The Wilmington Regional Office received a complete, modified Stormwater
Management Permit Application for IKA Works North America Expansion and
Renovation on January 24, 2012 Staff review of the plans and specifications has
determined that the project, as proposed, will comply with the Stormwater Regulations
set forth in Title 15A NCAC 2H 1000 and Session Law 2008-211, as applicable We are
forwarding Permit No SW8 880910 dated January 25, 2012, for the construction,
operation and maintenance of the BMP's and built -upon areas associated with the
subject project
This permit shall be effective from the date of issuance until January 25, 2020, and shall
be subject to the conditions and limitations as specified therein Please pay special
attention to the conditions listed in this permit regarding the Operation and Maintenance
of the BMP(s), recordation of deed restrictions, procedures for changes of ownership,
transferring the permit, and renewing the permit Failure to establish an adequate
system for operation and maintenance of the stormwater management system, to
record deed restrictions, to transfer the permit, or to renew the permit, will result in
future compliance problems
The following modifications are included and covered by this permit
The expansion of the existing facility and the demolition and re -design the
existing parking lots resulting in the addition of 17,520 square feet of impervious
area to the previously permitted drainage area
• The expansion of the existing wet detention pond to incorporate a forebay also
increases the permanent pool surface area and the provided storage volume
Please note that the original design was based on the NGVD29 datum which is
approximately 1 foot higher than NAVD88, which is why the elevations appear 1
foot lower than originally permitted
If any parts, requirements, or limitations contained in this permit are unacceptable, you
have the right to request an adjudicatory hearing by filing a written petition with the
Office of Administrative Hearings (OAH) The written petition must conform to Chapter
150B of the North Carolina General Statutes, and must be filed with the OAH within
thirty (30) days of receipt of this permit You should contact the OAH with all questions
regarding the filing fee (if a filing fee is required) and/or the details of the filing process

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North
Carolina as amended, and other applicable Laws, Rules, and Regulations

FOR THE
construction, operation and maintenance of one (1) wet detention pond in compliance with
the provisions of 15A NCAC 2H 1000 and Session Law 2008-211, as applicable (hereafter
collectively referred to as the "stormwater rules') the approved stormwater management
plans and specifications and other supporting data as attached and on file with and approved
by the Division of Water Quality and considered a part of this permit
This permit shall be effective from the date of issuance until January 25, 2020, and shall be
subject to the following specified conditions and limitations
I DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data
This stormwater system has been approved for the management of stormwater runoff
as described in Section 18 of this permit The stormwater control has been designed
to handle the runoff from 116,727 square feet of impervious area
A 50' wide vegetative buffer must be provided and maintained adjacent surface
waters, measured horizontally from and perpendicular to the normal pool of
impounded structures, the top of bank of both sides of streams and rivers and the
mean high water line of tidal waters
4 A vegetated filter strip is not required for this pond as it has been designed for a 90%
total suspended solids removal efficiency
The tract will be limited to the amount of built -upon area indicated in this permit, and
per approved plans This permit does not provide any allocation of built -upon area for
future development
6 All stormwater collection and treatment systems must be located in either dedicated
common areas or recorded easements The final plats for the project will be recorded
showing all such required easements, in accordance with the approved plans

II SCHEDULE OF COMPLIANCE

The stormwater management system shall be constructed in its entirety, vegetated
and operational for its intended use prior to the construction of any built -upon surface
During construction, erosion shall be kept to a minimum and any eroded areas of the
system will be repaired immediately
The permittee shall, at all times, provide the operation and maintenance necessary to
assure the permitted stormwater system functions at optimum efficiency The signed
and approved Operation and Maintenance Agreement must be followed in its entirety
and maintenance must occur at the scheduled intervals
Records of maintenance activities must be kept and made available upon request to
authorized personnel of DWQ The records will indicate the date, activity, name of
person performing the work and what actions were taken
Decorative spray fountains will not be allowed in the stormwater treatment system, as
the permanent pool volume is less than 30,000 cubic feet
The facilities shall be constructed as shown on the approved plans This permit shall
become void unless the facilities are constructed in accordance with the conditions of
this permit, the approved plans and specifications, and other supporting data

