The Wilmington Regional Office received a complete Stormwater Management Permit
Application for Black's Tire on February 24, 2011 Staff review of the plans and specifications
has determined that the project, as proposed, will comply with the Stormwater Regulations set
forth in Title 15A NCAC 2H 1000 and Session Law 2008-211 We are forwarding Permit No
SW8 110206 dated February 28 2011, for the construction of the subject project
This permit shall be effective from the date of issuance until February 28, 2021 and shall be
subject to the conditions and limitations as specified therein Please pay special attention to the
Operation and Maintenance requirements in this permit Failure to establish an adequate
system for operation and maintenance of the stormwater management system will result in
future compliance problems
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory hearing upon written request within thirty (30) days following
receipt of this permit This request must be in the form of a written petition, conforming to
Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative
Hearings, P O Drawer 27447, Raleigh, NC 27611-7447 Unless such demands are made this
permit shall be final and binding

North Carolina as amended, and other applicable Laws, Rules, and Regulations

construction, operation and maintenance of one wet detention pond in compliance with
the provisions of 15A NCAC 2H 1000 and Session Law 2008-211 (hereafter collectively
referred to as the "stormwater rules') the approved stormwater management plans and
specifications and other supporting data as attached and on file with and approved by
the Division of Water Quality and considered a part of this permit
This permit shall be effective from the date of issuance until February 28, 2021, and
shall be subject to the following specified conditions and limitations
I DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data
This stormwater system has been approved for the management of stormwater
runoff as described in Section 18 on page 3 of this permit The stormwater
control has been designed to handle the runoff from 35,362 square feet of
impervious area There are 17,753 square feet of impervious area developed
prior to 1988 This area is not required to be treated
A 50' wide vegetative buffer must be provided adjacent impounded structures,
streams, rivers and tidal waters
4 The tract will be limited to the amount of built -upon area indicated on page 3 of
this permit, and per approved plans The built -upon area for the future
development is limited to 0 square feet

5 All stormwater collection and treatment systems
must be located in either
dedicated common areas or recorded easements
The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans
6 The runoff from all built -upon area within the permitted drainage area(s) of this
project must be directed into the permitted stormwater control system

II SCHEDULE OF COMPLIANCE
The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built -upon surface
During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately
The permittee shall at all time provide the operation and maintenance necessary
to assure the permitted stormwater system functions at optimum efficiency The
approved Operation and Maintenance Plan must be followed in its entirety and
maintenance must occur at the scheduled intervals including, but not limited to
a Semiannual scheduled inspections (every 6 months)
b Sediment removal
c Mowing and re -vegetation of slopes and the vegetated filter
d Immediate repair of eroded areas
e Maintenance of all slopes in accordance with approved plans and
specifications
f Debris removal and unclogging of outlet structure, orifice device, flow
spreader, catch basins and piping
q Access to the outlet structure must be available at all times

4 Records of maintenance activities must be kept and made available upon
request to authorized personnel of DWQ The records will indicate the date,
activity, name of person performing the work and what actions were taken
5 Decorative spray fountains will not be allowed in the stormwater treatment
system because the permanent pool volume is less than 30,OOOcf
6 The facilities shall be constructed as shown on the approved plans This permit
shall become void unless the facilities are constructed in accordance with the
conditions of this permit, the approved plans and specifications, and other
supporting data
7 Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation Any deviations from the
approved plans and specifications must be noted on the Certification A
modification may be required for those deviations
8 If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility
9 Access to the stormwater facilities for inspection and maintenance shall be
maintained via appropriate recorded easements at all times
10 The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below
a Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc
b Project name change
c Transfer of ownership
d Redesign or addition to the approved amount of built -upon area or to the
drainage area
e Further development, subdivision, acquisition, lease or sale of any, all or
part of the project area The project area is defined as all property owned
by the permittee, for which Sedimentation and Erosion Control Plan
approval or a CAMA Major permit was sought
f Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan
11 Prior to the construction of any permitted future areas shown on the approved
plans, the permittee shall submit final site layout and grading plans to the
Division for approval
12 A copy of the approved plans and specifications shall be maintained on file by
the Permittee at all times
13 The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made

