REGAN Secretary TRACY DAVIS Director Effective August 1, 2013 the State Stormwater program has been transferred from the Division of Water Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please note that this permit will now reference DEMLR as the Division responsible for issuance of the permit. The Wilmington Regional Office received a complete 8 year Stormwater Management Permit Renewal Application for Kure Dunes Phase IV on July 7, 201 T The Division is hereby notifying you that permit SW8 961234 has been renewed on September 13, 2017, and shall be effective until January 21, 2022. For your records, please find enclosed a renewed, updated; and re -issued permit and a copy of the renewal application. Please keep this permit on file at all times. Please note that the renewed, updated, and re -issued permit does not impose new or different terms, it merely restates some of the previous terms to provide you with a better understanding of your obligations under the permit. The renewal and reissuance of this stormwater permit does not imply that the site is currently in compliance with the terms and conditions of this state stormwater permit. The plans originally approved on September 18, 1997 and subsequently modified on January 21, 2000, will remain in full force and effect in accordance with the regulations set forth in Title 15A NCAC 2H.1000 effective September 1, 1995. This permit is subject to the conditions and limitations as specified therein. Please pay special attention to the conditions listed in this permit regarding the Operation and Maintenance of the BMP(s), recordation of deed restrictions, procedures for changes of ownership, transferring the permit, and renewing the permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system, to record deed restrictions, to transfer the permit, or to renew the permit, will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable; you have the right to request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH). The written petition must conform to Chapter 150B of the North Carolina General Statutes; and must be filed with the OAH within thirty (30) days of receipt of this permit. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -upon area. 4. The following items will require a modification to the permit: a. Any revision to the approved plans, regardless of size. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area. e. Further subdivision of the project area. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. g. The construction of permeable pavement for BUA credit. 5. The Director may determine that other revisions to the project should require a modification to the permit. 6. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 7. The permittee shall at all times follow the approved Operation and Maintenance plan to assure the permitted stormwater system functions at optimum efficiency. Maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of trenches; outlet/bypass structures, orifice, catch basins and piping. g. Access to the outleUbypass structure must be available at all times. h. Annual cleaning/testing of the infiltration trench system. 8. Records of maintenance activities must be kept and made available upon request to authorized personnel of DEMLI2. The records will indicate the date, activity, name of person performing the work and what actions were taken. 9. The facilities shall be constructed, operated and maintained in accordance with the provisions of this permit, the approved plans and specifications, and the supporting documents attached to this permit and on file with the Division. Upon completion of construction; prior to issuance of a Certificate of Occupancy; and prior to operation of this permitted facility; a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. 11. Prior to the sale of any lot, deed restrictions must be recorded which limit the built -upon area per lot to the amount as shown on the Project Data Sheet, per Section I, Part 2. A copy of the recorded deed restrictions, including the statements below, must be received within 30 days of the date of recording: a. "The maximum built -upon area per lot is _* square.fect, and includes that portion of the right-of-way between the lot line and the edge of pavement; structures; pavement; brick; stone; gravel, slate, coquina, and parking areas, but does not include raised; open wood decking; or the water surface of swimming pools." "The covenants pertaining to stormwater regulations may not be changed or deleted without concurrence of the State." C. "Alteration of the drainage as shown on the approved plan may not take place without the concurrence of the State." d. "All runoff on the lot must drain into the permitted system. This may be accomplished through providing roof drain gutters which drain to the street, grading the lot to drain toward the street, or grading perimeter swalcs and directing them into the pond or street. Lots that naturally drain into the system are not required to provide these measures." 12. A copy of the recorded deed restrictions must be sent to the Division within 30 days of the date of recording. 13. A copy of the approved plans and specifications shall be maintained on file by the Pennittee for a minimum of ten years from the date of the completion of construction. 14. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. Neither the sale of the project, in whole or in pail, nor the conveyance of common area to a third party constitutes an approved transfer of the stormwater permit. 16. Decorative spray fountains will not be allowed in the stornnvater treatment system until calculations are provided documenting the permeant pool volume is greater than 30.000 cubic feet. 17. If the use of permeable pavement for BUA credit within the lot is desired, the permittee shall direct the lot owner to submit an application with all supporting documentation and the application fee to the Division and receive a permit prior to construction of the permeable pavement. 