Effective August 1, 2013 the State Stormwater program has been transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous references to
DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please
note that this permit will now reference DEMLR as the Division responsible for issuance of the permit.
The Wilmington Regional Office received a complete 8 year Stormwater Management Permit Renewal
Application for Kure Dunes Phase IV on July 7, 201 T The Division is hereby notifying you that permit SW8
961234 has been renewed on September 13, 2017, and shall be effective until January 21, 2022. For your
records, please find enclosed a renewed, updated; and re -issued permit and a copy of the renewal application.
Please keep this permit on file at all times. Please note that the renewed, updated, and re -issued permit does
not impose new or different terms, it merely restates some of the previous terms to provide you with a better
understanding of your obligations under the permit.
The renewal and reissuance of this stormwater permit does not imply that the site is currently in compliance
with the terms and conditions of this state stormwater permit. The plans originally approved on September 18,
1997 and subsequently modified on January 21, 2000, will remain in full force and effect in accordance with
the regulations set forth in Title 15A NCAC 2H.1000 effective September 1, 1995.
This permit is subject to the conditions and limitations as specified therein. Please pay special attention to the
conditions listed in this permit regarding the Operation and Maintenance of the BMP(s), recordation of deed
restrictions, procedures for changes of ownership, transferring the permit, and renewing the permit. Failure to
establish an adequate system for operation and maintenance of the stormwater management system, to record
deed restrictions, to transfer the permit, or to renew the permit, will result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable; you have the right to
request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH).
The written petition must conform to Chapter 150B of the North Carolina General Statutes; and must be filed
with the OAH within thirty (30) days of receipt of this permit. You should contact the OAH with all questions
regarding the filing fee (if a filing fee is required) and/or the details of the filing process at 6714 Mail Service
Center, Raleigh, NC 27699-6714, or via telephone at 919-431-3000, or visit their website at

construction, operation and maintenance of one (1) detention pond and one (1) underground infiltration trench
in compliance with the provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules') and
the approved stormwater management plans and specifications and other supporting data as attached and on file
with and approved by the Division of Energy, Mineral and Land Resources and considered a part of this permit.
This permit shall be effective from the date of issuance until .January 21, 2022 and shall be subject to the
following specified conditions and limitations:
1. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater described in the
application and other supporting data.
2. This stormwater system has been approved for the management of stormwater runoff as described on
page 3 of this permit, the Project Data Sheet. The stormwater detention pond has been designed to
handle the runoff from 185,698 f12, and the infiltration gallery has been designed for 19,563 ft2 of
impervious area, and includes lots, clubhouse area; roads, and parking, as shown on the drainage area
map.
3. Approved plans and specifications for this project are incorporated by reference and are enforceable
parts of the permit.
4. The tract will be limited to the amount of built -upon area indicated on page 3 of this permit, and per
approved plans.
5. Each of the 40 lots in the subdivision is restricted to a maximum amount of built -upon area, as tabulated
on the attachment to the application. 5 of this permit for the specific allowable 13UA per lot.

IL SCHEDULE OF CON IPLIANCE
The stormwatcr management system shall be constructed in its entirety, vegetated and operational for its
intended use prior to the construction of any built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be
repaired immediately.
3. The permittee is responsible for verifying that the proposed built -upon area does not exceed the
allowable built -upon area.
4. The following items will require a modification to the permit:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
e. Further subdivision of the project area.
f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan.
g. The construction of permeable pavement for BUA credit.
5. The Director may determine that other revisions to the project should require a modification to the
permit.
6. The Director may notify the permittee when the permitted site does not meet one or more of the
minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall
submit a written time schedule to the Director for modifying the site to meet minimum requirements.
The permittee shall provide copies of revised plans and certification in writing to the Director that the
changes have been made.
7. The permittee shall at all times follow the approved Operation and Maintenance plan to assure the
permitted stormwater system functions at optimum efficiency. Maintenance must occur at the scheduled
intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of trenches; outlet/bypass structures, orifice, catch basins and
piping.
g. Access to the outleUbypass structure must be available at all times.
h. Annual cleaning/testing of the infiltration trench system.
8. Records of maintenance activities must be kept and made available upon request to authorized personnel
of DEMLI2. The records will indicate the date, activity, name of person performing the work and what
actions were taken.
9. The facilities shall be constructed, operated and maintained in accordance with the provisions of this
permit, the approved plans and specifications, and the supporting documents attached to this permit and
on file with the Division.