III GENERAL CONDITIONS
1 This permit is not transferable to any person or entity except after notice to and
approval by the Director In the event of a change of ownership, or a name
change, the permittee must submit a completed Name/Ownership Change Form
signed by both parties, to the Division of Water Quality, accompanied by the
supporting documentation as listed on page 2 of the form The approval of this
request will be considered on its merits and may or may not be approved
2 The permittee is responsible for compliance with all permit conditions until such
time as the Division approves the transfer request Neither the sale of the project
nor the transfer of common area to a third party constitutes an approved transfer
of the stormwater permit
3 Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215 6A to 143-215 6C
4 The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction
5 In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems
6 The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility
7 The permit remains in force and effect until modified, revoked, terminated or
renewed The permit may be modified, revoked and reissued or terminated for
cause The filing of a request for a permit modification, revocation and re -
issuance or termination does not stay any permit condition
8 Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual
9 Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit
10 The permittee shall notify the Division of any name, ownership or mailing address
changes at least 30 days prior to making such changes
11 The permittee shall submit a permit renewal request at least 180 days prior to the
expiration date of this permit The renewal request must include the appropriate
documentation and the processing fee

VII DEED RESTRICTIONS AND PROTECTIVE COVENANTS
For all subdivisions, outparcels, and future development, the appropriate property restrictions and protective
covenants are required to be recorded prior to the sale of any lot If lot sizes vary significantly or the proposed

The Wilmington Regional Office received and accepted a State Stormwater Management Permit
Application for Black's Tire on February 3, 2011 A preliminary in-depth review of that
information has determined that the application is not complete Please add a drainage
easement for the wet pond and show its dimensions along with any applicable pipe sizes and
swale inverts on the plans
Please note that this request for additional information is in response to a preliminary review
The requested information should be received in this Office prior to March 21, 2011, or the
application will be returned as incomplete The return of a project will necessitate resubmittal of
all required items, including the application fee
If you need additional time to submit the information, please mail, email or fax your request for a
time extension to the Division at the address and fax number at the bottom of this letter The
request must indicate the date by which you expect to submit the required information The
Division is allowed 90 days from the receipt of a completed application to issue the permit The
construction of any impervious surfaces, other than a construction entrance under an approved
Sedimentation Erosion Control Plan, is a violation of NCGS 143-215 1 and is subject to
enforcement action pursuant to NCGS 143-215 6A Please reference the State assigned
project number on all correspondence Any original documents that need to be revised have

I see that DA1 is the "whole" tract of land including DA2 which is the area to be covered by the permit I looked online
to see when the project was originally built, but Google Earth only goes back to 1993 Do you know if the site was
developed prior to 19887 If so, then this will be a mute point Just email me some aerial pictures or other
documentation for the file If it has been developed since 1/1/88 did it require either an E&SC or a CAMA Major when it
was built? If it did, then it would have required a State Stormwater permit back then and therefore would need to be
covered now If it is pre-1988 or if it did not require an E&SC or LAMA Major when it was built since 1/1/88 then it can
be permitted as it is presented I just want to be sure I understand what you are proposing

