Guidelines for Access: The staff of Wilmington Regional Office is dedicated to making public records in
our custody readily available to the public for review and copying. We also have the responsibility to the
public to safeguard these records and to taffy out our day-to-day program obligations. Please read
carefully the following guidelines signing the form:
1. Due to the large public demand for file access, we request that you call at least a day in
advance to schedule an appointment to review the files. Appointments will be scheduled
between 9:00am and 3:00P& Viewing time ends at 4:45pm Anyone arriving without an
appointment may view the files to the extent that time and staff saperyisfon is available.
2. You must specify files you want to review by facility name. The number of files that you
may review at one time will be limited to five.
3. You may make copies of a file when the copier is not in use by the staff and if time permits.
Cost per copy is $.05 cents. Payment may be made by check; money order, or cash at the
reception desk. Copies totalma $5 00 or more can be invoiced for your convenience..
4. FILES MUST BE KEPT IN ORDER YOU FOUND THEM. Files may not be taken from
the office. To remove, alter, deface, mutilate, or destroy material in one of these files is a
misdemeanor for which you can be fined up to $500.00. No briefcases large totes. etc. are
pemaitted in the file review area
5. In accordance with General Statue 25-3-512, a $25.00 processing fee will be charged and
collected.for checks on which payment has been refused

Please find attached a copy of the completed form entitled "Stormwater Compliance Inspection
Report". The report summarizes the findings of a recent inspection of the project's stormwater
controls conducted on September 10, 2008 to determine compliance with Stormwater Permit
Number SW8 970233 issued on April 6, 2008.
A summary of the findings and comments are noted under Section 4 of the report. Please
inform this Office in writing before November 3, 2008, of the specific actions that will be
undertaken and the time frame required to correct the deficiencies. Failure to provide the
requested information, when required, may initiate enforcement action. If you have any

1. It appears that the approved plan was not followed during the construction of
this project and the property boundaries have changed since the original
submittal. Please submit a modification to address the deviations from the
approved plan.
It appears that the approved stormwater collection system was. never
installed. This matter should be resolved immediately to prevent further
untreated stormwater from polluting surrounding surface waters of the state.
Please submit a modification to address the deviations from the approved
plan.
3. This office never received a Designers Certificate please submit this
document once all violations have been resolved.
4. Please be reminded that your state stormwater permit expired on April 6,
2008 and the operation of a stormwater treatment facility without a valid
permit, is a violation of NC General Statue 143-215.1 and may result in
appropriate enforcement action including the assessment of civil penalties of
up to 10,000 per day. This office sent you a renewal package on July 7, 2007
to this date we have received no response.

This letter is to notify you that the Wilmington Regional Office of the Division of Water Quality is considering
sending a recommendation for enforcement action to the Director of the Division of Water Quality. The
recommendation concerns the violation of North Carolina General Statute 143-215.6A (a)(4); failing to submit
requested information. According to your engineer's August 14, 1997, letter, a Stormwater Management Permit
Application package was to be submitted by early September. You have failed to make application.
If you have an explanation for this violation that you wish to present, please respond in writing to me within
ten (10) days following receipt of this Nofice. Your explanation will be reviewed and if an enforcement action is still
deemed appropriate, your explanation will be forwarded to the Director with the enforcement package for his
consideration.

On February 20, 1997, personnel of this office inspected a project located Hwy 904 just east
of US Hwy ' 17 in Cape Fear County, North Carolina. This inspection was performed to determine
compliance with the North Carolina Sedimentation Pollution Control Act of 1973. The inspection
revealed a land -disturbing activity of approximately 1.3 acres being conducted.
It is our understanding that you and your firm are responsible for this land -disturbing activity.
The purpose of this letter is to inform you that this activity was found to be in violation of the Act,
NCGS 113A-50 to 66, and Title 15A, North Carolina Administrative Code, Chapter 4. If you feel that
you are not responsible for the following violations, please notify this office immediately,
The violations that were found are: s
1. Failure to file an erosion and sedimentation control plan with this office at least 30 days"prior
to beginning a land -disturbing activity on a tract comprising more than one acre, when more
than one acre is to be uncovered, failure to secure this office's prior approval of the plan for
any land -disturbing prior to beginning the land -disturbing activity. NCGS 113A-57(4) and"'! 5A
NCAC 4B.0007(c)
An erosion and sedimentation control plan has not been submitted for the referenced project.
2. Failure on a tract of more than one acre, when more than one acre is uncovered, to install
11, sedimentation and erosion control devices sufficient to retain the sediment generated by the
land -disturbing activity within the boundaries of the tract during construction upon and

Measures to control erosion and retain sediment on site have not been installed. Some run off
around the drive way and culvert has resulted in sediment accumulation in the NC 904 Right -
Of -Way ditch.
To correct these violations, you must:
1. Submit an approvable erosion and sedimentation control plan to this office for the referenced

2. Install the measures structures and/or devices necessary to control erosion and retain sediment

Please be advised that if these violations are not corrected within 20 days of receipt of this
notice, the Director,". Division of, Land Resources, will be requested to take appropriate legal action