10. Upon completion of construction; prior to issuance of a Certificate of Occupancy; and prior to operation
of this permitted facility; a certification must be received from an appropriate designer for the system
installed certifying that the permitted facility has been installed in accordance with this permit, the
approved plans and specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification.
11. Prior to the sale of any lot, deed restrictions must be recorded which limit the built -upon area per lot to
the amount as shown on the Project Data Sheet, per Section I, Part 2. A copy of the recorded deed
restrictions, including the statements below, must be received within 30 days of the date of recording:
a. "The maximum built -upon area per lot is _* square.fect, and includes that portion of the
right-of-way between the lot line and the edge of pavement; structures; pavement; brick; stone;
gravel, slate, coquina, and parking areas, but does not include raised; open wood decking; or the
water surface of swimming pools."

b. "The covenants pertaining to stormwater regulations may not be changed or deleted without
concurrence of the State."
C. "Alteration of the drainage as shown on the approved plan may not take place without the
concurrence of the State."
d. "All runoff on the lot must drain into the permitted system. This may be accomplished through
providing roof drain gutters which drain to the street, grading the lot to drain toward the street, or
grading perimeter swalcs and directing them into the pond or street. Lots that naturally drain into
the system are not required to provide these measures."
12. A copy of the recorded deed restrictions must be sent to the Division within 30 days of the date of
recording.
13. A copy of the approved plans and specifications shall be maintained on file by the Pennittee for a
minimum of ten years from the date of the completion of construction.
14. An access/maintenance casement to the stormwater facilities shall be granted in favor of the permitter
for the operation and maintenance of the facility.

15. The permittee is responsible for compliance with all permit conditions until such time as the Division
approves the transfer request. Neither the sale of the project, in whole or in pail, nor the conveyance of
common area to a third party constitutes an approved transfer of the stormwater permit.
16. Decorative spray fountains will not be allowed in the stornnvater treatment system until calculations are
provided documenting the permeant pool volume is greater than 30.000 cubic feet.
17. If the use of permeable pavement for BUA credit within the lot is desired, the permittee shall direct the
lot owner to submit an application with all supporting documentation and the application fee to the
Division and receive a permit prior to construction of the permeable pavement.
18. The permittee shall submit a permit renewal application request at least 180 days prior to the expiration
date of this permit. The renewal request must include the appropriate documentation and the processing
fee.
III. GFIN7RAL CONDITIONS
This permit is not transferable to any person or entity except after notice to and approval by the Director.
The permittee shall submit a completed and signed Name/Ownership Change Form, accompanied by the
supporting documentation as listed on the form. to the Division of Energy, Mineral and Land Resources
at least 60 days prior to any one or more of the following events:
a. An ownership change including the sale or conveyance of the project area in whole or in part,
except in the case of an individual lot sale that is made subject to the recorded deed restrictions:
b. The sale or conveyance of the common areas to a Homeowner`s or Property Owner's
Association, subject to the requirements of Session Law 201 1-256;
c. Bankruptcy:
d. Foreclosure. subject to the requirements of Session Law 2013-121:
e. Dissolution of the partnership or corporate entity, subject to NCGS 57D-2-01(e) and NCGS 57D-
6-07;
f. A name change of the current permittee;
g. A naive change of the project;
It. A mailing address change of the permittee;
2. Any individual or entity found to be in noncompliance with the provisions of this stormwater
management permit or the requirements of the stomiwater rules is subject to enforcement procedures as
set forth in NCGS 143 Article 21.
The issuance of this permit does not preclude the Permittee from complying with any and all statutes,
rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and
federal) which have jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions,
the Permittee shall take immediate corrective action, including those as may be required by this
Division, such as the construction of additional or replacement stormwater management systems.
The permittee grants DEI-tNR Staff permission to enter the property for the purpose of inspecting all
components of the permitted stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a
permit modification, revocation and rcissuance or termination does not stay any permit condition.

that stormwater management permits, issued for projects that require the construction of engineered stormwater,
control measures (High Density Permits), shall be required to submit an application to renew the permit 180 days

As for your inquiries about multiple permits (SW8 961234 — per your letter, plus SW8 920807 — Kure Dunes Phase II
issued to Town of Kure Beach, and SW8 950709 — Kure Dunes Phase III issued to Kure Beach Associates (a dissolved
LLC)):
• 1 have cced our stormwater runoff committee members, Terry Youngbluth and Vince DeFritas, and — assuming
SW8 961234 is indeed our operative permit — we will get our update materials in order and over to you;
This is the only permit currently issued to Kure Dunes HOA.

