Dear Mr. Hearne:
This Certification is pursuant to the application for Kure Dunes - Phase III received on July 21,
1995. Staff review of the project plans and specifications has determined that the stormwater control
system as proposed for Kure Dunes - Phase III will comply with the Stormwater Regulations set forth
in Title 15A NCAC 2H.1003(i). The runoff from 380,714.4 square feet will be treated in a detention
pond sized to achieve 90% reduction in Total Suspended Solids.
Any modification of the plans submitted to and approved by this Office or further development
of this site regardless of the fact that the modification may be less than 1 acre, will require an additional
Stormwater Submittal/Modification and approval prior to initiation of construction. Modifications include
but are not limited to; project name changes, transfer of ownership, redesign of built -upon surfaces,
addition of built -upon surfaces, redesign or further subdivision of the project area.
This Certification shall be effective from the date of issuance until rescinded. The project shall
be constructed and maintained in accordance with the plans and specifications approved by the
Wilmington Regional Office. This Certification does not supersede any other permit or approval. The
developer is responsible for obtaining any and all permits and approvals necessary for the development
of this project. This could include the Division of Coastal Management under CAMA requirements, the
Division of Environmental Management under Wetland 401 Water Quality Certification and/or a Dredge
and Fill Permit and/or a Sewer Extension/Collection Permit, U.S. Army Corps of Engineers 404 Wetland
Permit, NPDES Stormwater Permit if disturbing five acres or more, local County or Town Agency
permits under their local ordinances, or others that may be inquired.

A professional engineer must certify that the stormwater system has been installed in accordance
with the approved plans and specifications upon completion of construction. The attached certification
should be received by this Office within 30 days of completion of construction.
The detention pond must be constructed in it's entirety, operational for it's intended use, and
permanently vegetated prior to the construction of any impervious surfaces proposed as a part of the
project, except roads.

WET DETENTION POND EVALUATION

1-inch of rainfall and is located above the permanent pool.

DRAINAGE CALCULATIONS FOR
KURE DUNES, PHASE 3
- Data used in these calculations was obtained from copies of documents dated December 2, 1992
which were provided by Linda Lewis and consisted of hand written calculations prepared by the DEM,
Water Quality Section. The hand written calculations were performed to determine the capacity of the
stormwater detention pond. The following calculations confirm that the existing stormwater detention
pond is capable of treating the stormwater runoff from Kure Dunes, Phase 3.
FROM INFORMATION PROVIDED BY DEM:
ALLOWABLE IMPERVIOUS AREA FOR PHASE 3 (ROADS ONLY):
= 0.5 + 0.4 = 0.9 ACRES
ALLOWABLE SITE IMPERVIOUS AREA (EXCLUDING ROADS):
= 0.7 [( 4.6 - 0.5 ) + ( 3 - 0.4 )] = 4.69 ACRES
TOTAL ALLOWABLE IMPERVIOUS AREA:
= 4.69 + 0.9 = 5.59 ACRES

- Only 0.9 acres were set aside for roads in Phase 3 development. We have proposed 1.01 acres.
Therefore, the amount of impervious area set aside for the lots (4.69 acres) must be adjusted.

- The document obtained from the DEM stated that 74.3% impervious surface was allowed for Phase 3.
We are proposing 73.9% which is acceptable since it is less than 74.3%.

between GULP STREAM DEVELOPERS, INC., a North Carolina Corpora-
tion, (-Grantor"); and KURE BEACH ASSOCIATES, a North Carolina
General Partnership, (^Grantee^);

THAT WHEREAS, said Grantor is the owner of the common areas
and street rights of way shown on the Final Plat of Phase 1-B of
The Keys at Kure Beach recorded in Map Book 34 Page 165 of the
New Hanover County Registry; and
WHEREAS, the Grantee is the owner of a certain tract of land
immediately South of and adjoining the land of the Grantor; the
same being the land conveyed to them by L 6 H INVESTMENTS by dead
dated October 17, 1985, and recorded in Book 1305 at Page 1608 in
the Office of the Register of Deeds for New Hanover County; and
WHEREAS, said Grantee desires to drain the above referenced
property into a lake located adjacent to and on the North of the
Grantor's tract shown on Map Book 34 Page 165 of the aforesaid

WHEREAS, it is necessary that in so doing that the Grantee
lay a pipeline for said drainage across said lands of the Grantor

NOW THEREFORE, said Grantor, for and in consideration of the

said Grantee a perpetual right and easement to construct and
maintain across and upon said land of Grantor an underground
drainage line extending across said land of Grantor to the lake
located adjacent to and on the North of Grantor's above described
property said easement being described as follows:
TRACT 1
A 10 foot drainage easement located along the entire western
right of way line of Anchor Nay, a public street shown on a map
entitled ^Pinal Plat Phase 1-B The Keys at Rure Beach" and
recorded in Map Book 34 Page 165 of the New Hanover County
Registry. The eastern line of said 100 foot easement is the
western right of way line of said anchor way.
Beginning at the point of intersection of the western line
of Anchor Way with the southern line of Sloop Pointe Lane, said
intersection being shown on a map of Phase 1-B The Keys at Kure
Beach recorded in Map Book 34 at Page 165 of the New Hanover
County Registry; running thence South 72 degrees 15 minutes 45
seconds west 10 feet to a point in the southern right of way line
of Sloop Pointe Lane, running thence North 12 degrees 35 minutes
00 seconds West 57 feet more or less to a point in the northern
right of way line of Sloop Pointe Lane said point being in the
Southern line of a thirty foot drainage easement; running thence
northwardly about 10 feet to a point in the northern right of way
line of Sloop Pointe Lane that lies South 12 degrees 35 minutes
00 seconds East 57 feet more or less from the point of beginning,
thence South 12 degrees 35 minutes 00 seconds East 57 feet more
or less to the point of beginning.

That tract described as -Drainage Easement" being thirty
feet vide, lying North of Sloop Pointe Lane and being shown on a
map of Phase 1-B The Keys at Kure Beach recorded in Map Book 34
Page 165 of the New Hanover County Registry.
The Grantor hereby grants to the Grantee the right to go
upon said lands whenever the same is reasonably necessary for the
purpose of inspecting, maintaining and repairing said drain
pipes, provided that in constructinq and repairing said line the
Grantee will remove all surplus earth, make level the surface of
the ground above said line and interfere as little as is reason-
ably possible with any plants, fences, streets or other improve-
ments upon the land of the Grantor.
The Grantor for itself, its successors and assigns further
covenants with the Grantee that in order to assure the full and
complete use of this easement by Grantee, Grantor will (i) join
with the Grantee in Grantee's application(s) for storm water
management permits to the State of North Carolina, and/or any of
its permitting agencies, (it) allow the Grantee full and complete
access to the drainage pond for the purpose of doing any work,
modifications or maintenance thereto required by the permitting
agency as a condition of granting the storm water permit, and
(lit) provide in its Homeowners Documents a method for assuring
the maintenance of the pond including where applicable a joint
maintenance agreement with Grantee in form acceptable to the
State of North Carolina and its Permitting agencies.

To have and to hold said right and easement to it the
Grantee, and its successors in title; it being agreed that these

nant to and run with the land now owned by the Grantee and
hereinabove referred to.
