
limited to 166,072 square feet of built -upon area. This permit covers the construction of 159,635 square feet o built -
upon area within the AEC. No collection systems are allowed within the 575' ORW AEC.

II. SCHEDULE OF COMPLIANCE
The stormwater management system shall be constructed in it's entirety, vegetated and operational for its intended
use prior to the construction of any built -upon surface except roads.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired
immediately.
The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater
system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its
entirety and maintenance must occur at the scheduled intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping.
g. Access to the outlet structure must be available at all times.
It. The vegetated filter will be kept grassed with no erosion. The spreader mechanism will be kept clear.
4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ.
The records will indicate the date, activity, name of person performing the work and what actions were taken.
5. Decorative spray fountains will not be allowed in the pond or basin.
6. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the
facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and
other supporting data.
Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this
permitted facility, a certification must be received from an appropriate designer for the system installed certifying
that the permitted facility has been installed in accordance with this permit, the approved plans and specifications,
and other supporting documentation. Any deviations from the approved plans and specifications must be noted on
the Certification.
A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten
years from the date of the completion of construction.
9. Prior to the sale of any portion of the property, an access/maintenance easement to the stormwater facilities shall be
granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale of any portion of
the property.
10. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -upon
area.
IL The runoff from all built -upon area on the project must be directed into the permitted stormwater control system.
12. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to
operation as a stormwater treatment device, and prior to occupancy of the facility.

13. The following items will require a modification to the permit:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
e. Further subdivision of the project area.
f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan.
g. Sale of any portion of the project area.
14. The Director may determine that other revisions to the project should require a modification to the permit.
15. The Director may notify the permittee when the permitted site does not meet one or more of the minimum
requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time
schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies
of revised plans and certification in writing to the Director that the changes have been made.
M. GENERAL CONDITIONS
1. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name
change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied
by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate.
The approval of this request will be considered on its merits and may or may not be approved.
2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement
action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-
215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules,
regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have
jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the
Permittee shall take immediate corrective action, including those as may be required by this Division, such as the
construction of additional or replacement stormwater management systems.
5. The permittee grants DENR Staff permission to enter the property for the purpose of inspecting all components of
the permitted stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit
modification, revocation and reissuance or termination does not stay any permit condition.

ATTACHMENT A
1. Deed Restriction Language
The following statements must be recorded for all low density projects and for all projects that involve t
subdivision and selling of lots or outparcels:
1. No more than _ square feet of any lot, including that portion of the right-of-way between the
edge of pavement and the front lot line, shall be covered by impervious structures including
asphalt, gravel, concrete, brick, stone, slate or similar material but not including wood decking or
the surface of swimming pools. This covenant is intended to insure continued compliance with the
stormwater permit issued, by the State of North Carolina. The covenant may not be changed or
deleted without the consent of the State.
2. No one may fill in, pipe, or alter any roadside Swale except as necessary to provide a, minimum
driveway crossing.
NOTE: If lot sizes vary significantly, the owner/developer must provide an attachment listing each lot
number, size and the allowable built -upon area for each lot.
For commercial projects that have outparcels or future development the following statements must also be
recorded:

forebay such that short-circuiting of the system does not occur.

The enclosed package contains the revised plans for Tiara Yachts. The following revisions as
noted in your October 14, 1998 letter have been made to complete the application:
The bluelines on the plans have been darkened to make the reading easier.
2. The issues concerning the wet pond's function have been resolved by our
discussion of the matter.
3. There is 50' of vegetative filter provided for any overflows from the wet detention
pond. The natural contours will induce sheet flowing of any overflow over a
vegetated area rather than a defined Swale with sloping sides. The overflow device
has been rotated to provide the 50' required and now contains a diffuser to spread
the flow as well as rip rap outlet protection.
4. Notations and detail arrangements have been modified to more clearly show the
location of the stormwater pump in relation to the overflow device. You will see
from the plan sheet as well as from the Overflow Device and Pump Basin Detail
that they are separate structures, only the Elevation View Detail shows the
combination of the two in profile.
5. A legend has been provided.
6. A distribution manifold has been added as a dispersion mechanism for the runoff
entering the infiltration basin. Plan and profile views are provided.
The information included in the calculations showing the proposed rerouting of
roof drainage has been added to the plans.

