The Wilmington Regional Office received a complete Stormwater Management Permit Renewal
Application for Harvest Grove on July 28, 2009. The Division is hereby notifying you that permit
SW8 951007 has been renewed on November 5, 2009, and shall be effective until August 13,
2017. The plans previously approved on August 13, 1997 in accordance with the regulations
set forth in Title 15A NCAC 2H.1000 effective September 1, 1995, remain in full force and effect.
The renewal and reissuance of this stormwater permit does not imply that the site is currently in
compliance. This site was reinspected on Tuesday, November 3, 2009 and was found to be out
of compliance with the terms and conditions of this state stormwater permit. According to the
Plan of Action submitted by yourself to the Division of Water Quality (DWQ) on August 4, 2009,
the inspection deficiencies will be completed by 90 days from the date the letter was submitted,
or December 9, 2009. Failure to complete these actions by the date provided may initiate
enforcement action.
Please pay special attention to the Operation and Maintenance requirements in this permit.
Failure to establish an adequate system for operation and maintenance of the stormwater
management system will result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory, hearing upon written request within thirty (30) days following
receipt of this permit. This request must be in the form of a written petition, conforming to
Chapter 150E of the North Carolina General Statutes, and filed with the Office of Administrative
Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this
permit shall be final and binding.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North
Carolina as amended, and other applicable Laws, Rules, and Regulations

operation and maintenance of a detention pond in compliance with the provisions of 15A
NCAC 2H .1000, effective September 1, 1995, (hereafter referred to as the "stormwater
rules') and the approved stormwater management plans and specifications and other
supporting data as attached and on file with and approved by the Division of Water
Quality and considered a part of this permit.
The permit is hereby renewed subject to the following addendums, clarifications,
conditions and limitations:
1. The original permit conditions contained in the permit issued on August 13,
1997 remain in full force and effect, except as amended herein. (An additional
copy of this original permit can be obtained from the Division of Water
Quality, Wilmington Regional Office.)
2. This permit shall be effective from the date of issuance until August 13, 2017.
3. The permittee shall submit a permit renewal application request at least 180
days prior to the expiration date of this permit. The renewal request must
include the applicable documentation and the processing fee.
4. Decorative spray fountains are allowed in a wet detention pond, subject to the
following criteria:
a. The fountain must draw its water from less than 2' below the permanent
pool surface.
b. Separated units, where the nozzle, pump and intake are connected by
tubing, may be used only if they draw water from the surface in the
deepest part of the pond.
c. The falling water from the fountain must be centered in the pond, away
from the shoreline.
d. The maximum horsepower for a fountain in this pond is 1/6 horsepower.
e. A fountain is not allowed if the permanent pool volume of the pond is less
than 30,000 cubic feet.
5. If the use of permeable pavement is desired, this permit must be modified to
add the permeable pavement conditions.

Comment: Areas along the banks of the pond are washing away. Up on the slopes
where the grass may have been cut too closely and in the pond itself, perhaps due to
animals. These areas need to be stabilized.

Dear Ms. Lau:
I have received a message on Sept. 14, 2009, from Bob Myrick, President of the Harvest Grove HOA. He
advised that he discussed the last two major issues that needed to be resolved with you. You advised
Bob to instruct me to write a letter to you describing the remedy for the two problems as follows:
1. There were three French drain discharges into the pond from houses. You stated that these
three discharges could remain in place if properly repaired to eliminate erosion. These three
outlets will be repaired to your satisfaction by October 30, 2009.
2. The other discharge is from the back yard of a house on the North side of the pond. Mr. Myrick
discussed this with the owner of the property. The owner advised Mr. Myrick that he will plug
up this discharged drain immediately, thereby eliminating this problem. This will also be
repaired to your satisfaction by October 30, 2009.
I trust now that all of the major issues have been resolved. Thanks again for all of your kindness,
patience, and assistance.

controls conducted on 9/26/2007 to determine compliance with Stormwater Permit Number

Dear Ms. Lau:
This response is a follow up to the meeting with you, me, and Bob Myrick, President of Harvest Grove
H.O.A., on Tuesday, July 28, 2009.
I am responding to the three major issues that must be resolved:
1. Stormwater Permit renewal- I bought the renewal permit and gave it to you on July 28, 2009.
You called me on July 30 and advised that the renewal fee was $505.00 in lieu of the $500.00
that I submitted. I advised that I would send another check for $5.00 with this letter. You will
find the $5.00 check enclosed .
2. Additional discharges — There are three French drain discharges into the pond from houses. After
discussing this matter, you advised that they could remain in place and the three outlets needed
to be repaired to eliminate erosion. This repair work will be done. The other discharge is from
the back yard of a house on the Northside of the pond. There were several alternatives discussed
at length and Bob Myrick is assuming the responsibility to make the final recommendation to
resolve this problem. I think he will be working on a satisfactory recommendation very soon.
3. The 2" orifice draw down — When you made inspection, you could not determine if the orifice
draw down was 2". 1 did advise you at our Tuesday, July 28, meeting that the orifice is most
definitely 2". The water clarity was not good. I re -assured myself by climbing down along the
side of the outlet box to make sure that the orifice is 2".
We are asking for 90 days to correct the above deficiencies.

