The Wilmington Regional Office received a complete modified State Stormwater
Management Permit Application for Broad & Gales Creek Fire Department Addition on
November 14, 2012 Staff review of the plans and specifications has determined that
the protect, as proposed, will comply with the Stormwater Regulations set forth in
Session Law 2008-211 and Title 15A NCAC 2H 1000 We are forwarding Permit No
SW8 120218 dated November 15, 2012, for the construction, operation and
maintenance of the BMP's and built -upon area associated with the subject project
The modifications covered by this permit include
1 Removal of one of the previously permitted infiltration basins
2 Minor changes to the design of the remaining infiltration basin
This permit shall be effective from the date of issuance until June 26, 2020, and shall be
subject to the conditions and limitations as specified therein Please pay special
attention to the conditions listed in this permit regarding the Operation and Maintenance
of the BMP(s), certification of the BMP's, procedures for changing ownership,
transferring the permit, and renewing the permit Failure to establish an adequate
system for operation and maintenance of the stormwater management system, to certify
the BMP's, to transfer the permit, or to renew the permit will result in future compliance
problems
If any parts, requirements, or limitations contained in this permit are unacceptable, you
have the right to request an adjudicatory hearing by filing a written petition with the
Office of Administrative Hearings (OAH) Per NCGS 143-215(e), the written petition
must conform to Chapter 150E of the North Carolina General Statutes, and must be
filed with the OAH within thirty (30) days of receipt of this permit You should contact
the OAH with all questions regarding the filing fee (if a filing fee is required) and/or the

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of
North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
construction, operation and maintenance of one (1) alternative design, infiltration basin
in compliance with the provisions of the 2008 version of 15A NCAC 2H 1000 (hereafter
referred to as the "stormwater rules') and the approved stormwater management plans
and specifications and other supporting data as attached and on file with and approved
by the Division of Water Quality and considered a part of this permit
This permit shall be effective from the date of issuance until June 26, 2020, and shall
be subject to the following specified conditions and limitations
I DESIGN STANDARDS
1 This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data
2 This stormwater system has been approved for the management of stormwater
runoff as described in Section 17 of this permit The infiltration basin labeled as
Basin 1 has been designed to treat the runoff from 44,693 square feet of built -
upon area
3 The tract will be limited to the amount of built -upon area indicated in Section 17
of this permit, and as shown on the approved plans
4 All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans
5 The runoff from all built -upon area within the permitted drainage area of this
project must be directed into the permitted stormwater control system
6 The project must provide a 50' wide vegetated buffer adjacent surface waters,
measured horizontally from and perpendicular to the normal pool of impounded
structures, the top of bank of both sides of streams and rivers, and the mean
high water line of tidal waters, as shown on the approved plans

8 Per section 1008 (h) of the stormwater rules, this alternative design basin
provides equal or better protection because it infiltrates a 10-year, 24-hour storm
without discharging, using an infiltration rate of one-half of the expected
infiltration rate provided in the soils report The infiltration basin is designed in
accordance with Option 4 of Section 16 3 9 of the BMP manual, therefore, no
bypass, no vegetated filter strip, and no additional storage volume are required
II SCHEDULE OF COMPLIANCE
1 The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built -upon surface
2 During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately
3 The facilities shall be constructed as shown on the approved plans This permit
shall become voidable unless the facilities are constructed in accordance with
the conditions of this permit, the approved plans and specifications, and other
supporting data
4 If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility
5 A copy of the approved plans and specifications shall be maintained on file by
the Permittee at all times

6 The permittee shall at all times provide the operation and maintenance
necessary to assure the permitted stormwater system functions at optimum
efficiency The approved Operation and Maintenance Plan must be followed in
its entirety and maintenance must occur at the scheduled intervals including, but
not limited to
a Semiannual scheduled inspections (every 6 months)
b Sediment removal
c Mowing and revegetation of slopes and the vegetated filter
d Immediate repair of eroded areas
e Maintenance of all slopes in accordance with approved plans and
specifications
f Debris removal and unclogging of bypass structure, infiltration media, flow
spreader, catch basins, piping and vegetated filter
g A clear access path to the bypass structure must be available at all times
7 Records of maintenance activities must be kept for each permitted BMP The
reports will indicate the date, activity, name of person performing the work and
what actions were taken
8 Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation Any deviations from the
approved plans and specifications must be noted on the Certification A
modification may be required for those deviations
9 Access to the stormwater facilities shall be maintained via appropriate recorded
access and drainage easements at all times
10 The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below
a Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc
b Redesign or addition to the approved amount of built -upon area or to the
drainage area
c Further development, subdivision, acquisition, lease or sale of any, all or
part of the project area The project area is defined as all property owned
by the permittee, for which Sedimentation and Erosion Control Plan
approval or a CAMA Major permit was sought
d Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan
11 The permittee shall submit final site layout and grading plans for any permitted
future areas shown on the approved plans, prior to construction
12 The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made
III GENERAL CONDITIONS
Approved plans and specifications for this protect are incorporated by reference
and are enforceable parts of the permit