18. The permittee shall submit a permit renewal application request at least 180 days prior to the expiration date of this permit. The renewal request must include the appropriate documentation and the processing fee. III. GFIN7RAL CONDITIONS This permit is not transferable to any person or entity except after notice to and approval by the Director. The permittee shall submit a completed and signed Name/Ownership Change Form, accompanied by the supporting documentation as listed on the form. to the Division of Energy, Mineral and Land Resources at least 60 days prior to any one or more of the following events: a. An ownership change including the sale or conveyance of the project area in whole or in part, except in the case of an individual lot sale that is made subject to the recorded deed restrictions: b. The sale or conveyance of the common areas to a Homeowner`s or Property Owner's Association, subject to the requirements of Session Law 201 1-256; c. Bankruptcy: d. Foreclosure. subject to the requirements of Session Law 2013-121: e. Dissolution of the partnership or corporate entity, subject to NCGS 57D-2-01(e) and NCGS 57D- 6-07; f. A name change of the current permittee; g. A naive change of the project; It. A mailing address change of the permittee; 2. Any individual or entity found to be in noncompliance with the provisions of this stormwater management permit or the requirements of the stomiwater rules is subject to enforcement procedures as set forth in NCGS 143 Article 21. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. The permittee grants DEI-tNR Staff permission to enter the property for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and rcissuance or termination does not stay any permit condition. I assume the permit reflects this? Regardless, our contact with the Town of Kure Beach is David Heglar(davidheglar@townofkurebeach.org), and I am sure he can rectify the inconsistent expiration issues with you. In addition to the offsite portion, this permit approves the use of underground infiltration trenches to treat a portion of the runoff. Likely the areas draining to these trenches either couldn't drain to the offsite ponds or the ponds didn't have enough capacity to handle this area. • Finally, as to SW8 950709 (Kure Dunes Phase III), assuming this permit encompasses our northernmost runoff area's diversion into our northern HOA neighbor, The Keys at Kure Beach HOA's retention pond, this is offsite treatment as well, so assuming there is no expiration issue for the permit, the only issue is transferring the name under the permit, which now should also be the Kure Dunes Homeowners'Association, Inc., yes? If the project has been built and has been turned over to the HOA, then the permit should be transferred to the HOA. VAN DER VAART Secretary TRACY DAVIS Director Effective August 1, 2013 the State Stormwater program has been transferred from the Division of Water Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified, transferred, or renewed. My research has yielded the following information: 1. Kure Dunes IV has their own permitted pond with an outlet structure and small diameter orifice. They do not rely on The Keys at Kure Beach pond to treat their runoff. 2. After treatment in the Kure Dunes IV pond, the one -inch. design storm discharges from the orifice over the course of approximately 3.9 days into a piped collection system in Anchor Way that eventually drains into The Keys pond. At the request of the Division during the review of the Kure Dunes IV application, an engineering analysis of the impact of this discharge on The Keys pond was provided by Mark Hargrove, P.E., formerly of Dawson Engineering. The engineer concluded that the impact was negligible. I attach a copy of Mr. Hargrove's summary to this letter. If you want a copy of the entire engineering analysis (about 100 pages), please contact Cameron Weaver to schedule that file review and pay for the copies. 3. A deed of easement was recorded on February 7, 1995, between Gulf Stream Developers, Inc. (as Grantor) and Kure Beach Associates (as Grantee). Gulf Stream granted a 10-foot easement along Anchor Way to Kure Beach Associates to construct a piped collection system that connects into existing piping within Sloop Pointe Lane and conveys the Kure Dunes IV pond discharge to The Keys pond. 4. The deed of easement endeavors to assure the full and complete use of the easement by Kure Beach Associates, and indicates that Gulf Stream Developers, Inc. will "provide in its Homeowners Documents a method for assuring the maintenance of the pond including where applicable a joint maintenance agreement with Grantee in form acceptable to the State of North Carolina and its pemtitting agencies." It is not the Division's responsibility to require Gulf Stream to provide that maintenance assurance now. Please contact the entities that are party to that deed of easement to negotiate the creation of the assured maintenance agreement. Box 22 Kure Beach, NC 28449 Subject:: Stormwater Permit No!SW8961234 Kure Dunes Phase IV New Hanover County Dear Mr. Hearne: The Division of Water Quality issued a Coastal Stormwater Management Permit, Number SW8961234 to Kure Beach Associates, for a High Density stormwater pond to serve Kure Dunes Phase IV on 9/18/1997. This permit will expire on 9/18/2007. Section .1003(h) of 15 A NCAC 2H .1000 (the stormwater rules) requires that applications for permit renewals shall be submitted 180 days prior to the expiration of a permit and must be accompanied by a processing fee, which is currently set at $420.00. If this is still an active project please complete and submit the enclosed renewal application in a timely manner. If this project has not been constructed and a permit is no longer needed, please submit a request to have the permit rescinded. If you have sold the project, or are no longer the permittee, please provide the name, mailing address and phone number of the person or entity that is now responsible for this permit. Enclosed is a form for change of ownership, which should be completed and submitted if the property has changed hands. Your permit requires that upon completion of construction and prior to operation of the permitted treatment units a certification of completion be submitted to the Division from an appropriate designer for the system installed. This is to certify. that the permitted facility has been installed in accordance with the permit, the approved plans, specifications and supporting documentation. Please include a copy of the certification with your permit renewal request and processing fee. Enclosed is a copy of a sample certification. Also enclosed is a new Operation and Maintenance agreement that should be completed and submitted along with your renewal application. You should be aware that failure to provide the Designer's Certification and the operation of a stormwater treatment facility without a valid permit, are violations of NC General Statute 143-215.1 and may result in appropriate enforcement action including the assessment of civil penalties of up to $10,000 per day.