7 Upon completion of construction, prior to issuance of a Certificate of Occupancy, and
prior to operation of this permitted facility, a certification must be received from an
appropriate designer for the system installed certifying that the permitted facility has
been installed in accordance with this permit, the approved plans and specifications,
and other supporting documentation Any deviations from the approved plans and
specifications must be noted on the Certification A modification may be required for
those deviations
8 If the stormwater system was used as an Erosion Control device, it must be restored
to design condition prior to operation as a stormwater treatment device, and prior to
occupancy of the facility
9 Access to the stormwater facilities for inspection and maintenance shall be maintained
via appropriate recorded easements at all times
10 The permittee shall submit to the Director and shall have received approval for revised
plans, specifications, and calculations prior to construction, for any modification to the
approved plans, including, but not limited to, those listed below
a Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc
b Redesign or addition to the approved amount of built -upon area or to the
drainage area
c Further development, subdivision, acquisition, lease or sale of any, all or part of
the project area The project area is defined as all property owned by the
permittee, for which Sedimentation and Erosion Control Plan approval or a
CAMA Major permit was sought
d Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan
11 Prior to the construction of any permitted future areas shown on the approved plans,
the permittee shall submit final site layout and grading plans to the Division for
approval
12 The Director may notify the permittee when the permitted site does not meet one or
more of the minimum requirements of the permit Within the time frame specified in
the notice, the permittee shall submit a written time schedule to the Director for
modifying the site to meet minimum requirements The permittee shall provide copies
of revised plans and certification in writing to the Director that the changes have been
made
13 Approved plans and specifications for this project are incorporated by reference and
are enforceable parts of the permit A copy of the approved plans and specifications
shall be maintained on file by the Permittee at all times
III GENERAL CONDITIONS
This permit is not transferable to any person or entity except after notice to and
approval by the Director At least 30 days prior to a change of ownership, or a name
change of the permittee or of the project, or a mailing address change, the permittee
must submit a completed and signed Name/Ownership Change Form to the Division
of Water Quality, accompanied by the supporting documentation as listed on the form
The approval of this request will be considered on its merits and may or may not be
approved
2 The permittee is responsible for compliance with all permit conditions until such time
as the Division approves the transfer request Neither the sale of the project in whole
or in part, nor the conveyance of common area to a third party constitutes an
approved transfer of the stormwater permit

3 Any individual or entity found to be in noncompliance with the provisions of this
storrmwater management permit or the requirements of the Stormwater rules is
subject to enforcement procedures as set forth in G S 143 Article 21
4 The issuance of this permit does not preclude the Permittee from complying with any
and all statutes, rules, regulations, or ordinances, which may be imposed by other
government agencies (local, state, and federal) having jurisdiction
5 In the event that the facilities fail to perform satisfactorily, the Permittee shall take
immediate corrective action, including those as may be required by this Division, such
as the construction of additional or replacement stormwater management systems
6 The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility
7 The permit remains in force and effect until modified, revoked, terminated or renewed
The permit may be modified, revoked and reissued or terminated for cause The filing
of a request for a permit modification, revocation and re -issuance or termination does
not stay any permit condition
8 Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual
9 The permittee shall submit a permit renewal request at least 180 days prior to the
expiration date of this permit The renewal request must include the appropriate
documentation and the processing fee

