Your offices have reviewed the PCN and attended a site meeting with the parties involved on August 12, 2014. Following that meeting, we received review comments from both offices, to which we are ready to respond. David, on September 16, Mark Cathey of our office discussed with you an issue which has arisen regarding the project. We have designated an upland area for disposal of the sediment which is to be removed during the project. To create this disposal area, we must excavate a hilltop and use the excavated area to build a dike to hold the material. We have become concerned with the potential for bedrock in the excavation, and have decided to use the services of a geotechnical sub - consultant to determine the depth to refusal (rock). In order to gain access to the proposed disposal area by our geotechnical consultant, we need to improve the future access road to allow his track drilling machine to get to the site. This will involve the installation of the 3 sections of pipe for the streams which cross the existing road. Based on your input, we have arrived at a decision that means we need to have 2 separate PCN's for the project in lieu of the single PCN. Therefore, we are hereby withdrawing the current PCN so that we can submit 2 separate applications. We will submit PCN #1 for the piping of 3 short stream sections on the future haul road, which will allow the pipes to be installed for the driller's access as well as to serve as the sediment haul road. We will then submit PCN #2, which will describe the actual removal of sediment from the river and the restoration of the river banks following dam and sediment removal. PCN #2 will include new information which will address the questions from your review of the original PCN submittal. Therefore, we request that you withdraw our original PCN application and we will submit PCN #1 in the next week. Thanks for your understanding of our situation, and we appreciate your patience as we move toward finalizing the permitting on this important project.
