Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Storm water Regulations set forth in Title 15A NCAC 21-1.1000. We are forwarding Permit No. SW8 g8O346 dated June 24, 1gg8, for the construction of Tiara Yachts. This permit shall be effective from the date of issuance until June 24, 2008, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in Future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an odjudicatory hearing upon written request within thirty (30) days Following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 15013 of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Deed restrictions must be recorded prior to the sale of any outporcel or future area shown on the approved plans to ensure that future owners are made aware of the built -upon area limitations. The following statement must be recorded: "To ensure continued compliance with the NC Division of Water Quality Stormwater Management Permit Regulations, 15A NCAC 2H.1OOO, the future area as shown on the approved plans is limited to 75,000 square feet of built -upon area, inclusive of that portion of the rigkt-of-way between the front lot line and the edge of the pavement, structures, pavement, walkways of brick, stone, slate, but not including wood decking or the water surface of swimming pools." Tke permittee will comply witk the following schedule for construction and maintenance of tke stormwater management system: a. Tke stormwater management system shall be constructed in it's entirety, vegetated and operational for its intended use prior to tke construction of any built -upon surface except roads. b. During construction, erosion shall be kept to a minimum and any eroded areas of tke system will be repaired immediately. Fi State Stormwater Management Systems Permit No. SW8 980346 2. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 montks). b. Sediment removal in the basin, control boxes, and EnviroChombers. C. Immediate repair of eroded areas of the site.. d. Mowing, revegetation and maintenance of side slopes of the basin in accordance with approved plans and specifications. e. Debris removal, repair and unclogging of bypass structures, control boxes, catch basins and piping. F. Access to the infiltration units and basin must be available at all times. g. The vegetated filter will be kept grassed with no erosion. The spreader mechanism will be kept clear. 3. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 4. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. S. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. 6. A copy of the recorded deed restrictions must be submitted to the DWQ within 30 days of the date of the recording. A copy of tke approved plans and specifications skall be maintained on file by tke Permittee for a minimum of ten years from tke date of tke completion of construction. s. Prior to tke sale of any portion of tke property, an access1maintenance easement to tke stormwater facilities skall be granted in favor of tke permittee if access to tke stormwater facilities will be restricted by tke sale of any portion of tke property. III• GENERAL CONDITIONS 1- Tkis permit is not transferable. In tke event tkere is a desire for tke facilities to ckange ownership, or tkere is a name ckange of tke Permittee, a formal permit request must be submitted to tke Division of Water Quality accompanied by an application fee, documentation from tke parties involved, and other supporting materials as may be appropriate. Tke approval of this request will be considered on its merits and may or may not be approved. 2. Failure to abide by tke conditions and limitations contained in tkis permit may subject tke Permittee to enforcement action by tke Division of Water Quality, in accordance witA Nortk Carolina General Statute 1-443-215.6A to 143-215.6C. 3. Tke issuance of this permit does not preclude the Permittee from complying witk any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (loca(, state, and federal) wkick leave jurisdiction. 4. In tke event tkat tke facilities fail to perform satisfactorily, including tke creation of nuisance conditions, tke Permittee skall take immediate corrective action, including tkose as may be required by tkis Division, suck as tke construction of additional or replacement stormwater management systems. 5. Your Item #1 The correct number for the control box into the infiltration pond is "21" and has now been properly numbered. The remaining boxes numbered I through 20 have had corrections made to their weir height to avoid the overlap of the numbers. Your Item #2 We concur with your drawdown scenario. Your Item #3 The Envirochamber is open at the bottom. It has been denoted on the plans. We hope the foregoing resolves your concerns. The "revised" Stormwater Management Plan sheet was not revised in two places. The control boxes were not renumbered on the "Control Box #1-20" detail, and the "Control Box #21" detail was not renumbered to #6. Please make these reivisions and submit 2 copies of the plans. 