DESIGN NARRATIVE
IKA Works, Inc's North American Headquarters located in the Northchase Industrial
Development Park of New Hanover County is proposing to expand their existing facility A
new primarily office and showroom space addition will be constructed on the front of the
building while a "butler building" will be attached on the rear of the building as a new testing
area The 2-story office expansion is approximately 16,000 total square feet while the butler
building will be approximately 6,000 square feet In addition an existing front parking lot will
be demolished and replaced with a lot containing 52 parking spaces, a small parking strip will
be installed along the common drive accommodating 10 parking spaces, and the rear parking
lot will be resurfaced and restriped to accommodate 62 parking spaces for a total of 124 parking
spaces This project will be contained within the existing parcel of land having an area of 4 53
acres
PROPOSED IMPROVEMENTS
This project proposes to perform corrective actions to the existing pond based on the most
recent NCDENR Notice of Inspection and expand it to accommodate the runoff for the net
additional BUA The original pond was designed and permitted in 1988, while the expanded
area of the pond will meet current regulatory requirements, the original pond footprint and
section is not being modified and will remain in the condition in which it was originally
ermitted, constructed and certified
The field conditions pertaining to sloughed slopes and sediment deposits in the pond bottom
observed on May 30, 2006 (based upon July 20, 2006 Notice of Inspection) were previously
corrected as can be seen in the existing conditions topographic survey Follow up inspections
were performed and site conditions approved by County staff however DWQ was not notified
of the improvements at that time Review of the existing contours indicates that the permitted
permanent pool surface area and pond depth are currently being met with minor sediment
deposits in the pond bottom Therefore clearing the trees on the IKA side of the pond, removal
of minimal areas of sediment deposition in the bottom of the existing pond, establishing grass
as the vegetative cover on the side slopes and repairs to the outlet structure are the proposed
maintenance items for the existing pond
The expansion to the existing pond was designed to treat the proposed built -out condition of a
4 53 acre drainage area with a 59 2% composite impervious area The wet pond treatment
volume was calculated using the existing permitted BUA with a 10" design runoff volume (as
required in the original 1988 permit) and adding in the net increase in BUA using a 15 " design
runoff volume The existing pond is lengthened through the addition of a forebay in order to
provide the required surface area and treatment volume The required surface area was met
using an SA/DA Ratio from the 59 2% composite impervious area and a 3 0 foot pond depth as
originally approved in the 1988 permit issuance
The forebay was sized to treat the weight based volume from the drainage area that flows from
the proposed piped system to the upstream segment of the pond Based upon the design
calculations that were performed, the expansion to the existing pond proposes to construct a
forebay at the upstream end of the existing pond sized to treat this weighted average of the
total drainage area that outfalls to this point This proposed forebay exceeds the typical 20%
for this weight -based drainage area, however, this extra storage helps minimize nuisance
sedimentation accumulation from the offsite drainage area that flows under Northchase
Parkway and into this pond
In addition, a name change application will be provided to change the permittee from Chuck
Agnoff to IKA Works, Inc subsequent to the April 20, 2006 request

jurisdictional assessment services at the above -referenced site. S&ME was requested by
you to perform these services in preparation for the planned site improvements. S&ME
has conducted these services in general accordance with S&ME Proposal 091A-1 I dated
April 5, 201 1.
PROJECT BACKGROUND
T'hc project site is located on the south side of Northchase Parkway SE, approximately
0.25 mile east of its intersection with North College Road in Wilmington, North Carolina.
The site is located in an area developed with high -density residential and commercial/
light industrial buildings. Several drainage ditches used to convey stormwater were
observed in the area. T`he project site is currently developed with one building.

western and southern property boundaries. Past development activities included the
placement of till for the building pad and for apparent landscaping/buffering purposes
between the building and Northchase Parkway.
STORMWATER SUITABILITY EVALUATION
T'he project site is located in an area mapped by the New Hanover County soil survey as
containing the Leon soil series (Figure 1) which is described as having a seasonal high
water table within one foot of the soil surface. This soil series is also described as having
slightly cemented to cemented subsurface soil horizons.

The seasonal high water table evaluations were performed on April 19, 2011 by
advancing hand auger borings to depths ranging from approximately 47 inches to 60
inches below the existing ground surface at the two test locations — one in front of the
building (SW -I) and one behind the building (SW-2).
Soils were evaluated under the guidance of a Licensed Soil Scientist for evidence of
seasonal high water table influence. This evaluation involved looking at the actual
moisture content in the soil and observing the matrix and mottle colors. Depending on
the soil texture, the soil color will indicate processes that are driven by seasonally high
water table fluctuations, such as iron reduction and oxidation and organic matter staining.
A hand auger boring profile sheet, which provides a description ofthe observed soil
horizons and the determined seasonal high water tables, has been included with this
report.
The soils at the test locations were observed to range from loamy surface horizons to
sandy and clay subsurface horizons. Fill material was encountered at the surface at both
locations with thicknesses varying from approximately 20 to 28 inches. The seasonal
high water table was determined to be approximately 20 inches below the existing ground
surface at SW-1 and 40 inches below the ground surface at SW-2.
See Figure 2 (attached) for the approximate test locations.
please note that groundwater levels fluctuate for numerous reasons, and these findings do
not indicate that groundwater levels have not or will not rise above the noted depths.
Due to the presence of fill material unsuitable for stormwater infiltration, compacted
and/or cemented subsurface soil horizons, and close proximity of the seasonal high water
table beneath the fill horizons, it is our opinion that neither test location would be suitable
for stormwater infiltration. We discussed this with Mr. Richard Collier with McKim &
Creed, the project engineer, while on site. Mr. Collier was aware of the potential for soil
conditions not being suitable for stormwatcr infiltration, and we agreed that in -situ
hydraulic conductivity testing would not be needed.
JURISDICTIONAL ASSESSMENT
Ourjurisdictional assessment included a review of published literature, maps and data to
evaluate the potential forjurisdictional waters of the U.S. on the project site, as well as a
site reconnaissance. Reference materials reviewed included National Wetland Inventory
(NWI) maps, New Hanover County Soil survey. New Hanover County GIS maps, and
USGS topographic maps.
Review of NWI maps revealed a majority of the property being mapped as containing
palustrian, forested evergreen wetland (Figure 3). U'SGS topographic maps did not
indicate the presence of any potential jurisdictional surface waters (Figure 4). New