Dear Mr. Beasley:
Please find attached a copy of the completed form entitled "Stormwater Compliance
Inspection Report". The report summarizes the findings of a recent inspection of the
project's stormwater controls conducted on June 11, 2009 to determine compliance with
Stormwater Permit Number SW8 951007 issued on August 13, 1997.
The required actions that are necessary to bring this site into compliance are noted on
the attached inspection report. Please inform this Office in writing before Friday,
August 7, 2009, of the specific actions that will be undertaken and the time frame that
will be required to correct the deficiencies. Failure to provide the requested information,
when required, may initiate enforcement action including the assessment of civil
penalties of up to $10,000 per day.
As indicated in the attached inspection report the following issues must be resolved:
1. Submit a renewal request along with the necessary fee and documentation
(Enclosed).
2. Either eliminate the additional discharges into the system (the French drains) or
modify the permit and plans to include them.
3. Perform necessary maintenance to the system so that it will perform as it was
designed. Provide documentation that the orifice has been installed as designed,
with a 2" orifice.

Inspection Summary:
The following deficiencies were noted during the inspection:
1. The permit has expired.
2. Some additional drainage area is coming into the pond from an adjacent property's pond via French drains. There are
3 additional French drains draining to the pond that were not shown in the plans.
3. 1 was also unable to find the downturned 4" pvc pipe outside of the outlet structer that was shown to have a 2" orifice.
If the orifice is 4" instead of 2" then the pond is not holding the design storm for the required detention time.
4. The system does not appear to have been maintained
To bring this permit into compliance you must:
1. Submit a renewal request along with the necessary fee and documentation (Enclosed).
2. Either eliminate the additional discharges into the system (the French drains) or modify the permit and plans to include
them.
3. Perform necessary maintenance to the system so that it will perform as it was designed. Provide documentation that

Comment: If the orifice is 4" instead of 2" then the pond is not holding the design

maintained when there is a problem instead of in regular intervals. The mowing is also
being performed by the homeowners in order to keep the area aesthetically pleasing.

The Division of Water Quality issued a Coastal Stormwater Management Permit, Number SW8951007 to Harvest Grove
Subdivision for a High Density project on August 13, 1997. This permit expired on August 13, 2007. Section .1003(h) of
15 A NCAC 2H .1000 (the stormwater rules) requires that applications for permit renewals shall be submitted 180 days
prior to the expiration of a permit and must be accompanied by a processing fee, which is currently set at $505.00. If this
is still an active project please complete and submit the enclosed renewal application in a timely manner. If this project
has not been constructed and a permit is no longer needed, please submit a request to have the permit rescinded. If you
have sold the project, or are no longer the permittee, please provide the name, mailing address and phone number of the
person or entity that is now responsible for this permit. Enclosed is a forth for change of ownership, which should be
completed and submitted if the property has changed hands.
Your permit requires that upon completion of construction and prior to operation of the permitted treatment units a
certification of completion be submitted to the Division from an appropriate designer for the system installed. This is to
certify that the permitted facility has been installed in accordance with the permit, the approved plans, specifications and
supporting documentation. Please include a copy of the certification with your permit renewal request and processing fee.
Enclosed is a copy of a sample certification. Also enclosed is a new Operation and Maintenance agreement that should
be completed and submitted along with your renewal application.
You should be aware that failure to provide the Designer's Certification and the operation of a storrmwater treatment
facility without a valid permit, are violations of NC General Statute 143-215.1 and may result in appropriate enforcement
action including the assessment of civil penalties of up to $10,000 per day.

Howdy Dave,
This is in reference to permit SW8951007 for the wet detention pond at the Harvest
Grove Subdivision off of Greenville Loop Road. Mr. Myrick came by the office on
Tuesday afternoon in order to talk to someone about the status of a name ownership
change from the developer to the HOA. He stated that he'd left messages for you
over the past couple of weeks.
This morning I was finally able to look at the file that Cam and Janet picked up
from storage for me, and I was unable to find any correspondence regarding a
name/ownership change. Nor did I find anything recent in BIMS. In BIMS I did find
a name change that Dean Hunkele did for the facility in 2007, but I suspect that
was just turning it from "Unknown WiRO" to the correct owner that's listed there
today?
Something I did find in the file was an October 2, 2007 non-compliance inspection
letter from Pat. In the letter she mentioned items they needed to address, the
primary of which was their requirement to renew the permit. However, her
correspondence was the second to the last item in the file, the last being a July
2, 2008 "File Access Record" from Allen Maxwell with the HOA. So I'm guessing that
they never responded to the renewal request, and we need to follow up on that?
The message I left for Bob mentioned that I found no "Name/Ownership changer -
request in the file, and that we'll be following up on the need for the permit to
be renewed. '
Is there a standard follow up letter to "re -ask" for a renewal that I could send to
the permittee? If so, could you point or send it to me so that I can go ahead and
get the ball started again on this one? If there isn't a shell then please let me
know that too so that I can just tweak something I've used before.
