All previous references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please note that any updated pages or addendums to this permit will now reference DEMLR as the Division responsible for issuance of the permit On September 15, 2015, the Wilmington Regional Office received a request to renew and transfer the subject state stormwater management permit under the provisions of Session Law 2013-121. Staff of DEMLR has inspected the project and reviewed the available documentation, and determined that the project is currently not in compliance with the terms and conditions of the state stormwater permit. As part of the transfer of this permit, you are required to submit a modification that will address the subsequent subdivision, additions and construction of the property since the original permit was issued. The Division has determined that the provisions of SL 2013-121 have been met as indicated by the supporting documents and findings listed below: 1. The successor -owner of the property has submitted a written request for the transfer of the permit. Reference is made to the attached signed Name/Ownership Change Form; 2. The original permit holder, Kenneth Bridges and 904 Storage, Inc., was lawfully and finally divested of title to the property on which the permitted activity is occurring. DESIGN STANDARDS This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.5 of this permit. The stormwater control has been designed to handle the runoff from a maximum of 121,347 square feet of impervious area. 3. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 4. The tract will be limited to the amount of built -upon area indicated in Section 1.5 of this permit, and per approved plans. 5. The following design parameters have been approved for this wet detention pond BMP and must be maintained at design condition: a. Drainage Area, acres: 3.03 b. Impervious Area, sf: 121,347 c. Pond Design Depth, feet: 6.0 d. Permanent Pool Surface Area, sf: 7,505 e. Permanent Pool Elevation, fmsl: 37.5 f. Temporary Pool Volume, cf: 10,369 g. Temporary Pool Elevation, fmsl: 38.7 h. SCHEDULE OF COMPLIANCE The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -upon area. The permittee shall submit revised plans and specifications, and receive approval for any of the following modifications to the permit, prior to construction: a. Any revision to the approved plans, regardless of size. b. Redesign or addition to the approved amount of built -upon area. e. Changes to or further subdivision or sale of the project area, in whole or in part. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 3. The Director may determine that other revisions to the project should require a modification to the permit. 4. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 5. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface except roads. 6. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 7. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. c. Mowing and revegetation of side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping. g. Access to the outlet structure must be available at all times. 8. Records of maintenance activities must be kept and made available upon request to authorized personnel of DEQ / DEMLR. The records will indicate the date, activity, name of person performing the work and what actions were taken. 9. The facilities shall be constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data as on file with the Division and which is made an enforceable part of this permit. 10. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. 11. The permittee shall maintain this permit, and a copy of the approved plans on file at all times. Prior to the subdivision and/or sale of any portion of the property, an access/maintenance easement to the stormwater facilities shall be granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale or subdivision. III. GENERAL CONDITIONS This permit is not transferable to any person or entity except after notice to and approval by the Director. The permittee shall submit a completed and signed Name/Ownership Change Form, accompanied by the supporting documentation as listed on the form, to the Division of Energy, Mineral and Land Resources at least 60 days prior to any one or more of the following events: a. An ownership change including the sale or conveyance of the project area in whole or in part, except in the case of an individual lot sale that is made subject to the recorded deed restrictions; b. The sale or conveyance of the common areas to a Homeowner's or Property Owner's Association, subject to the requirements of Session Law 2011-256; c. Bankruptcy; d. Foreclosure; e. Dissolution of the partnership or corporate entity; f. A name change of the current permittee; g. A name change of the project; h. A mailing address change of the permittee; Any individual or entity found to be in noncompliance with the provisions of a stormwater management permit or the stormwater rules is subject to enforcement action as set forth in North Carolina General Statute 143 Article 21. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. In the event that the facilities fail to perform satisfactorily, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants DEQ Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. The permittee shall submit a renewal application and fee at least 180 days prior to the expiration date of this permit. Permit renewed, transferred and reissued this the 31 day of November 2015. The only reference to a "letter' is the combined renewal and transfer letter that I mentioned today in our meeting. Our database is only set up to handle one "bean counting" at a time. The renewal, the transfer and the modification of this permit are 3 separate "beans" that must be entered into the database and "issued" one after the other in proper succession. Once I get the signed renewal application, I will enter that into our database as the first "bean" and "issue" it. The next day, I will enter the transfer into the database as the second "bean" and "issue" it. Then, I will compose a single letter approving of both the renewal and the transfer. Once Mr. Lampe receives that letter, then we can accept a request from him as the permittee to modify the permit, as we discussed this morning. All previous references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please note that this letter references DEMLR as the Division responsible for issuance of the permit. On May 8, 2015, the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources (DEMLR) conducted a file review of Sunset Beach Mini Storage located at 318 Seaside Road near Sunset Beach in Brunswick County. This project file was reviewed because there have been several ownership changes, but the associated stormwater permit has not been transferred to each successive owner as required. The Division is interested in making sure that you either apply to renew and transfer the existing stormwater permit or that you apply for a new permit so that you will be in compliance with the coastal stormwater management rules under 15A NCAC 02H.1000. The project known as 904 Storage was originally approved under permit #SW8 970233 issued to 904 Storage, Inc. (Joe Johnson & Kenneth Bridges) on April 6, 1998. The permittee received a Notice of Inspection and Non -Compliance on October 1, 2008, which included cites for failing to follow the approved plan, failing to construct the permitted system and failing to renew the permit. The permittee denied any responsibility for the permit because he sold the property in 2003. However, the permit requires that the permittee notify the Division prior to the sale of the property so that the permit can be transferred to the new owner. The permittee failed to notify the Division of the sale of the project and the permit was not transferred to the new owner. The Division put the new owner, Ronald D. Griffin, Jr., under Notice of Violation on November 23, 2009 and requested that he apply for a permit to deal with the existing development, the lack of adequate stormwater controls, the expired permit and his failure to obtain a permit for the development. Mr. Griffin advised us on December 10, 2009, that he purchased the property from Crescent Bank, that no improvements to the property had occurred, and that a stormwater plan had been filed. However, the site layout plan prepared in April 2009, by James L. Walters, P.E., with Latham -Walters Engineering, Inc. in Huntersville, NC, was never submitted to the Division for review nor has a stormwater permit been issued to Mr. Griffin. In the meantime, the Governor signed two (2) different session laws (one in 2010 and the other in 2011) that extended the effective period of the permit to April 6, 2012. Per the Brunswick County Tax records, it appears that you are the current owner of this property. Since there is no active permit for this site, you are currently discharging to waters of the state without a permit which is a violation of NCGS 143-215.1. Therefore, your options are to: 1) have the existing permit renewed and then transferred to you; or 2) Apply for a new permit to cover the existing and any future development associated with Sunset Beach Mini Storage. That there were insufficient stormwater control measures installed with the majority of the runoff from the impervious surfaces going untreated. DWQ also observed the installation of a storage basin for runoff that discharges into a ditch along the front of the subject property, which constitutes an unauthorized outlet to waters of the state. A review of DWQ files confirmed that no State Stormwater Management Permit has been issued prior to construction of impervious surfaces at the subject site as described above. As a result of the site inspection and file review, the following violations are noted: I.