Hanover County GIS maps showed a low area along the eastern and southern property
boundaries (Figure 5). The New Hanover County Soil Survey did not indicate any
jurisdictional features on the project site (Figure 1).
Nojurisdictional waters of the U.S. were identified on the subject property during our site
reconnaissance. The low area napped along the southern and western property
boundaries is a swale and basin system that appears to be associated with the previously
permitted stormwater management system for the site and surrounding developed areas.
Photos of the Swale and basin system are attached. These features are nlan-made and
constructed to treat stormwater runoff from nearby impervious surfaces. Although they
may have a cotulection to jurisdictional waters of the U.S., their construction was most
likely permitted by the North Carolina Department of Environment and Natural
Resources, thus precluding their inclusion into the category of jurisdictional waters of the
U.S.

DESIGN NARRATIVE
PROPOSED PROIEC I
IKA Works, Inc's North American Headquarters located in Northchase in New Hanover
County is proposing to expand their existing facility A new primarily office and showroom
space addition will be constructed on the front of the building while a "butler building" will be
attached on the rear of the building as a new testing area The 2-story office expansion is
approximately 16,000 total square feet while the butler building will be approximately 6,000
square feet In addition an existing front parking lot will be demolished and replaced with a
jot containing 52 parking spaces, a small parking strip will be installed along the common drive
accommodating 10 parking spaces, and the rear parking lot will be resurfaced and restriped to
accommodate 62 parking spaces for a total of 124 parking spaces This project will be
contained within the existing parcel of land having an area of 4 53 acres
PROPOSED IMPROVEMENTS
This project proposes to perform corrective actions to the existing pond and expand it to
accommodate the runoff for the net additional BUA
The field conditions pertaining to sloughed slopes and sediment deposits in the pond bottom
observed on May 30, 2006 (based upon July 20, 2006 Notice Of Inspection) were previously
corrected as can be seen in the existing conditions topographic survey Follow up inspections
were performed and site conditions approved by County staff however DWQ was not notified
of the improvements at that time Review of the existing contours indicates that the permitted
permanent pool surface area and pond depth are currently being met with minor sediment
deposits in the pond bottom Therefore clearing the trees on the IKA side of the pond, removal
of minimal areas of sediment deposition in the bottom of the existing pond, establishing grass
as the vegetative cover on the side slopes and repairs to the outlet structure are the proposed
maintenance items for the existing pond
The expansion to the existing pond was designed to treat the proposed built -out condition of a
4 53 acre drainage area with a 59 29/6 composite impervious area Pond sizing was performed
by evaluating 413 acres of drainage area at an impervious percentage of 55 01% and a design
rainfall depth of 1" (existing impervious area) and 0 40 acres of drainage area at an impervious
percentage of 100% with a design rainfall depth of 15" (proposed impervious area) The
forebay was sized to treat the weight based volume from the design storm that flows from the
proposed piped system to the upstream segment of the pond Based upon the design
calculations that were performed, the expansion to the existing pond consists primarily of
constructing a forebay at the upstream end of the existing pond sized to treat this weighted
average of the total drainage area that drams to this point Additional volume was also
included to help minun,ze nuisance forebay sedimentation accumulation from the offsite
drainage area that flows through the pond
In addition, a name change application will be provided to change the pernuttee from Chuck
Agnoff to IKA Works, Inc subsequent to the April 20, 2006 request