Black's 'I ire is an eusung retail ire business and is located at 2650 Ocean Highway West, approximately
2000 feet from the north intersecuon of US 17 bypass and US 17 business in Shallotte The Tar ID
number for the property is 1820007101 and 1820007102 Fhe total project area is 1 70 acres, and is
currently partially developed land The total hunts of disturbance for this project will be 154 acres The
"stormwater project boundary" is 128 acres and is smaller than the "project boundary area" due to the fact
that a portion of the project area is already developed and will not be affected during construction
The property slopes towards north and the northeast of the property Portions of the construction area
will utih7e silt fence as the primary erosion control device This will be sufficient in these areas due to the
small area and slopes A portion of the construction area will utilize a temporary diversion directed to the
proposed stormwater detention pond This area will present the greatest potential for sediment transport
and as such will use a more aggressne sediment control device The stormwater detention pond will
function as a temporary sediment trap during construction and then be converted to a stormwater
detention pond as designed on the stormwater plans I1ie pond will be cleaned out to design depths and
slopes once it is no longer required as a temporary sediment trap A temporary construction entrance will
be installed at the entrance to the site to prevent sediment transport during construction To prevent
sediment from entering the stomiwater collection system during construction, block and gravel inlet
protection will be used on the proposed curb inlets and catch basins These measures shall be inspected
regularly, and the accumulated sediment removed to prevent the conveyance of sediment to anv off -site
areas
The prnmary permanent erosion control measures that will remain after all disturbed areas have been
stabilized and the temporary measures arc removed will bL permanent grassing A seechng schedule along
with a construction sequence, project description and erosion control notes will be included on the plans
STORMWATER MANAGEMENT NARRATIVE
The proposed development will include an addition to the existing facility of 4,339 square feet of
associated impervious area The associated gddmonal asphalt parking will consist of 31,023 square feet of
impervious area
The proposed project is located within the Lumber River Basin Fhe proposed project drains to the
Sharron Creek which is classified SC FIQW
Stormwater runoff will be allowed to sheet flow to curb and gutter and then to curb inlets The stormdrain
system will direct the runoff to an onsite detenuon pond The discharge onfice is a 1" SCH 40 pipe with
an internal diameter of 1 03" This will drawdown the required storage volume in 4 2 days The pond has
been sized to provide 90% ISS removal and does not utilize a vegetative filter strip In the event of a
larger than design ram event, an emergency spillwav has been provided I he seasonal high water table was
observed to be at 35 00 FMSL and the permanent pool elevation (PPE) was set at 35 50 FMSL

basin/trench must be marked and flagged If these areas are not flagged, the Soils Scientist
reserves the right to decline to do the investigation If the proposed infiltration system will be
located in an area of existing pavement and there is no open area nearby, equipment capable of
breaking through the impervious layer must be provided The soils investigation does not take
the place of a sods report prepared by an appropriate professional The Sods Scientist will only
verify the sod conditions that are reported in the Sods Report, and make a determination as to
the suitability of the site to meet the infiltration design requirements under NCAC 2H 1000, and
assumes no liability should the system fail

RFTS is pleased to provide testing services during the design phase of stormwater system for the
Black's Tire Store addition located at 2650 Highway 17 South in Shallotte, North Carolina
DESCRIPTION OF ACTIVITIES AND FINDINGS
As requested, our staff visited the site on December 8, 2010, to estimate the seasonal high
watertable and classify the soils at one location identified by you The purpose of this testing was
to provide soil parameters for stormwater design
Seasonal High Watertable Estimate
A hand auger boring was advanced at one location near the center of the proposed pond to a
depth of approximately 5 feet below the existing ground surface near the center of the proposed
stormwater pond The encountered soils were logged and visually classified by depth and a
Munsell Soil Color Chart was used to determine the hue, value, and chromes of the visually
distinct soil layers Our soil logs are presented in Table 1
Soils encountered in our boring consisted of clean sands (USCS Soil Group SP) in the upper 24
inches below the existing ground surface Below the depth of 24 inches and continuing through a
depth of 37 inches clayey sand (USCS Soil Group SC) was encountered From 37 inches to the
boring termination depth of 59 inches clean sands (USCS Soil Group SP) were again
encountered Comparison of the soils to the Munsell Chart suggests the presence of a limited
zone of aerated soils indicative of the seasonal water level approximately 24 inches below the
ground surface within the unsaturated zone Measurements made 30 minutes after augering
indicate a depth to standing water in the boreholes of 45 inches below the existing ground
surface

In addition, to providing an estimate of the seasonal high ground water elevation, our personnel
also visually classified the soils in the bore hole for the purpose of determining their suitability
for use as structural fill in the budding pad and parking areas Based on our visual classifications
of the soils encountered it is our opinion that the spoils excavated from the stormwater pond
could be use as structural fill provided the soils removed are blended However, our hand boring
wds advanced to a depth of approximately 5 feet below the ground surface, the soil type below
this depth are not known