• As for the Town's permit, SW8 920807, the Town of Kure Beach filled in our pond servicing the subject runoff
area and diverted the runoff to one of our southern neighboring HOA, Beachwalk's ponds, so this should now be
an "offsite permit," yes? I assume the permit reflects this? Regardless, our contact with the Town of Kure Beach
is David Heglar([e-mail]), and I am sure he can rectify the inconsistent expiration
issues with you.
In addition to the offsite portion, this permit approves the use of underground infiltration trenches to treat a
portion of the runoff. Likely the areas draining to these trenches either couldn't drain to the offsite ponds or the
ponds didn't have enough capacity to handle this area.
• Finally, as to SW8 950709 (Kure Dunes Phase III), assuming this permit encompasses our northernmost runoff
area's diversion into our northern HOA neighbor, The Keys at Kure Beach HOA's retention pond, this is offsite
treatment as well, so assuming there is no expiration issue for the permit, the only issue is transferring the name
under the permit, which now should also be the Kure Dunes Homeowners'Association, Inc., yes?
If the project has been built and has been turned over to the HOA, then the permit should be transferred to the
HOA.

No problem. I'm just glad to get the information to where it needs to go. Here's a pdf of the letter that sent in mid -
September to 522 Anchor Way regarding SW8 961234 but was returned in mid -October as "No mail receptacle unable to
forward". I can update this letter if given a current mailing address.
There also seems to be two other Kure Dunes permits:
- SW8 920807 — Kure Dunes Phase II issued to Town of Kure Beach. The latest version of this permit dated
October 8, 1998 has conflicting information regarding the expiration of the permit. The cover letter says it does
not expire, however the permit says it expired on October 8, 2008. Being a high density permit with
underground infiltration devices, it should have had an expiration date.
SW8 950709 — Kure Dunes Phase III issued to Kure Beach Associates (a dissolved LLC). The latest version of this
permit dated October 8, 1998 has the same conflicting information on the expiration date. However, this one
being solely an offsite permit should not have an expiration date. Being that the permittee is dissolved, the

permit will have to be transferred to the HOA (or other responsible entity), likely under the provisions of SL
2013-121.
I will likely issue corrections to clarify that SW8 920807 has an expiration date and that SW8 950709 does not. Please

Effective August 1, 2013 the State Stormwater program has been transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous
references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are
modified, transferred, or renewed. Please note that this letter references DEMLR as the Division
responsible for issuance of the permit.
State Stormwater Management Permit 4SW8 961234 for the subject project was last issued on September
24, 2001 to Kure Dunes Homeowner's Association, Inc. and expired on January 21, 2014. Per 15A
NCAC 2H.1003(h) (the stormwater rules), applications for permit renewals shall be submitted 180 days
prior to the expiration of a permit and must be accompanied by a processing fee, which is currently set at
$505.00. Please complete and submit a renewal application prior to October 17, 2016. The renewal
application can be found at the following website under the Applications Forms section:
permits/stormwater-perutits/forms. Please note that if they have not already been submitted to the
Division, the permit renewal request must be accompanied by the required Designer's Certification and
the recorded documents (if applicable).
Additionally, it appears that the contact information for this corporation has changed. Please complete
the enclosed Permit Update Form to correct your contact information.
Please be advised that you are required to comply with the terms, conditions and limitations of the
Stormwater Management Permit under Title 15A North Carolina Administrative Code 2H .1003 and
North Carolina General Statute 143-214.7 until you submit the required Name/Ownership Change Form
to the Division and receive approval from the Division to transfer the permit. This includes providing the
necessary operation and maintenance of the permitted stormwater system. The Name/Ownership Change