I have no problem with how you are determining the BUA to be treated When you start looking at the related drainage
area (DA), the DA to be considered at the 1" design storm would be the total DA— net BUA addition In other words the
DA for the 1 5" would be equal to the BUA (or 100% impervious) This is assuming the onsite total DA isn't increasing
Now on to the issues you presented
1 If you are considering expanding the current pond, then the section that is being expanded (and only that area)
needs to meet the current design standards by including a vegetated shelf, forebay, and such You will have to
look at the SA/DA ratio and consider the average depth The forebay must be designed to handle approx 20% of
the flow coming to that area (similar to the design calcs for multiple forebays in the BMP manual,)
2 As you know SHWT calls are made on sod colors that take years to develop and may or may not reflect the
current conditions I have seen cases made where nearby ditches, ponds, and outfalls that have been there for a
decade or so has lowered the water table such that the SHWT has been lowered and the elevation more closely
matches the new outfall With this pond being over 15 yrs old, it seems that you might be able to make this case
for this project
3 1 have no problem with the forebay being deeper than the pond
4 The offsite drainage that is going through the pond must be considered under the same standards as when this
permit was originally issued The only difference would be to consider the offsite area at the full built out
potential

Because it seemed like there was some question Thursday regarding adding proposed BUA into an existing permitted
BMP and the limits of required improvements to it, I wanted to present this to you for confirmation This route is being
considered by IKA after a long coordination and budgeting meeting with them Friday morning I will try to be as brief as
I can but want to put all the cards on the table so we don't miss anything
Current permitted BUA = 99,207 SF (treated at 1")
Total proposed BUA = 116,727 SF **
Net BUA addition = 17,520 SF (treated at 1 5")
** - the "Total Proposed BUA" consists of the existing BUA minus the BUA being demo'd plus the proposed BUA
Therefore, the proposed improvements shown in the attached drawing are to treat 17,520 SF of BUA with a design
rainfall depth of 1 5" This schematic design includes 2 retaining walls on each side of the BMP (to obtain adequate
average depth in a 60' easement) and a forebay to treat only the net BUA addition
The issues I would like to have addressed are
1- My understanding of our conversation is that I need only to consider treatment of BUA over and above the
previously permitted BUA square footage at a 1 5" rainfall depth, the required BMP expansion for this additional
BUA is the only portion of the pond that must meet current standards, and the offlme forebay will treat only this
increase in BUA over and above the permitted BUA Is this correct?
2- The PPE is 30 0' (based on NAVD88), the SHWT is approximately 34 33 on the north end of the pond and 32 87
at the south end Both of these elevations are well outside of the +/-6" range from SHWT However it is obvious
that lining only this expanded section of the BMP would be fruitless What will DWQ's stance be on the PPE
being this far out of range from the +/-6" and not being lined?
3- The existing BMP is permitted at a depth of 3' To obtain an average depth of at least 3', our BMP expansion
must be deeper than that As proposed in the attached, our bottom of pond elevation is 25 5' — this means this
section of the BMP will be 1 5' deeper than the existing BMP
4- There is an offsite drainage area of approximately 12 acres based on recent delineations This offsite drainage
area was included in the calculations that were originally approved back in 1988 However they were only
provided to show that the hydraulics of the pond were analyzed to ensure adequate sizing of the spillway
system — the treatment volumes that were calculated, and subsequently permitted, did not account for any
offsite drainage areas and the plans did not show a bypass of the BMP IE the plans showed, and were
approved, with this offsite drainage area draining through the BMP with no stormwater quality considerations
for it

I guess the only real question I have at this point goes back to the fact that we are going to propose expanding the

Consequently, as was the procedure back then, we could not transfer the permit Today, we would be able to
transfer the permit to IKA, and then pursue the compliance aspect through the new permittee
Please have a person of at least the level of VP in IKA sign the latest permit transfer form Or, the consultant or
other agent can sign the form as long as the form is accompanied by a letter of authorization signed by a
person of at least the level of VP in IKA That's all that needs to be submitted Mr Agnoff does not need to sign
off on the newer form, as he had already signed off on the transfer on the 2006 paperwork Please remember
to submit the original signed form to DWQ We can't accept a photocopied signature
Have the remedial measures to restore the pond been completed? The pond was certified in 1993, so no
additional certification is needed, however, we would like written verification that the required remedial
measures outlined in the July 20, 2006 inspection report have been completed