2. Page 5 of the March 27, 1998, calculations indicates that a drawdown rate of 0.6" per hour was used, not 6" per hour. That is part of the reason why I was confused as to how the drawdown time was computed. For stormwater calculations purposes, I convert inches per hour to cubic feet per hour per square foot, and use the surface area available for infiltration and the volume provided to determine the drawdown time. Each unit provides a bottom surface area of 34" by 75", or 17.7 square feet, and a volume of 87 gallons, or 11.63 cubic feet. Assuming that 6" per hour is the correct rate, that converts to .5 cubic feet per hour per square foot. The drawdown time per unit would be 1.3 hours. 3. Neither the details nor the literature provide an indication of how the runoff stored in the infiltrator gets through the bottom into the underlying soil? At the time of the April 27 memo, the line had been re -delineated and surveyed, and changes made to accommodate the new line. Once again, as I stated in the memo, the applicant chose to submit the new design without first having the wetland line confirmed. The line was checked on May 12, and was found to have minor changes. There is only one place in which the proposal will affect the project as designed. On the southeast side of the tract, the road right-of-way will now encroach upon approximately 500 square feet of Section 404 Wetlands. This area will be graded and filled. The original Section 404 Wetland impacts to be incurred by this project were stated as 5708 square feet. The new calculation will total approximately 6208 square feet. Type of Development aaod nSW_do34(p Tiara Yachts is proposing to acquire and partially develop on a 39.155 tract currently owned and operated by Outboard Marine Corporation. The upland development activities consist of the phased construction of two buildings and parking lots with necessary service streets. Marine development will also take place on the area adjacent to Goose Creek to facilitate future marine operations. All development taking place on the tract will comply with approved plans and specifications for the installation of utilities and construction of marine, building, street, and drainage improvements. 2. Earth Disturbing Activities a. Clearing and grubbing of trees located within the proposed street right-of- way, drainage and utility easements. b. Proposed drainage will primarily take the form of infiltration, vegetated swales, and sheet run-off. 4. Soil Classification Soils contained on the site consist of the following types: Wando and Seabrook soil types.. These types are upland soils with sand to loamy sand textures.. B. Erosion and Sedimentation Control Measures Due to the substantial sand content at this site, proper attention shall be required for erosion and sedimentation control measures. Various levels of control are proposed on the plan. If it becomes evident that additional erosion and sedimentation control measures are needed, they shall be installed immediately. It is intended that all grading and excavation activities within a certain area will be protected as soon as that activity is complete, i.e., drainage swales, utility easements, etc. 1. Silt Fence - Silt fence will be utilized as necessary in locations as shown on plans or as deemed necessary by the engineer to insure that off -site sedimentation in controlled. 2. Silt Basins and/or Check Dams - Silt basins and/or check dams shall be installed at locations shown to allow suspended solids time to settle out. 3. Seeding - All disturbed areas will be seeded within 30 days following construction in accordance with the seeding schedule shown on plans. C. Time Sequence of Operations 1. Clear and grub right-of-ways, drainage, and utility easements. 2. Install stone construction entrance. 