On February 16, 2016, the Division received your emailed request for information regarding the
pond discharge from Kure Dunes Phase IV (permit #SW8 961234) into the downstream pond for
The Keys at Kure Beach (permit #SW8 940217). My research has yielded the following
information:
1. Kure Dunes IV has their own permitted pond with an outlet structure and small diameter
orifice. They do not rely on The Keys at Kure Beach pond to treat their runoff.
2. After treatment in the Kure Dunes IV pond, the one -inch. design storm discharges from
the orifice over the course of approximately 3.9 days into a piped collection system in
Anchor Way that eventually drains into The Keys pond. At the request of the Division
during the review of the Kure Dunes IV application, an engineering analysis of the
impact of this discharge on The Keys pond was provided by Mark Hargrove, P.E.,
formerly of Dawson Engineering. The engineer concluded that the impact was negligible.
I attach a copy of Mr. Hargrove's summary to this letter. If you want a copy of the entire
engineering analysis (about 100 pages), please contact Cameron Weaver to schedule that
file review and pay for the copies.
3. A deed of easement was recorded on February 7, 1995, between Gulf Stream Developers,
Inc. (as Grantor) and Kure Beach Associates (as Grantee). Gulf Stream granted a 10-foot
easement along Anchor Way to Kure Beach Associates to construct a piped collection
system that connects into existing piping within Sloop Pointe Lane and conveys the Kure
Dunes IV pond discharge to The Keys pond.
4. The deed of easement endeavors to assure the full and complete use of the easement by
Kure Beach Associates, and indicates that Gulf Stream Developers, Inc. will "provide in
its Homeowners Documents a method for assuring the maintenance of the pond including
where applicable a joint maintenance agreement with Grantee in form acceptable to the
State of North Carolina and its pemtitting agencies." It is not the Division's responsibility
to require Gulf Stream to provide that maintenance assurance now. Please contact the
entities that are party to that deed of easement to negotiate the creation of the assured
maintenance agreement.

Charles Meier from Marshall, Gorham and Williams (local attorney) called me today. He
contacts me a lot about file reviews so he thought I could help him but I told him this is beyond
my realm. He asked that I pass the info on to you and ask that you give him a call.
SW8 961234 (which is EXPIRED) drains into SW8 940217. It is written into the permit and
there is a Deed of Easement in the file stating same. Charles represents the permitee of SW8
940217.
For years they have been trying to get SW8 961234 to assist in the cost of maintaining the
pond for SW8 940217 and they are refusing. I'm not really sure what the purpose of Charles
call is ...... it doesn't sound like anything we can get involved in (?), but he did say something
about the permit not being renewed - not sure if or how that works into this scenario at all.

processing fee.
Does this mean we need to include a copy of the original certificate of completion? Or do we need to obtain a new one
to certify the stormwater treatment system is currently working as designed?
2. Can you please check to make sure there are no additional outstanding permits for Kure Dunes Subdivision

On August 5, 2009, the Governor signed Session Law 2009-406. This law impacts any.
development approval issued by the Division of Water Quality under Article 21 of
Chapter 143 of the General Statutes, which is current and valid at any point between
January 1, 2008, and December 31, 2010. The law extends the effective period of any
stormwater permit that is set to expire during this time frame to three (3) years from its
current expiration date. On August 2, 2010, the Governor signed Session Law 2010-
177 which grants an extra year for a total of four (4) years extension.
Accordingly, Stormwater Permit # SW8 961234 which has already expired on January
21, 2010, is now in effect until January 21, 2014. Please resubmit the renewal
application and fee at least 180 days prior to January 21, 2014, which would be July 21,
2013. A copy of the Renewal Application can be obtained from the following website:

Dear Mr. Hearne:
The Division of Water Quality issued a Coastal Stormwater Management Permit, Number SW8961234
to Kure Beach Associates, for a High Density stormwater pond to serve Kure Dunes Phase IV on
9/18/1997. This permit will expire on 9/18/2007. Section .1003(h) of 15 A NCAC 2H .1000 (the
stormwater rules) requires that applications for permit renewals shall be submitted 180 days prior to the
expiration of a permit and must be accompanied by a processing fee, which is currently set at $420.00.
If this is still an active project please complete and submit the enclosed renewal application in a timely
manner. If this project has not been constructed and a permit is no longer needed, please submit a
request to have the permit rescinded. If you have sold the project, or are no longer the permittee,
please provide the name, mailing address and phone number of the person or entity that is now
responsible for this permit. Enclosed is a form for change of ownership, which should be completed and
submitted if the property has changed hands.
Your permit requires that upon completion of construction and prior to operation of the permitted
treatment units a certification of completion be submitted to the Division from an appropriate designer
for the system installed. This is to certify. that the permitted facility has been installed in accordance with
the permit, the approved plans, specifications and supporting documentation. Please include a copy of
the certification with your permit renewal request and processing fee. Enclosed is a copy of a sample
certification. Also enclosed is a new Operation and Maintenance agreement that should be completed
and submitted along with your renewal application.
You should be aware that failure to provide the Designer's Certification and the operation of a
stormwater treatment facility without a valid permit, are violations of NC General Statute 143-215.1 and
may result in appropriate enforcement action including the assessment of civil penalties of up to
$10,000 per day.