I was at your office yesterday to do a file review on SW8 880910 Forrest Plaza 1 and noticed that there was an attempt to
do a name change on this permit in 2006 The last correspondence to that applicant was a request for additional
information on May 19, 2006
A stormwater inspection was performed by DENR staff and a report was sent to the original permittee on July 20, 2006
requiring some remedial measures prior to a permit transfer This was the most recent correspondence of any kind that I
could find So based on my review, it appears as though the permit that is valid is still the original issuance of a
Determination of Compliance dated September 26, 1988 There was a note on the front of this protect folder to "return to
Linda's inspection file" - I wanted to confirm the above information with you just in case you had some of the paperwork
out of this file - I didn't know if this was an active file you were working on and perhaps a reissued permit to IKA was not in
it at the time of my review
IKA (the applicant for the name change in 2006) is planning an expansion of their facility I need some help
understanding what needs to be done to get this plan approved I assume that the remedial measures listed in July 20,
2006 inspection report need to be completed and that we could then do a name change and plan approval at the same
time to get the permit into IKA's name Can you confirm this for me9

The wet ponds of 1988 were not designed with any requirement to meet pre/post runoff volumes or flowrates
don't think the 14 acres should be considered at all because I don't know where that 14 acres is and because
the permitted drainage area to the pond is only 4 53 acres, of which 2 28 is Impervious
My last understanding of the proposed project was that a new BMP was being designed for the new BUA and
the old BMP was going to be remediated to address the July 2006 violation after Issuance of the revised
permit Has this now changed? Are you now proposing to utilize the existing pond for treatment?
Your methodology to apply the 1" design storm to the currently permitted 2 28 acres of impervious area and to
apply the 1 5" design storm to the new impervious area is correct However, since our last correspondence in
2006, there has been a rules change regarding the review of modifications to previously permitted projects If
you are going to use the existing pond for treatment, you will also need to recalculate the required minimum
surface area based on the permitted design depth of 3 feet, and the larger amount of BUA (i e , higher percent
impervious, higher SA/DA ratio )
If you can meet the new surface area minimum, and store the entire volume (V old plus 1 5" new) in the pond
as it was permitted without enlarging the pond or changing elevations, then the pond does not have to be
brought up to today's standards However, it will still need to be remediated to the previously permitted
condition,-Ityou:hav-e to enlarge the pond:to accommodate the- new_required-minimum-surface area and/or
volume then you wdl have to redesign the pond -to meet-today's design_standardsincludmg_a forebayJ
vegetated shelf -and -a surface areabased on the averaae-depth

I know I e-mailed you not too long ago on this project regarding the pending name change to IKA Works I am straight
there We have now completed a design and are close to being ready for submittal In fact, I spoke with Janet Russel
today to make sure the express process hasn't changed and to find out current lead times for review appointments
In doing my final CIA on the plans I realized I need to get clarification on one item I'm fairly certain that we are on the
right path but wanted to let you confirm for me The original wet detention pond was sized for an overall drainage area
of 14 acres in terms of pre/post analysis and had a water quality volume size determined based upon the size of the
subject tract — 4 53 acres at 50% impervious (with a 1" rainfall)
Therefore, we have designed our site using those same parameters with the exception of using a 1 5" rainfall event for
the new BUA So our water quality volume was determined using 1" rainfall over the existing site BUA and 1 5" rainfall
over proposed BUA And the hydraulics of the pond itself above the WQV were designed to pass the regulated storm
events required by New Hanover County
I attached the copies that I made during my file review to save a few steps for you in case the file isn't handy Can you
please provide me confirmation or your thoughts on this? I'll be out of the office next week but will be checking voice

I talked to Linda about the proposed liner & the 'uncertain' SHWT elevation in the new pond She refreshed my memory
that when ponds are lined as a result of the SHWT being above the PP, the Inver is required to go above the SHWT (not
just the PP) in order to prevent groundwater from seeping into the pond, taking up the required storage volume, and
impacting the drawdown time
I will have to talk to Vincent about the SHWT, but without a boring in that area or a survey of the elevations in that area
before the site was filled, I imagine it would be hard to justify only lining the pond below the vegetated shelf