3. Rough grade street system, detention pond, and outlet ditch and rip rap. 4. Coastal Stormwater Regulations The North Carolina Division of Environmental Management implemented coastal stormwater regulations in coastal counties on January'1, 1988. these regulations are detailed in 15 NCAC 211.1000 Stormwater Runoff Disposal. These rules allow for a development to consider density options as a passive means to reduce water quality impacts. Tract located at the end of NCSR 1507, Swansboro South area, Onslow County, North Carolina. TO: Tiara Yacht Company c/o Mr. Ron Cullipher, PE Stroud Engineering Company, PA 151-A NC Hwy 24, Hestron Plaza ll, Suite A Morehead City, NC 28557 (919) 247-7479 The land & soils within portions of the Tiara Yacht Tract (-44 acres) were evaluated to determine potential suitability for on -site stormwater treatment usage. NCDEH&NR "Stormwater Runoff Disposal" rules and regulations (NCAC 15-2H-.1000) were used as guidelines in making this evaluation. Portions of the tract were also evaluated for potential 404-CAMA Wetland areas. The 1987 "Federal Wetlands Delineation Manual" and NCDEH&NR-DCM CAMA regs were used to determine these wetland areas. The proposed project is greater than 1 acre in size, has >25% impervious surfaces, drains to Class O.R.W., S.A. or S.C. Waters, and is within 1/2 mile of these classified surface waters. If a project drains to Class SC or Unclassified Waters, stormwater may be treated by detention ponds or infiltration basins. If the development project is within 1/2 mile of and drains directly to Class SA Waters or their unclassified tributaries, stormwater must be treated by infiltration basins or an equivalent alternative method. The tract has previously been determined to be geographically located within 1/2 mile of Class S.A. or O.R.W. Waters to the south and west, thus stormwater is to be treated through infiltration basins. This tract has broad sandy ridgetops, that slope (-3-10%) to poorly drained flats and drainageways. The southern portion has been historically filled to varying degrees with sandy dredge spoils from maintenance of intracoastal Waterway to the south and a dredged basin to the west. Principle soil and site requirements for an infiltration system are: —the infiltration system's bottom must be 2 ft or greater from the seasonal high water table; —must be capable of complete draw -down within 5 days; —the soil's hydraulic conductivity must be >0.52 in/hr; —recent fill material is not usable. The enclosed land & soils map shows the various land/soil types found (see map). The following are brief descriptions of these land & soil types for stormwater infiltration usage: Page 2. Tiara Yacht Tract, Stormwater & Wetlands The 'YELLOW" Areas (see map) are moderately well drained, deep sandy soils. These soils have an estimated seasonal high water static water table between +30 to 55 inches from the surface based upon soil wetness indicators. Estimated permeability is +5-10 min/in (+6-12 in/hr) to +60" depths. These soil types should be considered as suitable for shallow or ultra - shallow placed (0 - 2.5 ft bottom depths) infiltration basin system with constructed sidewall berms due to seasonal high water table depths. Soil types found are Seabrook and Wando. The tract is relatively uniform within the respective soil groups delineated on the enclosed map. The major variations are depths to seasonal high water table indicators. The better sites for stormwater infiltration system usage are on the higher elevations, with marginal to unsuitable sites being at intermediate to lower elevations. Careful planning and design should be exercised to insure usable soil areas are reserved for stormwater infiltration treatment, and relatively preserved in their natural state. Otherwise, the usable soil areas could be degraded to an unsuitable status for stormwater infiltration basins. Soil logs can be provided upon request. The'GRAY-MARSH SYMBOL" Areas (see map) are considered to be jurisdictional 404 Wetlands that meet all the hydric soil & vegetative criteria, and hydrology to be defined as such and come under U.S. Army Corps/EPA jurisdiction. These areas cannot be filled or surficially disturbed for a change in land -use unless the proper Federal & State permits can be acquired. These 404 wetlands are likely to be considered as "adjacent" wetlands and not eligible for many of the nationwide fill permits. The 404 Wetland areas of concern were delineated in the field with "pink/black-striped" flagging. The'WHITE-MARSH SYMBOL" Areas (see map) are considered to be jurisdictional CAMA-404 Wetlands that meet all the hydric soil & vegetative criteria, and hydrology to be defined as such and come under NCDEH&NR-DCM-CAMA and U.S. Army Corps/EPA jurisdictions. These are the tidally influenced wetland areas. These areas cannot be filled or surficially disturbed except for water dependent structures such as piers, docks, boat ramps, and etc. which also requires permitting. The CAMA AEC zone is 575' landward of O.R.W. mean high tide and 75' landward of other mean high tide lines. These were evaluated but not delineated in the field. Careful planning and design should be exercised to avoid wetland areas and preserve usable areas for stormwater treatment.