Dear Mr. Cullipher:
The Wilmington Regional Office received a Stormwater Management Permit Application for Tiara
Yachts on October 9, 1998. A preliminary review of that information has determined that the application
is not complete. The following information is needed to continue the stormwater review:
1. Please darken up the bluelines. The notes and lines are very faint, and it is very difficult to
read the notes and to distinguish between proposed contours and impervious areas since both
are the same line type.
2. It is not necessary to provide a wet pond that is in compliance with the regulations, since it
will not be permitted. It is only a storage device. The infiltration area is the only system to
be permitted for this project. I can proceed with review of the plans as is, however, I thought
you needed to know this in case modifications could be made.
3. Because of the SA water classification, a 50' vegetated filter is required for any overflows
from the pond. Please add a detail of the vegetated filter to the plans. Remember that the
filter is NOT a ditch. It must be designed such that the overflows are spread out over the
width of the filter, and does not create a direct discharge to SA waters.
4. Please indicate the location of the stormwater pump station on the plans. The note by the pond
on the grading plan, indicates that the outflow structure contains the pump, but the outflow
elevation detail on the first detail sheet (the plans sheets are not numbered) does not show how
the pump station is connected to the outflow device. Does the fiberglass pump station fit down
inside the concrete box, or is it adjoining the overflow box from the outside? The overflow
elevation detail shows the 3" orifice coming into the concrete box, but the plan view above
it shows the orifice coming into the pump station. Please clarify.

5. Please provide a legend on the plans for all the various symbols used, such as for the marsh,
wetlands, filled wetlands, property lines, right-of-way, contours, spot elevations, etc.
6. Please provide and detail a dispersion mechanism for the runoff entering the infiltration basin,
so that the runoff is evenly distributed across the bottom of the basin.
7. There is a faint note on the plans within the area of the Phase 2 expansion building that says,
I think, that only 32,700 square feet of roof area is allowed to discharge to the ORW. While
it is good that the note is there, and the calculations have a building downspout plan that
shows the proposed rerouting, you must put this information on the plans. Very few
construction people look at the calculations- they only see the plans, so that information
should be on the plans..
8. The maximum drainage area fora single infiltration basin should be no more than 5 acres.
Please revise. For any requirement that is not met, justification must be provided.
Please note that this request for additional information is in response to a preliminary review. The
requested information should be received by this Office prior to November 14, 1998, or the application will
be returned as incomplete. The return of a project will necessitate resubmittal of all required items, including
the application fee.

The land & soils within SW portions of the Tiara. Yacht Tract (-44 acres) were evaluated to
determine potential 404-CAMA Wetland areas. The 1987 "Federal Wetlands Delineation Manual'
and NCDEH&NR-DCM CAMA regs were used to determine these wetland areas. The enclosed
land & soils map shows these areas and are discussed as follows:
The "YELLOW" Areas (see map) are moderately well drained, deep sandy upland soils. These
soils have an estimated seasonal high water static water table between +30 to 55 inches from
the surface based upon soil wetness indicators. Estimated permeability is +5-10 min/in (+6-12
in/hr) to +60" depths. These soil types should be considered as suitable for shallow or ultra
shallow placed (0 - 2.5 ft bottom depths) infiltration basin system with constructed sidewall berms
due to seasonal high water table depths. Soil types found are Seabrook and Wando. The tract
is relatively uniform within the respective soil groups delineated on the enclosed map. The major
variations are depths to seasonal high water table indicators. The better sites for stormwater
infiltration system usage are on the higher elevations, with marginal to unsuitable sites being at
intermediate to lower elevations. Careful planning and design should be exercised to insure
usable soil areas are reserved for stormwater infiltration treatment, and relatively preserved in
their natural state. Otherwise, the usable soil areas could be degraded to an unsuitable status
for stormwater infiltration basins. Soil logs can be provided upon request.
The "GRAY -MARSH SYMBOL"Areas (see map) are considered to be jurisdictional 404 Wetlands
that meet all the hydric soil & vegetative criteria, and hydrology to be defined as such and come
under U.S. Army Corps/EPA jurisdiction. These areas cannot be filled or surficially disturbed for
a change in land -use unless the proper Federal & 'State permits can be acquired. These 404
wetlands are likely to be considered as "adjacent':' wetlands and not eligible for many of the
nationwide fill permits. The 404 Wetland areas.. of concern were delineated in the field with
"pink/black-striped" flagging.