2 This permit is not transferable to any person or entity except after notice to and
approval by the Director At least 30 days prior to a change of ownership, or a
name change of the permittee or of the protect or a mailing address change, the
permittee shall submit a completed and signed Name/Ownership Change form to
the Division of Water Quality, accompanied by the appropriate documentation as
listed on the for The approval of this request will be considered on its merits
and may or may not be approved
3 The permittee is responsible for compliance with all permit conditions until such
time as the Division approves a transfer request
4 Any person or entity found to be in noncompliance with the terms and conditions
of this stormwater permit or with the stormwater rules, is subject to enforcement
action by the Division of Water Quality, in accordance with North Carolina
General Statute 143 Article 21
The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction
In the event that the facilities fad to perform satisfactorily the Permittee shall take
immediate corrective action, including those as may be required by this Division,
such as the construction of additional or replacement stormwater management
systems
The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility
The permit issued shall continue in force and effect until revoked or terminated
Per Section 1011 of the stormwater rules, the permit may be modified, revoked
and reissued or terminated for cause The filing of a request for a permit
modification, revocation and reissuance or termination does not stay any permit
condition
9 Unless specified elsewhere, permanent seeding requirements for the stormwater
controls must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual
10 The issuance of this permit does not prohibit the Director from reopening and
modifying the permit, revoking and reissuing the permit, or terminating the permit
as allowed by the laws, rules and regulations contained in Session Law 2008-
211, Title 15A NCAC 2H 1000, and NCGS 143-215 1 et al
11 The permittee shall submit a permit renewal application at least 180 days prior to
the expiration date of this permit The renewal request must include the
appropriate documentation and the processing fee

VII DEED RESTRICTIONS AND PROTECTIVE COVENANTS
For all subdivisions outparcels and future development, the appropriate property restrictions and protective
covenants are required to be recorded prior to the sale of any lot If lot sizes vary significantly or the proposed
BUA allocations vary, a table listing each lot number lot size, and the allowable built -upon area must be
provided as an attachment to the completed and notarized deed restriction form The appropriate deed
restrictions and protective covenants forms can be downloaded from

submittal
In the instances where the applicant is different than the property owner it is the responsibility of the property
owner to sign the deed restrictions and protective covenants form while the applicant is responsible for ensuring
that the deed restrictions are recorded

DESIGN NARRATIVE
1 GENERAL
The project site is located along NC Highway 24 and is approximately 0 9 miles east of the
intersection of NC Highway 24 and Broad Creek Loop Road in Newport, N C The intent of
this project is to construct a new building with associated parking, storm drainage and storm
water management device
2 EXISTING SITE
The existing site is located in the coastal area and is not within % miles of SA waters The site
is currently developed that includes fire station and EMT facility Topographically the site is
mostly flat (approximately 0 50%) with runoff from this site being collected into road side
ditches The runoff from the site eventually enters into the Broad & Gales Creek (Stream
Class SA, HQW)
Based on Carteret County Soil Survey, the existing sods are WuB (Wando), Se (Seabrook)
and KuB (Kureb) The hydraulic sod group used was "A " The FEMA Flood Insurance Rate
Map (Panel 6306) shows the project site to not located within a flood hazard area The USGS
map, the Carteret County sod survey map, and the FEMA map are included in this report
3 PROPOSED IMPROVEMENTS
This project will have a disturbed area of 153 acres, in which the majority of the disturbed area
will be utilized for the construction of the building, parking areas, stone drainage, and
infiltration basins
The site will be graded such that the majority of stormwater runoff from the proposed
improvements will be directed by sheet flow to the infiltration basin shown on plan sheet C-4 0
Runoff from the impervious areas built after 1988 will be collected in storm pipes/french dram
system and directed to the infiltration basin A complete set of calculations, including hydraulic
grade line calculations, for the stormwater drainage are attached
Stormwater Control and Treatment
The current NCDENR Coastal Stonmwater Rules require the control and treatment of runoff
generated by the first 1 5' of rainfall, or the difference in the stormwater runoff of pre -
development and post -development conditions for the 1-year, 24-hour storm, whichever is
greater The Simple Method was used to determine which runoff volume was greater
The Infiltration Basin was designed to handle runoff generated from a 1 56 acre drainage area
as shown on enclosed Map 2 Calculations resulted in the volume generated by the 1-year,
24-hour, storm (3 65") being greater than the volume generated by the first 1 5" of rainfall
therefore, the basin was designed for the volume generated by the 3 65" rainfall event
Water Quantity
Routing results prove that both infiltration basins meet pre -post development conditions for the
1-year, 24 hour stone Furthermore, both basins contain the 10-year storm and therefore,
vegetated filters are not required See table below for results of pre -post development