DESIGN NARRATIVE
IKA Works, Inc's North American Headquarteis located in Noithchase in New Hanover
County is proposing to expand their existing facility A new pumanly office and showroom
space addition will be constructed on the front of the building while a "butlei building' will be
attached on the rear of the budding as a new testing area The 2-stay office expansion is
approximately 16,000 total square feet while the butler building will be approximately 6,000
square feet In addition an existing front pai king lot will be demolished and replaced with a
lot containing 52 parking spaces, a small parking strip will be installed along the common drive
accommodating 10 parking spaces, and the rear parking lot will be resurfaced and restriped to
accommodate 62 parking spaces for a total of 124 parking spaces This project will be
contained within the existing parcel of land having an area of 4 53 acres
PROPOSED IMPROVEMENTS
This project proposes to perfa in corrective actions to the existing pond and to construct a new
wet pond for the net additional BUA
The field conditions pertaining to sloughed slopes and sediment deposits in the pond bottom
observed on May 30, 2006 were previously con ected as can be seen in the existing conditions
topographic survey Follow up inspections were performed and site conditions approved by
County staff however DWQ was not notified of the improvements at that time Review of the
existing contours indicates that the permitted pei manent pool surface area and pond depth are
currently being met Therefore clearing the trees on the IKA side of the pond, establishing
grass as the vegetative cover and repairs to the outlet structure are the proposed improvements
for the existing pond
The proposed wet pond will treat the net increase in built upon area A wet pond is designed
to meet all current DWQ State Stormwater requirements for wet detention ponds including
forebay, littoral shelf, a temporary water quality volume sufficient to treat the 1 5" runoff
volume from the net increase in BUA and construction of a new spillway system meeting the 2-
5 day detention requirements of NCDENR
In addition, a name change application will be provided to change the permittee from Chuck
Agnoff to IKA Works, Inc subsequent to the Apri120, 2006 request

DESIGN NARRATIVE
PROPOSED PROTECT
IKA Works, Inc's North American Headquarters located Northchase in New Hanover County
is proposing to expand their existing facility Anew primarily office and showroom space
addition will be constructed on the front of the building while a "butler building" will be
attached on the rear of the building as a new testing area The 2-story office expansion is
approximately 16,000 total square feet while the butler building will be approximately 6,000
square feet In addition an existing front parking lot will be demolished and replaced with a
lot containing 52 parking spaces, a small parking strip will be installed along the common drive
accommodating 10 parking spaces, and the rear parking lot will be resurfaced and restriped to
accommodate 63 parking spaces for a total of 125 parking spaces This project will be
contained within the existing parcel of land having an area of 4 53 acres
PROPOSED IMPROVEMENTS
This project proposes to completely renovate the existing wet detention pond bringing it up to
current standards to treat all of the onsite BUA This includes clearing of all trees within the
pond area, provision of a forebay and littoral shelf, a temporary water quality volume
sufficient to treat the 1 5" runoff volume from the permitted site using the newly proposed
average depth and construction of a new spillway system for meeting the 2-5 day detention
requirements of NCDENR
In addition, a name change application will be provided to change the permittee from Chuck
Agnoff to IKA Works, Inc subsequent to the April 20, 2006 request

We did SHWT evaluations for a building/facility expansion in the North Chase business park off North College Road a few
months ago At the time, we identified what seemed to be potential fill so we did not run our infiltration test The engineer
came back to us today and said they think they can't make an infiltration basin fit using the minimum rate of 0 52 in/hour
I mentioned that there's fill at that location which typically excludes an area from being used for infiltration but that
occasionally DWQ will approve fill material if it is reasonably suitable and has been in place long enough to naturalize, so
to speak They asked that I set up a meeting with you to review the area they would like to use for infiltration to get your
opinion on the soil Unfortunately, they're in a hurry Are you available anytime soon? Shouldn't take us very long

Thank you very much for your response I have not been to the site yet so I can not confirm whether the remedial
measures have been completed at this time But from what I understand from discussions with others, they have not
I guess the only real question I have at this point goes back to the fact that we are going to propose expanding the
facility The stormwater will not be treated in the previously permitted pond however I understand that the remedial
measures on that pond will need to be completed Can we submit the permit transfer request at the same time as the
plans for the proposed expansion? This package would also provide some level of detail for completing the remedial
measures This would require it being acceptable to you to perform the remedial measures at the same time as the
installation of the new BMPs associated with the expansion