Tiara Yacht Tract, Stormwater & Wetlands
The'WHITE-MARSH SYMBOL'Areas (see map) are considered to be jurisdictional CAMA-404
Wetlands that meet all the hydric soil & vegetative criteria, and hydrology to be defined as such
and come under NCDEH&NR-DCM-CAMA and U.S. Army Corps/EPA jurisdictions. These are the
tidally influenced wetland areas. These areas cannot be filled or surficially disturbed except for
water dependent structures such as piers, docks, boat ramps, and etc. which also requires
permitting. The CAMA AEC zone is 575' landward of O.R.W. mean high tide and 75' landward
of other mean high tide lines. These were evaluated but not delineated in the field.
The remaining portions of the tract have not been evaluated as no development impacts are
anticipated. Careful planning and design should be exercised to avoid wetland areas and
preserve usable areas for stormwater treatment. Before initiating any construction the respective
permitting agencies should be contacted for their reviews and approvals.

Non -Clog Submersible Pumps
Specifications.
PUMP MODEL — Pump shall be Myers Model Number 3WHV Non -Clog Submersible Pump with 2
vane enclosed impeller. All openings in pump impeller and volute case to be large enough to pass a 2-
1/2" diameter sphere. Discharge flange shall:6e vertical three (3) inch standard.
OPERATING CONDITIONS — Pump shall have a capacity of GPM at a total head of
feet and shall use a ,HP motor operating at RPM.
MOTOR — Pump motor shall be of the sealed_ submersible type rated HP at RPM 60
Hertz. Motor shall be for single phase 230 volts or three phase 200 volts 230 volts
460 volts or 575 volts Single phase motors shall be of capacitor start,
capacitor run, NEMA L type. Three phase motors shall be NEMA B type.
Stator winding shall be of the open type with Class B insulation good for 130 degrees C. maximum
temperature. Winding housing shall be filled with a clean high dielectric oil that lubricates bearings and
seals and transfers heat from winding and rotor to outer shell. Air -filled motors which do not have the
superior heat dissipating capabilities of oil -filled motors shall not be considered equal.
Motor shall have two heavy duty ball bearings to support pump shaft and take radial and thrust loads.
Ball bearings shall be designed for 50,000 hours B-10 life. Stator shall be heat shrunk into motor
housing. On single phase motors a line break overload shall be attached to the windings to'stop the
motor if the temperature of the winding is more.than 130 degrees C. This overload will automatically
reset when the motor cools to safe operating.temperature. On three phase motors overcurrent protec-
tion should be provided in the control panel.. The common pump -motor shaft shall be of 416 stainless
steel.
SEAL — Motor shall be protected by a mechanical seal. Seal faces shall be lubricated by the oil -filled
motor housing above seal. Seal faces shall be carbon and ceramic and lapped to a flatness of one light
band. Seal faces of tungsten carbide are optional.
IMPELLER — The impeller shall be cast ductile iron and of the 2 vane non -clog enclosed type. Vane
inlet tips shall be carefully rounded to prevent_stringy material from catching in vanes. Pump -out vane
shall be used in front and back chamber. Impeller shall be dynamically balanced.
Impeller to be driven by stainless steel shaft tiey.and impeller held in place with lock screw and washer.
Impeller and motor shall lift off of case as a unit without disturbing discharge piping.
PUMP CASE — The volute case shall be cast iron and have a flanged center line discharge: Dis-
charge flange shall be three (3) inch standard.with bolt holes straddling center line. The volute shall
have integrally cast legs for mounting pump on bottom of wet well.
PUMP AND MOTOR CASTING — All castings shall be of high tensile cast iron and shall be treated
with phosphate and chromate rinse.

All fasteners shall be 302 stainless steel.
POWER CABLES — Power cable shall be double sealed. Cable entry into cord cap shall be sealed by
a cord grip fitting. Individual wire entry into top, of motor housing shall be sealed by a rubber compres-
sion sealing grommet.

Impeller to be driven by stainless steel shaft key and impeller held in place with lock screw and washer.
Impeller and motor shall lift off of case as a unit without disturbing discharge piping.
PUMP CASE — The volute case shall be cast iron and have a flanged center line discharge. Dis-
charge flange shall be three (3) inch standard with bolt holes straddling center line.
PUMP AND MOTOR CASTING — All castings shall be of high tensile cast iron and shall be treated
with phosphate and chromate rinse.
All fasteners shall be 302 stainless steel.
POWER CABLES — Power cable shall be double sealed. Cable entry into cord cap shall be sealed by
a cord grip fitting. Individual wire entry into top, of motor housing shall be sealed by a rubber compres-
sion sealing grommet.
Insulation of power cable shall be type SOW/SOW-A.