See the Hydraulic Summary's for 10-year storm routing and maximum elevation results
A soil evaluation prepared by Fred D Smith Sod Consulting, Inc dated October 141", 2011,
states that the infiltration rate of the existing sods range above 0 52 inches/hour, which would
be favorable for the design of an infiltration device Infiltration rates ranged from 35 9 in/hr to
71 6 in/hr The infiltration rate of 17 95 in/hr (50% of 35 9) was used in design of the infiltration
basins Furthermore the seasonable high water table was observed to be approximately 78
inches below the surface
4 EROSION CONTROL AND MAINTENANCE CONSIDERATIONS
Temporary silt fence will be placed along the lowest sides of the limits of disturbance to
cleanse stormwater runoff before leaving the site Temporary diversion ditches will be installed
to direct stormwater runoff from the site to sediment basin Inlet protection will be placed
around all new drainage structures that may be affected by the proposed construction
Calculations for the design of the sediment basins are attached All erosion control measures
are documented on the enclosed erosion control plan
Contractors shall be responsible for periodic inspection and maintenance of all indicated
erosion control devices In addition, inspection and any necessary maintenance will be
required immediately following any significant storm event Any measure that fads to function
as intended shall be repaired immediately Upon completion of construction, the property
owner shall be responsible for site maintenance

This letter concerns the soil evaluation I performed at the above mentioned site You authorized
me to perform a sod evaluation of the surface soils on the site to determine the depth to the
`seasonal high water table', and to perform in -situ sod permeability testing at the site
You provided me with site drawings that show the existing and planned buildings The site
currently is occupied by a parking lot for the fire station I understand that the fire station will
have an addition buck.
My work consisted of hand auger borings to observe and describe physical properties such as
texture, color, structure, consistency, depth to seasonal or perched groundwater, parent
material, and restrictive horizons The soils are described into the USDA sod classification
system
The sod is formed from wind blown and marine deposits of sediments

The soils are deep sands that do not exhibit any cemented layers or cementation of sand grams
(or shallow seasonal water tables) which are typical in the area
Groundwater was encountered below about 92 inches beneath the surface The seasonal high
water table at this site is about 78 inches beneath the surface where sod moisture significantly
increased Gray colors that are indicative of seasonal water tables were present at this depth
The soil permeability of the soil layers at the site was measured using an Aardvark Soil
Permeability The Aardvark Permeameter maintains a constant head of water in a bore hole
The rate of water movement is measured over tune_ The results are entered into an Excel
spreadsheet program that computes the permeability value in inches per hour
The Aardvark field forms are attached The test results are presented below The approximate
locations of all bongs and tests are shown on the accompanying drawing.
Prior to beginning the tests, the bore hole was allowed to soak for about 15 minutes Tins is to
fill the sod pore spaces around the boring so that saturated hydraulic conductivities are
measured

The above saturated hydraulic conductivity rates are average rates I suggest that a
safety factor be used for design purposes Generally, the academic and regulatory
community agrees with using 10% of average conductivity for a safety factor In
addition, the column on the attached permeability field report forms shows a `Design
Loading Rate in gallons per square foot per day' that has a 10% safety factor