We never received any communication or confirmation that the pond had been restored to design condition
Consequently, as was the procedure back then, we could not transfer the permit Today, we would be able to
transfer the permit to IKA, and then pursue the compliance aspect through the new permittee
Please have a person of at least the level of VP in IKA sign the latest permit transfer form Or, the consultant or
other agent can sign the form as long as the form is accompanied by a letter of authorization signed by a
person of at least the level of VP in IKA That's all that needs to be submitted Mr Agnoff does not need to sign
off on the newer form, as he had already signed off on the transfer on the 2006 paperwork Please remember
to submit the original signed form to DWQ We can't accept a photocopied signature
Have the remedial measures to restore the pond been completed? The pond was certified in 1993, so no
additional certification is needed, however, we would like written verification that the required remedial
measures outlined in the July 20, 2006 inspection report have been completed

I was at your office yesterday to do a file review on SW8 880910 Forrest Plaza 1 and noticed that there was an attempt to
do a name change on this permit in 2006 The last correspondence to that applicant was a request for additional
information on May 19, 2006
A stormwater inspection was performed by DENR staff and a report was sent to the original permittee on July 20, 2006
requiring some remedial measures prior to a permit transfer This was the most recent correspondence of any kind that I
could find So based on my review, it appears as though the permit that is valid is still the original issuance of a
Determination of Compliance dated September 26, 1988 There was a note on the front of this protect folder to "return to
Linda's inspection file" - I wanted to confirm the above information with you just in case you had some of the paperwork
out of this file - I didn't know if this was an active file you were working on and perhaps a reissued permit to IKA was not in
it at the time of my review
IKA (the applicant for the name change in 2006) is planning an expansion of their facility I need some help
understanding what needs to be done to get this plan approved I assume that the remedial measures listed in July 20,
2006 inspection report need to be completed and that we could then do a name change and plan approval at the same
time to get the permit into IKA's name Can you confirm this for me?

of Compliance", and consisted essentially of a page or two -nothing like today's
permits Additionally, only low density projects were required to submit the
application form The permit was in the file, but there is no application form I
can certainly send you a copy of the permit and I can complete the design
information on pages 1-3 of the pond supplement form based on the approved
calculations and plans, which you can then sign, notarize and return

with NCDENR related to the Forest Plaza I Project I looked through files on
this project and only saw actual premit For Land Disturbing Activity for
4880910 IKA is buying Forest Plaza I from Bob Fullerton The original owner
was Chuck Agnoff
I was told by engineer with Tripp that a storm water permit existed with above
ref # SW8 880910, but this was not evident in file other then by reference in
letter from McKim and Creed in 1993 by A Street Lee
Our engineer as advised us that it would be beneficial to get current owner to
transfer existing permit in our name prior to closing on builiding He has
agreed to do this, but I can't find copy of permit to have him transfer over

care now if we plan to expand on the site in next 2 years? Does a storm water

Erosion Permit for Phase II on Monday April 13, 1992
The removal of the sediment in the pond basin and over the overflow inlet and outlet
orifice will be accomplished during the clearing and grading work for Phase II
Regrading and reseeding of the pond banks will also be accomplished during the Phase
II clearing and grading work This work will commence as soon as permits are obtained,
hopefully, the last week of April 1992

Dear Mr. Angoff:
This office has reviewed the subject sedimentation and erosion
control plan. We find the plan to be acceptable. HOWEVER,
THIS IS NOT A GRADING PERMIT.
Please be advised that a copy of the approved soil erosion plan
and a copy of issued grading permit must be available at all
times at the site.
New Hanover County's Soil Erosion and Sedimentation control
program is performance oriented. Requiring protection of the
natural resources and adjoining properties. If following the
commencement of the project it is determined that the plan is
inadequate to meet the requirements of the New Hanover County
Soil Erosion and Sedimentation Control Ordinance, this office
may require revisions in the plan and its implementation to
insure compliance with the ordinance.
Recognizing the desirability of early coordination of
sedimentation and erosion control, I would like to arrange a
pre -construction conference with owner/agent, grading
contractor, engineer, and myself. Proceed with the placement
of the planned erosion control measures; these will be
inspected at the pre -construction conference. Please contact
this office to set the date of the pre -construction conference
at which time you shall be issued the grading permit. However,
this permit will not preclude any other permits or approvals
necessary for beginning or completing this development.

Erosion control measures to be installed prior to grading
(1) Retention basin as shown with a controlled outlet.
(2) Construction exit to be located where construction
traffic encounter a paved surface.
(3) Silt fencing as needed.
(4) Contact Ann Hines to outline New Hanover County Tree
Preservation.
